ASSIGNMENT OF BENEFICIAL INTEREST -MONTANA TRUST INDENTURE
FOR VALUE RECEIVED, the undersigned. hereby grants, assigns and transfers to the City of Bozeman
those beneficial interests set forth under that certain Montana Trust Indenture dated. 0 3 / 18 / 2 0 0 9 ,
executed by Joshua and Cynthia Maxwell as Grantor, to American Land Title Company, as Trustee, and.
Habitat for Humanity of Gallatin Valley, Inc. as Beneficiary, and recorded as Document No.
2 3 2 4 5 4 8 in the Official Records in the County Recorder's office of Gallatin County, Montana,
describing land therein as:
Lot 4A-1 in Block 8 of West Winds Major Subdivision Phases 2A and 2B, situated in the NW'/4
of Section 2, Township 2 South, Range 5 East, P.M.M., Gallatin County, MT
NAMELY, the specific beneficial interest that are assigned are set forth in the note incorporated by the
Montana Trust Indenture as follows:
in the event the property that secures this promissory note is sold within ten (10) years of the date
hereof, Habitat for Humanity of Gallatin Valley, Inc. shall assign all right, title and interest in the
sum of TWENTY ONE THOUSAND AND NO/100 DOLLARS ($21,000.00) of the full sum set
forth above to the City of Bozeman, PO Box 1230, Bozeman, MT 59771 in accordance with the
terms and conditions of the grant awarded May 7, 2007 to Habitat for Humanity of Gallatin
Valley, Inc. Said right to assignment from Habitat for Humanity of Gallatin Valley, lnc. to the
City of Bozeman shall be null and void. after ten (10) years from the date hereof.
TOGETHER with the note or notes therein described or referred to, the money due and. to become due
thereon with interest, and all rights accrued or to accrue under said Montana Trust Indenture.
