ORDINANCE NO. 1602
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING THE ZONE MAP BY AMENDING THE ZONING
DESIGNATION FROM "BP" (BUSINESS PARK
DISTRICT), TO "B-2"
(COMMUNITY BUSINESS DISTRICT) ON 126:1: ACRES AND TO "R-3"
(RESIDENTIAL MEDIUM DENSITY DISTRICT) ON 12::1:: ACRES LOCATED
NORTHWEST OF THE INTERSECTION OF BAXTER LANE AND GALLATIN
GREEN, DESCRIBED AS TRACT 4, COS 2202 AND A PORTION OF TRACT 2,
COS 2202, AND LOCATED IN THE SE1h OF SECTION 34, T1S, R5E, PMM, CITY
OF BOZEMAN, MONTANA.
WHEREAS, the proposed zone map amendment to amend the zoning designation from "BP"
(Business Park District) on 138:1:: acres to "B-2" (Community Business District) on 126:!:: acres and "R-3"
(Residential Medium Density District) on 12:1:: acres has been properly submitted, reviewed and
advertised; and
WHEREAS, the City of Bozeman Zoning Commission held a public hearing on May 20, 2003,
to receive and review all written and oral testimony on the request for a zone map amendment; and
WHEREAS, the City of Bozeman Zoning Commission recommended to the Bozeman City
Commission that the zone map amendment be approved; and
WHEREAS, after proper notice, the City Commission held its public hearing on May 27, 2003,
to receive and review all written and oral testimony on the request for a zone map amendment; and
WHEREAS, the City Commission has reviewed and considered the twelve zone change criteria
established in Section 76-2-304, M.C.A., and found the proposed zone map amendment, as
recommended by the Zoning Commission, to be in compliance with the twelve criteria; and
WHEREAS, at its meeting held on June 2, 2003, the City Commission found that the proposed
zone map amendment would be in compliance with the Bozeman 2020 Community Plan and would be
in the public interest.
NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman,
Montana:
Section 1
That the zoning district designation of the following-described property is hereby amended from
"BP" (Business Park District) to "B-2" (Community Business District):
Situated in the southeast one-quarter of Section 34, Township 1 South, Range 5
East, Principal Meridian, Montana, Gallatin County, Montana, and being more
particularly described as follows:

Beginning at the southeast corner of Section 34; thence S 89041'57" W, along the
south line of Section 34, 2023.41 feet; thence N 00018'03"W 2214.00 feet; thence
S 89041'57" W 229.85 feet; thence N 00020'59" E 445.09 feet to the north line of said
southeast 1,4 Section 34; thence N 89051'36" E, along said north line, 2273.41 to the
east 1,4 corner of said Section 34; thence S 00012'58" W 331.41 feet; thence
S 00014'39" W 690.31 feet; thence S 00014'55" W 1631.09 feet to the point of
beginning containing 126.45 acres of land.
Section 2
That the zoning district designation of the following-described property is hereby amended from
"BP" (Business Park District) to "R-3" (Residential Medium Density District):
Situated in the southeast 1,4 of Section 34, Township 1 South, Range 5 East,
Principal Meridian, Montana, Gallatin County, Montana, and being more particularly
described as follows:
Commencing at the southeast corner of Section 34; thence S 89041'57" W, along the
south line of Section 34, 2023.41 feet to the Point of Beginning; thence S 89041'57"
W, continuing along the south line of Section 34, 255.00 feet; thence N 00020'59" W
2214.14 feet; thence N 89041'57" E 229.85 feet; thence S 00018'03" E 2214.00 feet
to the point of beginning containing 12.32 acres of land.
Section 3
The effective date is thirty days after final adoption of this ordinance on second reading.
PASSED by the City Commission of the City of Bozeman, Montana on first reading at a regular
session thereof held on the 21 st day of July 2003.
