ORDINANCE NO. 1590
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONT ANA, AMENDING THE CITY OF BOZEMAN ZONE MAP BY AMENDING THE
ZONING DESIGNATION FROM "R-41t (RESIDENTIAL HIGH DENSITY) TO ItR_3alt
(RESIDENTIAL, TWO-HOUSEHOLD MEDIUM DENSITY DISTRICT) ON 5.22
ACRES LOCATED ALONG THE SOUTH SIDE OF WEST OLIVE STREET,
BETWEEN THE ALLEY BETWEEN SOUTH 7TH AND SOUTH 8TH AVENUES AND
SOUTH 11TH AVENUE, IN THE CITY OF BOZEMAN, GALLATIN COUNTY,
MONTANA.
WHEREAS, the proposed zone map amendment to rezone approximately 5.22 acres from
"R-4" , Residential High Density, to "R-3a", Residential Two-Household Medium Density, has been
properly submitted, reviewed and advertised; and
WHEREAS, the Bozeman Zoning Commission held a public hearing on November 19, 2002,
to receive and review all written and oral testimony on the request for a zone map amendment; and
WHEREAS, the Bozeman Zoning Commission recommended to the Bozeman City Commission
that the zone map amendment be denied; and
WHEREAS, atter proper notice, the City Commission held its public hearing on December 2,
2002, to receive and review all written and oral testimony on the request for a zone map amendment;
and
WHEREAS, written comment in support of the zoning change was received from nine (9)
property owners within the area to be re-zoned and eight (8) property owners adjacent to the subject
area; written letters in protest of the zoning change was received from four (4) property owners within
the area to be re-zoned; a written petition of support was submitted with twelve (12) signatures from
owners of legal record; and a written petition against the zoning change was submitted with seven (7)
signatures from owners of legal record; and
WHEREAS, the City Commission has reviewed and considered the twelve zone change criteria
established in Section 76-2-304, M.C.A., and found the proposed zone map amendment, to be in
compliance with the twelve criteria; and
WHEREAS, at its meeting held on December 2,2002, the City Commission found, on a vote
of 5 - 0, that the proposed zone map amendment would be in compliance with Bozeman's Adopted
Growth Policy and would be in the public interest.
NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman,
Montana:
Section 1
That the zoning district designation of the following-described property is hereby changed from
designated "R-4" , Residential, High Density, to "R-3a", Residential, Two-Household Medium Density:
A tract of land located in the NW% of the SE% of Section 12, T2S, R5E, PMM, City
of Bozeman, Gallatin County, Montana. Commencing at the point of intersection of
the centerline of South 11 th Avenue and the centerline of West Olive Street. Thence
east to the point of intersection of the centerline of West Olive Street and the

centerline of the alley that runs through Block 10, Park Addition between South 7th
Avenue and South 8th Avenue. Thence south to the current boundary thus affecting
Lots 1-6 and 21-24, Block 7, West Park Addition; Lots 1-7 and 18-24, Block 8, West
Park Addition; Lots 1-7, the north six feet of Lot 8 and Lots 18-24, Block 9, West Park
Addition; and Lots 18-24, Block 10, Park Addition. Said parcel containing 5.22 acres.
Section 2
The effective date is thirty days after final adoption of this ordinance on second reading.
PASSED by the City Commission of the City of Bozeman, Montana on first reading at a regular
session thereof held on the 24th day of February 2003.
