WARRANTY DEED
FOR VALUE RECEIVED, Northwestern Corporation, D/B/A/ Northwestern Energy,
a Delaware Corporation, of 40 East Broadway, Butte, Montana 59701, ("Grantor', does
hereby grant, bargain, sell and convey unto, the City of Bozeman Montana, a political
subdivision of the State of Montana of P.O. Box 1230, Bozeman, Montana 59771-1230
("Grantee', its successors and assigns, the following described premises, in Gallatin
County, Montana, to-wit:
Tract 2 of Certificate of Survey No. 473E ,located in the North Half of
Section 26, Township 1 South, Range 5 East, P.M.M., Gallatin County,
Montana, according to the official plat thereof on file and of record in the
office of the County Clerk and Recorder of Gallatin County, Montana.
Reserving onto the Grantor, its successors, assigns and apportionees, an
easement, over, under, along, and across the subject property, at the
location and of the dimensions as illustrated in Exhibit "A", which is
attached hereto, and incorporated herein, upon which to construct,
operate, inspect, maintain, replace, upgrade and remove overhead electric
power lines, communications systems, guy poles, guy anchors and
necessary appurtenances. Further reserving to Grantor, its successors,
assigns and apportionees, reasonable right of access to and from the
easement areas over the Grantee's adjoining lands, using existing roads
and trails where practicable; the right to use and keep the easement
areas free and clear of any and all obstructions or structures, except

fences; and the right to clear and remove all timber, brush or vegetation
from the easement areas that in Grantee's sole .opinion endanger the
electric power lines, communications systems or necessary
appurtenances.
Subject to the following:
1. Real Property taxes and special assessments for the year 2008 and
subsequent years;
2. Right of Way for, or any portion falling within Springhill Road or
Moss Bridge Road running across the subject property, as disclosed
in the Gallatin County Plat Books;
3. Four Right of Way Easements, respectively recorded January 23,
1959, in Book 129, Page 574; December 23, 1960, in Book 136,
Page 169; October 7, 1969, in Film 5, Page 835; April 1, 1982, in
Film 68, Page 2246;
4. Any adverse claim based on the assertion that the location of the
East Gallatin River has moved;
5. Any adverse claim that some portion of said land is now or at one
time has been within the boundaries of the East Gallatin River;
6. Any rights, interests or easement in favor of the public which exist
or are claimed to exist over that part of said land included within
the bed and banks of the East Gallatin River and any portage rights
associated therewith.
7. Provided no warranty is given to the portion of the subject property
previously described on Film 4, Page 672, as depicted on Certificate
of Survey No. 473D.
TO HAVE AND TO HOLD the said premises, with its appurtenances unto the said
Grantee, its successors and assigns forever. Grantor covenants with the Grantee that
the Grantor is now seized in fee simple absolute of said premises; that the Grantor has
full power to convey same; that the same is free from all encumbrances excepting
WARRANTY DEED.

those set forth above; that the Grantee shall enjoy the same without any lawful
disturbance; that the Grantor will, on demand, execute and deliver to the Grantee, at
the expense of the Grantor, any further assurance of the same that may be reasonably
required; and, with the exceptions set forth above, that the Grantor warrants to the
Grantee and will defend for it all the said premises against every person lawfully
claiming all or any interest in same.
