Commission Memorandum TO: Honorable Mayor and City Commission FROM: Keri Thorpe, Assistant Planner SUBJECT: City of Bozeman Lower Yards Shop/HRDC Bus Facility and Sand Storage Building Site Plan Application/Certificate of Appropriateness (SP/COA) #Z-09053 MEETING DATE: Monday, May 11, 2009 at 6:00 PM RECOMMENDATION: That the City Commission 1) moves to approve the Public Agency Exemptions requested for the Site Plan/Certificate of Appropriateness application #Z-09053 for the City of Bozeman Lower Yards Shop/HRDC Bus Facility and Sand Storage Building and 2) moves to approve the same application with the conditions and code provisions outlined in the staff report. BACKGROUND: The property owner, City of Bozeman, represented by Mike Wiseman of Dowling Sandholm Architects, Inc., has made an application for a Site Plan to allow the construction of one building, totaling approximately 25,380 square feet, a 4,000 square foot sand storage building and related site improvements on the property located at 1812 N. Rouse Avenue. The property is zoned “M-1” (Light Manufacturing District) and is located in the Class 2 Entryway Corridor Overlay District. The Bozeman 2020 Community Plan designation for this property is “Public Institutions”. The proposal requires City Commission approval per section 18.02.080 of the BMC which states that development of all City-owned land shall be subject to approval by the City Commission. The Design Review Committee (DRC) and Design Review Board (DRB) have reviewed this SP/COA application for the Phase I Lower Yards Shops, sand storage building and HRDC bus barn located on the east side of North Rouse Avenue, immediately south of Griffin Drive, and recommend City Commission approval. Planning Staff has identified various code provisions that are currently not met by this application. The applicant must comply with all provisions of the Bozeman Unified Development Ordinance (except those approved for public agency exemption by the City Commission), which are applicable to this project, prior to receiving final site plan approval. Staff recommends the approval of this project with the agency exemptions (p. 2), conditions (pp. 3-5) and code provisions (pp. 6-9) listed in this staff report with the understanding that some improvements will be completed as funding allows (See table page 3). UNRESOLVED ISSUES: The Department of Planning is not aware of any unresolved issues for the proposed development at this time. The property is zoned M-1 (Light Manufacturing District) and is located in the Class 2 Entryway Corridor Overlay District. Report By: Keri Thorpe, Assistant Planner Recommendation: Conditional Approval ____________________________________________________________________________________ PROJECT LOCATION The subject property is located on the east side of N. Rouse Avenue immediately south of Griffin Drive and addressed as 1812 N. Rouse Avenue. The property is legally described as Tract 12, NW ¼ NE ¼ Section 6, T2S, R5E, Gallatin County, Montana. The property is zoned “M-1” (Light Manufacturing District) and is located in the Class 2 Entryway Corridor Overlay District. 244 #Z-09053 Bozeman Lower Yards Shop/HRDC Bus Facility SP/COA 2 PROPOSAL The property owner, City of Bozeman, represented by Mike Wiseman of Dowling Sandholm Architects, Inc., has made an application for a Site Plan to allow the construction of one building, totaling approximately 25,380 square feet, a 4,000 square foot sand storage building and related site improvements. In recent history, this City property has been used primarily for storage (sand, snow, Street and Forestry Department equipment/signs and impounded vehicles). The site is generally unimproved with multiple structures in variable conditions. With this proposal the site will be graded per a drainage plan and gravel will be brought to the sight to improve the proposed drive aisle and circulation areas. The waste oil disposal station and water fill station will be moved from the 814 N. Bozeman Avenue City complex to this location. This proposal contains a component of the office and vehicle maintenance shop reviewed informally by the Development Review Committee (DRC) and Design Review Board (DRB) in 2008. A conceptual plan including the larger office component (Phase II) is included with the submittal materials. If approved, the 25,380 sq foot shop and bus facility will be used jointly by the City Street Maintenance Division and HRDC Streamline Bus Service. A common parking area is proposed. This will be partially paved to provide an impervious surface under the waste oil disposal station but gravel will be the primary road base with minimal paving of circulation areas. Curbing of the common parking area and paving of the large vehicle route (from North Rouse through the water truck fill station to Griffin Drive) will be added as funding allows. As part of the application, the owner/applicant has requested public agency exemptions from Title 18 of the Bozeman Municipal Code (BMC) pertaining to screening