RELEASE AND.RECONVEYANCE OF EASEMENT(S)
COMES NOW the City of Bozeman, 121 North Rouse Avenue, Bozeman, MT 59715, a
Municipal Corporation of the State of Montana hereinafter ("GRANTOR") and does hereby
release and reconvey the following described easement(s) unto Bozeman Partners LLC, 111
Market St. NE Suite 200, Olympia, WA 98501, Montana as follows:
WITNESSETH
WHEREAS the Grantor is the legal record title holder of a Sewer Pipeline Easement and
Agreement recorded as Document No. 2323898, Records of the Clerk and Recorder, Gallatin
County, Montana, situated across the Grantee's tract of land located in the Northwest Quarter of
Section 2, Township 2 South, Range 5 East, P.M.M., West Winds Major Subdivision Phase 4,
Block 2, Lot 1, City of Bozeman, Gallatin County, Montana.
WHEREAS the above Sewer Pipeline Easement and Agreement(s) were granted
February 12, 2009 and recorded on March 13, 2009 at the Clerk and Recorder's Office of
Gallatin County, Montana.
WHEREAS the construction of improvements to the West Winds Phase 4 Subdivision
has been completed without having to occupy said easements recorded on March 13, 2009 was
not used as specified for a sewer line for the project and will not adversely impact the Grantor's
interests.
WHEREFORE, the Grantor does hereby release and reconvey to Bozeman Partners LLC
those portions of the easement(s) located on the above described real property as set forth on
Exhibit A attached hereto together with any right, title, or interest that the Grantor may have in
said easements.
