ORDINANCE NO. 1588
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING THE CITY OF BOZEMAN ZONE MAP AND ESTABLISHING
AN INITIAL MUNICIPAL ZONING DESIGNATION OF "R-3"
(RESIDENTIAL,
MEDIUM DENSITY DISTRICT) ON 8.2 ACRES lOCATED IN THE WEST HALF OF
THE EAST HALF, SOUTHEAST QUARTER OF THE SOUTHWEST QUARTER OF
SECTION 35, TOWNSHIP 1 SOUTH, RANGE 5 EAST, MONTANA PRINCIPAL
MERIDIAN.
WHEREAS, the proposed zone map amendment to establish an initial zoning designation of
"R-3", Residential, Medium Density District, on 8.2 acres has been properly submitted, reviewed and
advertised; and
WHEREAS, the City of Bozeman Zoning Commission held a pUblic hearing on July 3, 2001, to
receive and review all written and oral testimony on the request for a zone map amendment; and
WHEREAS, the City of Bozeman Zoning Commission recommended to the Bozeman City
Commission that the zone map amendment be approved; and
WHEREAS, after proper notice, the City Commission held its public hearing on July 23, 2001,
to receive and review all written and oral testimony on the request for a zone map amendment; and
WHEREAS, the City Commission has reviewed and considered the twelve zone change
criteria established in Section 76-2-304, M.C.A., and found the proposed zone map amendment, to be
in compliance with the twelve criteria; and
WHEREAS, at its meeting held on July 23, 2001, the City Commission found that the proposed
zone map amendment would be in compliance with the Bozeman Area Master Plan and would be in
the public interest, contingent upon annexation of the subject property; and
WHEREAS, the subject property was annexed through adoption of Commission Resolution
No. 3578. adopted on the 18th day of February 2003.
NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman,
Montana:
Section 1
That the zoning district designation of the following-described 8.2 acres is hereby initially
established as "R-3," Residential, Medium Density District.
A parcel of land located in the West one-half, East one-half, Southeast one-quarter,
Southwest one-quarter of Section 35. Township 1 South, Range 5 East, Montana
Principal Meridian, Gallatin County, Montana, being more particularly described as
follows:

Commencing at the South One-Quarter Corner of said Section 35; thence South
89016'00" West on and along the south line of said Section 35,a distance of 330.52 feet
to the true point of beginning; thence South 89016'00" West on and along the south line
of said Section 35, a distance of 165.26 feet; thence North 00005'30" West a distance of
527.17 feet; thence North 89016'00" East a distance of 165.26 feet; thence South
00005'30" East a distance of 527.17 feet to the true point of beginning. Deed reference

Section 2
The effective date is thirty days after final adoption of this ordinance on second reading.
PASSED by the City Commission of the City of Bozeman, Montana, on first reading, at a
regular session thereof held on the 18th day of February 2003.