of outdoor storage, perimeter curbing of drive aisles and parking lot, on-site paving and landscaping. Specifically, the Public Agency Exemptions being requested with this application include the following Sections: • 18.42.160 Screening of outdoor storage • 18.46.020 Parking lot stall, aisle and driveway design and • 18.48 Landscaping (Note: this project was publicly noticed for additional exemptions including 18.44.060 Street Improvement Standards, 18.44.080, Sidewalk installation on street frontages and 18.44.090 Access Improvements; however, these items will now be handled through the variance procedure) A landscaping plan was not prepared because of ongoing changes to this site including the MDT improvements planned for N. Rouse Avenue. As funds are available and North Rouse Avenue improvements become more evident, staff recommends that screening of outdoor storage areas be the top priority with the N. Rouse Avenue frontage landscaping as the second landscaping priority. No buildings are being demolished with this phase. Variances for street improvements, sidewalk installations and access improvements for North Rouse Avenue and Griffin Drive are being requested with a forthcoming subdivision application for this property. As of the writing of this report, no public comment has been received regarding this application. RECOMMENDATION The DRC and DRB have reviewed the SP/COA application for the Phase I Lower Yards Shops, sand storage building and HRDC bus barn located on the east side of North Rouse Avenue, immediately south of Griffin Drive, and recommend City Commission approval. Planning Staff has identified various code provisions that are 245 currently not met by this application. The applicant must comply with all provisions of the Bozeman Unified Development Ordinance (except those approved for public agency exemption by the City Commission), which are applicable to this project, prior to receiving final site plan approval. The applicant is advised that unmet code provisions, or code provisions that are not specifically listed as conditions of approval, does not, in any way, create a waiver or other relaxation of the lawful requirements of the Bozeman Municipal Code or state law. Staff recommends the approval of this project with the agency exemptions (p. 2), conditions (pp. 3-5) and code provisions (pp. 6-9) listed in this staff report with the understanding that some improvements will be completed as funding allows (See table below). Exemption Requested Section Description Partial or Complete Intent 18.42.160 Screening of outdoor storage Partial As the outdoor storage location and fencing gets finalized, lilacs will be planted around the fence perimeter to provide screening of storage areas visible from Rouse Avenue and Griffin Drive. 18.46.020 Parking lot stall, aisle and driveway design Partial No curbing of drive aisles will occur, but some curbing of the parking area will likely take place with phase I; the parking lot will be partially paved; water truck route will be paved between Rouse entrance and Griffin exit as funds allow in 2010, or by no later than the end of 2012 18.48 Landscaping Partial City Forestry Dept will plant boulevard acceptable trees at the north end of the property. Rouse Avenue streetscape landscaping will be improved when MDT improvements are complete. RECOMMENDED CONDITIONS OF APPROVAL The DRC and DRB find that the application, with conditions, is in general compliance with the adopted Growth Policy and the City of Bozeman Unified Development Ordinance. The following project specific conditions of approval are recommended: Planning Related: 1. As funding allows, curbing and surfacing improvements to the parking and circulation areas shall be made. 2. As funding allows, screening of outdoor storage areas shall be screened with opaque fencing and/or non- deciduous landscaping. 3. As funding allows and as MDT improvements to N. Rouse Avenue are completed, street frontage landscaping shall be improved along N. Rouse Avenue and Griffin Drive. 4. Fleet vehicle parking or other vehicle storage was not considered with determining the site’s parking requirements. A parking calculation must be provided with the Final Site Plan (FSP) that shows the BMC #Z-09053 Bozeman Lower Yards Shop/HRDC Bus Facility SP/COA 3 246 #Z-09053 Bozeman Lower Yards Shop/HRDC Bus Facility SP/COA 4 parking requirements for “manufacturing and industrial uses with associated offices” plus any additional parking required for fleet vehicles. 5. A circulation plan for the site is required with the FSP submittal. 6. All roof top mechanical equipment and mechanical equipment visible from the public right-of-way must be accurately depicted on the final site plan. Screening method must be provided. 7. Provide bicycle rack location and detail. 8. Any fence sections in poor condition must be repaired. 9. A conceptual plan for future phases must be provided with the FSP. The conceptual plan should delineate future buildings, parking and outdoor storage area(s), provide for pedestrian connectivity between on-site facilities and N. Rouse Avenue, delineate areas to be landscaped and show buildings to be demolished. 