HomeMy WebLinkAboutOrdinance 04- 1608 Amends zone map, MacDonald .. ..__.. ___no ____.__..__._ ______________.___.__._._ - ._.._u_.._.....__._.._..._ __._........_n.__.u ORDINANCE NO. 1608 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONT ANA, AMENDING THE CITY OF BOZEMAN ZONE MAP BY ESTABLISHING AN INITIAL ZONING DESIGNATION OF "R-O" (RESIDENTIAL OFFICE DISTRICT), AND "R-3" (RESIDENTIAL MEDIUM DENSITY DISTRICT) ON 10.70 ACRES SITUATED IN THE NORTHWEST QUARTER AND SOUTHWEST QUARTER OF SECTION 35, TOWNSHIP 1 SOUTH, RANGE 5 EAST, MONTANA PRINCIPAL MERIDIAN. WHEREAS, the proposed zone map amendment to establish an initial zoning designation of "R-O", (Residential Office District), and "R-3", (Residential, Medium Density District) on 1 0.70 acres has been properly submitted, reviewed and advertised; and WHEREAS, the City of Bozeman Zoning Commission held a public hearing on June 18, 2002, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the City of Bozeman Zoning Commission recommended to the Bozeman City Commission that the zone map amendment be approved as submitted; and WHEREAS, after proper notice, the City Commission held its public hearing on July 15, 2002, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the City Commission received a written petition representing sixteen (16) residents in the area of the amendment requesting that the zone map amendment be modified to a R-3A and R-O zoning designation(s); and WHEREAS, no members of the general public spoke in opposition to the zone map amendment; and WHEREAS, the City Commission has reviewed and considered the twelve zone change criteria established in Section 76-2-304, M.C.A., and found the proposed zone map amendment, as recommended by the Zoning Commission, to be in compliance with the twelve criteria; and WHEREAS, at its meeting held on July 15, 2002, the City Commission found that the proposed zone map amendment would be in compliance with the Bozeman Area Growth Policy and would be in the public interest upon annexation of the subject property; and WHEREAS, the subject property was annexed through adoption of Commission Resolution No. 3648, adopted on the 12th day of January 2004. - -.-..-... ..-.- n__.._..__.____ ...-.--...------.- NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman, Montana: Section 1 That the zoning district designation of the following-described property is hereby initially established as "R-O" (Residential Office District). A tract of land being Tract 1A, Certificate of Survey No. 1855A, as recorded with the Gallatin County Clerk and Recorder, located in the northeast one-quarter of Section 11, Township 2 South, Range 5 East, Principal Meridian Montana, Gallatin County State of Montana and being more particularly described as follows. Beginning at the SE corner of said Tract 1 A, thence along said Tract 1 A through the following courses: S88.14'47"W, a distance of 329.36 feet; NOO.25'42"W, a distance of 45.02 feet; NOO.00'43"W, a distance of 304.61 feet; S89.12'40"E, a distance of 330.11 feet; SOO.06'12"W, a distance of 293.22 feet; SOO.04'57"E, a distance of 41.79 feet to the point of beginning containing 2.59 gross acres more or less. The computed area of the herein described parcel is 2.59 acres, more or less along with and subject to any existing easements. Section 2 That the zoning district designation of the following-described property is hereby initially established as "R-3" (Residential Medium Density District). A tract of land being Tract 2A, Certificate of Survey No. 1855A, as recorded with the Gallatin County Clerk and Recorder, located in the northeast one-quarter of Section 11, Township 2 South, Range 5 East, Principal Meridian Montana, Gallatin County State of Montana and being more particularly described as follows. Beginning at the NE corner of said Tract 2A, thence along said Tracts 2A, through the following courses: SOO.11'03"W, a distance of 30.18 feet; SOO.06'20"W, a distance of 30.18 feet; SOO.06'20"W, a distance of 24.25 feet; SOO.12'31"W, a distance of 667.74 feet; SOO.06'12"W, a distance of 332.65 feet; N89.12'40"W, a distance of 330.11 feet; NOO.00'43"W, a distance of 1 04.41 feet; NOO.01 '21 "W, a distance of 213.04 feet; NOO.05'28"W, a distance of 375.63 feet; NOO.06'58"E, a distance of 56.65 feet; NOO.13'02"E, a distance of 55.45 feet; NOO.22'07"W, a distance of 54.84 feet; NOO.04'40"W, a distance of 61.00 feet; NOO.06'28"E, a distance of 63.56 feet; NOO.05'51 "E, a distance of 29.91 feet; NOO.05'51 "E, a distance of 30.18 feet; N83.52'57"E, a distance of 335.82 feet to the point of beginning. The computed area of the herein described parcel is 8.11 acres, more or less along with and subject to any existing easements. Section 3 Effective Date.
