HomeMy WebLinkAboutProposal to Rescind Condition 16 (9:00 p.m. time limit) of Story Mansion Conditional Use Permit Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Chris Kukulski, City Manager Andy Epple, Director of Planning SUBJECT: Proposal to Rescind Condition 16 (9:00 p.m. time limit) of Story Mansion Conditional Use Permit MEETING DATE: June 8, 2009 BACKGROUND: Mayor Jacobson has requested that Commissioners rescind Condition 16 of the Story Mansion Conditional Use Permit. Condition 16 reads: “All outside activities on the Mansion grounds shall end no later than 9:00 p.m.” This condition was added by the Commission after receiving public testimony on the Story Mansion CUP application on April 13, 2009. If Condition 16 of the Story Mansion CUP is rescinded, hours of operation and occupancy of the facility and grounds would be controlled by Resolution 4156, adopted by Commissioners March 23, 2009. At the Mayor’s request, Deputy Police Chief Marty Kent has compiled data regarding service calls for noise and related disturbance complaints at Beall and Lindley Parks. His memo is attached. Finally, members of the public who participated in the public proceedings in April have been notified that the Commission will be re-visiting Condition 16 on June 8th, and have been invited to provide public comment as appropriate. RECOMMENDATION: That Commissioners consider and act upon the Mayor’s request to rescind Condition 16 of the Story Mansion Conditional Use Permit. I ran the time parameter January 1, 2008 through May21, 2009. You’ll find these parks aren’t very noisy. If we searched for noise complaints coming from private residences within a 2 or 3 block perimeter of the parks, I’m confident we would find scattered complaints but that would hold true almost everywhere in the city. It’s my opinion the Story Mansion will not be a source of noise complaints any more than our parks currently are. An argument you may want to use is when the SAE house was up and running as a fully functioning fraternity house, noise complaints were a regular weekly occurrence. The neighbors tolerated noise, alcohol and parking complaints. I believe the Story Mansion events will pale in comparison. If you need anything else, please let me know. Beall Park The Bozeman Police Department responded to a total of 26 calls for service. Noise and disturbance related calls were as follows: Animal complaints: 9 Disturbances: 1 Disorderly conduct: 1 Minor in possession 1 Lindley Park The Bozeman Police Department responded to a total of 214 calls for service. Noise and disturbance-related calls were as follows: Animal complaints: 18 Disturbances: 5 Disorderly conduct: 2 Out w/ a vehicle 79 (These are generally cars parked near the cemetery entrance after closing hours participating in a variety of behaviors.) 128