10. A materials and color palette must be provided with the FSP. The final material and color selection will be reviewed and approved by ADR staff and as recommended by the Design Review Board. 11. Design Review Board (DBR) comments will be completed prior to the completion of the staff report for the City Commission’s consideration of the Preliminary Site Plan/COA and may include additional recommended conditions of approval (see below). 12. That the applicant upon submitting the Final Site Plan for approval by the Planning Director and prior to issuance of a building permit, will also submit a written narrative outlining how each of the conditions of approval and code provisions have been satisfied. Design Review Board Related: 1. Wall mounted light fixtures should reflect a traditional style common to the area (i.e., goose neck). 2. If signage is to be proposed, and since more than one tenant will utilize this site, a common signage plan shall be submitted for review and approval, and shall clearly define location, placement, materials and method of illumination for all signage. The Final Site Plan shall provide a legend determining the amount of signage allotted each tenant and shall comply with the sign ordinance, unless deviations to the ordinance are requested by the applicant. 3. Muted colors and earth tones will be used for all buildings, including roof materials. A minimum of 75% of the exterior walls seen from the public way shall have muted colors. The building materials shall also be non-glare and non-reflective. 4. The Final Site Plan shall contain a notation stating that all roof mounted mechanical equipment and air exchange units must be screened from public right-of-way. All ground mounted equipment must be noted on the site plan and any ground mounted equipment visible from the public right-of-way shall be screened when feasible. Engineering Related: 1. A public street easement shall be granted for North Rouse Avenue that provides for a total right-of-way width of 60’ east of centerline. The easement shall be acceptable in form and content and executed by the property owner prior to final site plan approval. 2. North Rouse Avenue along the property frontage shall be constructed to one-half a principal arterial street standard in accordance with the 2007 Transportation Plan Update unless a variance is granted. 3. Griffin Drive along the property frontage shall be constructed to a full local street standard in accordance with the 2007 Transportation Plan Update unless a variance is granted. 247 #Z-09053 Bozeman Lower Yards Shop/HRDC Bus Facility SP/COA 5 4. A deviation from access separation standards of Section 18.44.090.D.3 UDO shall be prepared in accordance with Section 18.44.090.H UDO. The deviation request shall be provided to and approved by the City Engineer prior to final site plan approval unless a variance is granted. 5. The Montana Department of Transportation shall approve site access locations and construction standards for accesses onto North Rouse Avenue. 6. A Utility Occupancy Permit shall be obtained from the Montana Department of Transportation for proposed new or relocated utilities in North Rouse Avenue. The permit shall be obtained prior to construction. 7. All floor drains in the proposed building shall be routed through a sand/oil separator prior to discharge to sanitary sewer. Domestic wastewater shall not be routed through the sand/oil separator. 8. The 100-year floodplain shall be delineated on the project site where the Base Flood Elevation intersects the existing ground surface. A floodplain development permit shall be obtained prior to construction of proposed improvements in the floodplain. 9. A storm water drain shall be installed at the water truck fill facility. ZONING DESIGNATION & LAND USES The property is zoned M-1 (Light Manufacturing District). The intent of the M-1 district is to provide for the community’s needs for wholesale trade, storage and warehousing, trucking and transportation terminals, light manufacturing and similar activities. The district should be oriented to major transportation facilities yet arranged to minimize adverse effects on residential development, therefore, some type of screening may be necessary. The following land uses and zoning are adjacent to the subject property: North: Vacant Land which is part of the public right-of-way, zoned R-S (Residential suburban) South: Retail/small engine service, storage facility, zoned M-1 (Light Manufacturing); East: Vacant land; zoned M-1 (Light Manufacturing). West: Developed land (storage facility, retail, bar); zoned M-1 (Light Manufacturing); ADOPTED GROWTH POLICY DESIGNATIONS The Bozeman 2020 Community Plan designates this property as “Public Institutions.” This designation provides for a variety of activities with schools as the dominant use including Montana State University. Other