HomeMy WebLinkAboutApprove ThinkTank Design Group's Request, reclaiming jurisdiction over #Z-09081    Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Chris Kukulski, City Manager Andy Epple, Director of Planning SUBJECT: ThinkTank Design Group Request on Behalf of Ponderosa Land Company and Empire Building Materials, Inc. for the Commission to Reclaim to Itself the Final Approval of Development Application #Z-09081, per Section 18.64.010 C.1. BMC. MEETING DATE: May 26, 2009 – Consent Agenda BACKGROUND: Zoning Application #Z-09081 has been made for Site Plan Approval with Variances, for the Empire Building Materials group to construct an 8,000 square foot cold storage building on its currently developed property located at the intersection of Pear and L Streets in Northeast Bozeman. Because of the multiple variances, the application would ordinarily be presented to the Board of Adjustment for final action. Due to past City Commission involvement with review and approval of certain development proposals on this property, also involving variances, the applicants are requesting that the Commission reclaim approval authority over the project, per Section 18.64.010 C.1. BMC (see attached letter from ThinkTank dated 05/20/2009). Given the history of past development reviews on this property by the City Commission, staff is supportive of the request. RECOMMENDATION: That the City Commission reclaim approval authority over Application #Z- 09081, per Section 18.64.010 C.1. BMC. FISCAL EFFECTS: None identified.
