Fence replacement on Empire property

RECOMMENDATION: The Commission to make a motion to adopt.
BACKGROUND: On October 13th 2008, Commission authorized the City Manager to utilize the
alternative delivery method for awarding the contract for the CMC East Main
Depot Asbestos Cleanup. On March 16`", 2009 a contract with Envirocon Inc,
was signed and executed. The contract was for $1,261,5978.97. In negotiations
with DEQ it was agreed that they would reimburse the City 79% of all qualified
costs of the cleanup.
It was discovered that an existing fence located on the Empire property was
placed in asbestos contaminated soil. The concrete anchoring the posts was
poured and buried in asbestos soils. In order safely mitigate the site the fence
needs to be removed and replaced.
FISCAL EFFECTS: The entire $14,432.50 change order will be included with the costs of the
CMC cleanup and will be eligible for the 79% reimbursement.
ALTERNATIVES: Approve Change Order No. 3 as detailed below.

Envirocon, Inc proposed price to remove and replace the 7' chain link fence and gate
bordering the Empire property is $49.55 per LF up to 250 LF ($12,387.50) for the fence
and $2,045.00 for the gate. Because the concrete anchoring the post is buried in
potential asbestos soils they will be disposed of in the existing landfill. The posts and
fence wire will be disposed of in an approved facility or recycled, if possible. The
existing fence location will be measured by onsite personnel in relationship to existing
structures and reinstalled in the same location. Payment will be for installed feet and
one gate.
