PUBLIC STREET EASEMENT
XL Limited Partnership , GRANTOR, in consideration of$1.00 and for other and valuable
considerations, receipt of which is acknowledged, grants to The City of Bozeman, a municipal
corporation of the State of Montana,with offices at 411 East Main,Bozeman,Montana 59771-0640,
GRANTEE, a perpetual street and utility easement for the use of the public, in, through, and across
a strip of land situated in Gallatin County, Montana, thirty-two and one-half, (32.50) feet wide to
be located on the following described real property:
A tract of land located in the northwest one-quarter of Section 2,
Township 2 South,Range 5 East,P.M.M., Gallatin County,Montana.
The easement is more particularly described on the attached
Exhibit(s) "A"and"B"which by this reference are made a part hereof.
The GRANTOR states that they possess the real property described above and that they have
a lawful right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the rights
and privileges herein granted without any interruption by the GRANTOR.
The terms, covenants, and provisions of this easement shall extend to and be binding upon
the heirs, executors, administrators, personal representatives, successors, and assigns of the parties
hereto.

A tract of land located in the northwest one-quarter of section 2, Township 2 South, Range 5
East, P.M.M., Gallatin County, Montana, described as follows:
The sideline of a 32.50 foot wide public street (27`h Avenue) easement lying west of and
parallel with the following described lines:
Beginning at the center quarter corner of said Section 2, North 01 027'13" East along the east-
west mid-section line, a distance of 1334.21 feet;
Thence North 01°15'40" East continuing along the east-west mid-section line, a distance of
1325.30 feet to the north section line of said Section 2 and the end of this easement;
The side lines of said easement being lengthened or shortened so as to begin on the east-west
mid-section line of Section 2 and end upon the north section line of said Section 2.
Said Tract contains 1.984 acres, more or less.
