WHEREAS, the City Commission did, on the 13th day of October 2008, authorize the City Manager to utilized the Alternative Delivery Method to award the bid for the CMC East Main Depot Asbestos Cleanup, to Envirocon, Inc., Missoula, Montana; and WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any such alterations or modifications of the specifications and/or plans of the contract be made by resolution; and WHEREAS, it has become necessary in the prosecution of the work to make alterations or modifications to the specifications and/or plans of the contract. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana, that the proposed modifications andLor alterations to the contract between the City of Bozeman, a municipal corporation, and Envirocon Inc., as contained in Change Order No. 1, attached hereto, be and the same are hereby approved; and the City Manager is hereby authorized and directed to execute the contract change order for and on behalf of the City; and the City Clerk is authorized and directed to attest such signature. BACKGROUND: On October 13~' 2008, Commission authorized the City Manager to utilize the alternative delivery method for awarding the contract for the CMC East Main Depot Asbestos Cleanup. On March 16`'', 2009 a contract with Envirocon Inc, was signed and executed. The contract was for $1,261,5978.97. In negotiations with DEQ it was agreed that they would reimburse the City 79% of all qualified costs of the cleanup. Early in the project an underground tank was found on one of the contaminated lots. The tank was found to be contaminated with asbestos and needed to be removed. Since the tank was not identified in the original scope of the contract a change order was necessary. The DEQ deemed the tank cleanup and removal not reimbursable and all costs associated would be picked up by the property owner. Since Envirocon is contracted by the City, the change order is being administered by the City but all costs will be reimbursed by the property owner. FISCAL EFFECTS: The entire $3,100.00 change order will be reimbursed by the property owner . ALTERNATIVES: Approve Change Order No. 1 as detailed below. The cost is for the additional resources associated with the UST removal outside the scope of the existing contract. Because the licensed UST removal personnel is not asbestos trained, Envirocon personnel will be doing all the work inside the exclusion zone as directed by the licensed UST remover, i.e. sampling liquid in the tank, below tank soil sampling, and handling the hoses while the tank is being pumped. Cost is also included for the operated excavator to excavate and remove the tank, for loading the tank on a trailer and poly wrapping (same as the dump trucks), for transporting the tank for disposal at the existing land fill, and for unloading and crushing the tank with the tracked loader before backfilling with daily cover. Below are the assumptions in developing the costs. • Panhandler Geotechnical & Environmental to provide licensed UST removal personnel and UST removal permit. • Panhandler Geotechnical & Environmental to sample and dispose of liquid in tank. • Panhandler Geotechnical & Environmental to sample below tank after removal. • Envirocon to dispose of tank in exiting landfill. Tank is 2000 gallon ~ 10 CY for disposal quantities, before crushing. • Cost assumes excavating only asbestos below the removed UST. • No costs included for disposal of TPH soils, if present below tank. • No costs for permits. • All other costs associated for tank removal are included in existing line items, i.e. backfill, etc. If you need any further assistance, please let me know.