typical uses are libraries, fire stations, and publicly operated utilities. The following land uses and land use designations are adjacent to the subject property: North, South, East and West: “Industrial” REVIEW CRITERIA & STAFF FINDINGS The Planning and Community Development Office has reviewed the application for a Site Plan/COA against the relevant chapters of the Unified Development Ordinance (UDO), and as a result offers the following summary review comments. The findings outlined in this report include comments and code provisions provided by the Development Review Committee (DRC) and Design Review Board (DRB). SECTION 18.34.090 “SITE PLAN REVIEW CRITERIA” In considering applications for a Site Plan, the City Commission, the DRC, and when appropriate, the ADR staff shall review the application against the Site Plan Review requirements of 18.34.090 as follows: 248 #Z-09053 Bozeman Lower Yards Shop/HRDC Bus Facility SP/COA 6 1. Conformance to and consistency with the City’s adopted growth policy The development proposal is in conformance with the Bozeman 2020 Community Plan including the “Public Institutions” land use designation which indicates that “a variety of activities are undertaken in this land use classification. Schools are a dominant use including Montana State University. Other typical uses are libraries, fire stations, and publicly operated utilities. A significant portion of Bozeman’s employment occurs within this category.” 2. Conformance to this title, including the cessation of any current violations The applicant is advised that unmet code provisions, or code provisions that are not specifically listed as conditions of approval, does not, in any way, create a waiver or other relaxation of the lawful requirements of the Bozeman Municipal Code or state law. The following code provisions must be addressed prior to final site plan approval: Planning Provisions: a. 18.34.130 requires the applicant to submit seven (7) copies a Final Site Plan within 6 months of preliminary approval containing all of the conditions, corrections and modifications to be reviewed and approved by the Planning Office. b. Section 18.34.140 states that a Building Permit must be obtained prior to the work, and must be obtained within one year of Final Site Plan approval. Building Permits will not be issued until the Final Site Plan is approved. c. Section 18.38.050.F requires that roof mounted mechanical equipment and ground mounted mechanical equipment visible from public right-of ways be screened. Rooftop equipment should be incorporated into the roof form and ground mounted equipment shall be screened with walls, fencing or plant materials. d. Section 18.42.080.G and H requires that stormwater detention/retention facilities shall be designed as landscape amenities. See specific section for all requirements. Cross sections of the ponds shall be provided with the final site plan. e. Section 18.42.130 specifies that all fences shall be constructed in a substantial, workman-like manner and of substantial material reasonable suited for its purpose and be maintained in a conditions of reasonable repair and shall not be allowed to become and remain in a condition of disrepair, damage or unsightliness, or constitute a nuisance, public or private; should be constructed with the “finished” side out; barb wire utilized in M-1 districts should only be located on the top of security fences. f. Section 18.42.150.D.7 specifies the requirements for site and building mounted lighting. Typical lighting “cutsheets” and lighting locations including building mounted lighting locations on the building elevations shall be provided with the FSP. g. Section 18.42.170 requires the trash receptacles to be appropriately sized and located for the specific as approved by the City Sanitation Department. Accommodations for recyclables must also be considered. All receptacles shall be located inside of an approved trash enclosure. h. Section 18.52.060.B requires a comprehensive signage plan for two or more tenant spaces on a lot. A comprehensive signage plan shall be submitted with the final site plan that complies with this section. 249 #Z-09053 Bozeman Lower Yards Shop/HRDC Bus Facility SP/COA 7 i. Chapter 18.52 requires the review and approval of a Sign Permit Application prior to the construction and installation of any on-site signage. Engineering Provisions: j. Plans and specifications for any water, sewer and/or storm sewer main extensions and Public Streets (including curb/gutter and sidewalks, signing/striping, intersections, etc.) prepared by a Professional Engineer (PE) shall be provided to and approved by the City Engineer. Water and sewer plans shall also be approved by the Montana Department of Environmental Quality. The applicant shall provide Professional Engineering services for construction inspection, post-construction certification and preparation of mylar record drawings. Specific comments regarding the existing and proposed infrastructure shall be provided at that