HomeMy WebLinkAboutOrdinance 03- 1593 Amends zoning map, Cattail Creek Phase I __.. n_.__.____ ____m ORDINANCE NO. 1593 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING THE CITY OF BOZEMAN ZONE MAP BY ESTABLISHING INITIAL ZONING DESIGNATIONS OF "R-2" (RESIDENTIAL SINGLE-FAMILY, MEDIUM DENSITY DISTRICT), uR-3A" (RESIDENTIAL TWO-FAMILY, MEDIUM DENSITY DISTRICT), AND uR_3" (RESIDENTIAL MEDIUM DENSITY DISTRICT) ON 59.03 ACRES SITUATED IN THE NORTHWEST ONE-QUARTER AND SOUTHWEST ONE-QUARTER OF SECTION 35, TOWNSHIP 1 SOUTH, RANGE 5 EAST, PRINCIPAL MERIDIAN MONTANA. WHEREAS, the proposed zone map amendment to establish initial zoning designations of "R-2", (Residential Single-Family, Medium Density District), "R-3A" (Residential Two-Family, Medium Density District), and "R-3", (Residential, Medium Density District) and on 59.03 acres has been properly submitted, reviewed and advertised; and WHEREAS, the City of Bozeman Zoning Commission held a public hearing on July 2, 2002, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the City of Bozeman Zoning Commission recommended to the Bozeman City Commission that the zone map amendment be approved as submitted; and WHEREAS, after proper notice, a public hearing was set before the City Commission on July 22, 2002, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the City Commission held its public hearing on July 22, 2002, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, no members of the general public spoke in opposition to the zone map amendment. WHEREAS, the City Commission has reviewed and considered the twelve zone change criteria established in Section 76-2-304, M.C.A., and found the proposed zone map amendment, as recommended by the Zoning Commission, to be in compliance with the twelve criteria; and WHEREAS, at its meeting held on July 22, 2002, the City Commission found that the proposed zone map amendment would be in compliance with the Bozeman Area Master Plan and would be in the public interest upon annexation of the subject property; and WHEREAS, the subject property was annexed under Commission Resolution No. 3585 on the 31 st day of March 2003. NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman, Montana: -..".--.------ Section 1 That the zoning district designation of the following-described property is hereby initially established as "R-2" (Residential Single-Family, Medium Density District). A parcel of land located in the Northwest one-quarter and Southwest one-quarter of Section 35, Township 1 South, Range 5 East, Montana Principal Meridian, Gallatin County, Montana, being more particularly described as follows: Beginning at the point hereinbefore referred to as Point C; thence South 59037'41" West, a distance of 249.23 feet; thence North 27029'58" West, a distance of 135.32 feet; thence South 65038'12" West, a distance of 175.00 feet; to the point of curvature of a non-tangent curve to the right having: a radius of 780.00', a central angle of 14024'37", a chord bearing of North 17009'30" West, and a chord length of 195.66', thence along the arc of said curve an arc length of 196.18 feet to the end of said curve; thence, on a non-tangent course, North 89046'08" West, a distance of 129.51 feet; thence South 00013'52" West, a distance of 163.99 feet; thence North 89046'08" West, a distance of 300.00 feet; thence North 00013'52" East, a distance of 328.99 feet; thence North 89046'08" West, a distance of 129.50 feet; thence North 00013'52" East, a distance of 839.07 feet; thence South 89046'08" East, a distance of 900.13 feet to a point on the generally westerly boundary of Lot B of Minor Subdivision No. 145B; thence southerly along said boundary through the following 6 courses: South 00013'52" West, a distance of 30.00 feet; North 89046'08" West, a distance of 58.43 feet; South 00013'52" West, a distance of 893.36 feet; South 30022'19" East, a distance of 236.99 feet; North 59037'41" East, a distance of 87.36 feet; South 30022'19" East, a distance of 32.50 feet to the Point of Beginning.