time. Construction shall not be initiated on the public infrastructure improvements until the plans and specifications have been approved and a pre- construction conference has been conducted. Building permits will not be issued prior to City acceptance of infrastructure improvements unless all provisions set forth in Section 18.74.030.C.1.b of the Unified Development Ordinance are met to allow for concurrent construction. k. Plans and specifications for any fire service line (and domestic services 4” or larger) must be prepared in accordance with the City’s Fire Service Line Policy by a Professional Engineer and be provided to and approved by the City Engineer prior to initiation of construction of the fire service or fire protection system. The applicant shall also provide Professional Engineering services for construction inspection, post-construction certification and preparation of mylar record drawings. Fire service plans (and domestic services 4” or larger) shall be a standalone submittal, separate from the infrastructure plans and final site plan. l. A Stormwater Drainage/Treatment Grading Plan and Maintenance Plan for a system designed to remove solids, silt, oils, grease, and other pollutants must be provided to and approved by the City Engineer. The plan must demonstrate adequate site drainage (including sufficient spot elevations), stormwater detention/retention basin details (including basin sizing and discharge calculations and discharge structure details), stormwater discharge destination, and a stormwater maintenance plan. A drainage easement must be established on the adjacent property and filed with the County Clerk & Recorder for drainage improvements and discharge courses located off the subject property. m. The FSP shall be adequately dimensioned and labeled with a legend of linetypes and symbols used provided. n. Easements and R/W located on and adjacent to the site shall be depicted and labeled appropriately. Distinction between proposed and existing easements shall be made. Any proposed easements shall be provided prior to FSP approval. o. Sewer, water and fire services shall be shown, with sizes labeled, on the Final Site Plan from main to building and approved by the Water/Sewer Superintendent. City of Bozeman applications for service shall be completed by the applicant. 250 #Z-09053 Bozeman Lower Yards Shop/HRDC Bus Facility SP/COA 8 p. The location of existing and proposed water/sewer mains and services shall be properly depicted, as well as nearby fire hydrants and proposed hydrants. Proposed utilities shall be distinguishable from existing. q. Proposed water/sewer mains, services and hydrants shall be depicted on the landscape plan and maintain a minimum horizontal separation of 10’ to proposed landscape trees and lot lighting improvements. r. Typical curb details (i.e. raised and/or drop curbs) and typical asphalt paving section detail shall be provided to and approved by the City Engineer. Concrete curbing shall be provided around the entire new parking lot and/or access perimeter and be adequately identified (i.e. drop vs. spill curb) on the FSP unless a Public Agency Exemption is invoked. s. As per section 18.44.090 UDO access approaches shall be constructed in accordance with City Standards and be labeled and detailed as such on the FSP unless a variance is granted. t. City standard sidewalk shall be installed and properly depicted at the standard location (i.e. 1’ foot off property line) along all street frontages unless a variance is granted. Any deviation to the standard alignment or location must be approved by the City Engineer. A City Sidewalk and Curb Cut Permit shall be obtained prior to construction. u. Street vision triangles shall be depicted in accordance with section 18.44.100 UDO and no plantings or other obstructions shall be located in the vision triangle in excess of 30” in height above the street centerline grade. v. The applicant shall submit a construction route map dictating how materials and heavy equipment will travel to and from the site in accordance with section 18.74.020.A.1 of the Unified Development Ordinance. This shall be submitted as part of the final site plan for site developments, or with infrastructure plans for subdivisions. It shall be the responsibility of the applicant to ensure that the construction traffic follows the approved routes. w. All construction activities shall comply with section 18.74.020.A.2 of the Unified Development Ordinance. This shall include routine cleaning/sweeping of material that is dragged to adjacent streets. The City may require a guarantee as allowed for under this section at any time during the construction to ensure any damages or cleaning that are required are complete. The developer shall be responsible to reimburse the City for all costs associated with the work if it becomes necessary for the City to correct any problems that are identified. x. If construction activities related to the project result in the disturbance of more than 1 acre of natural ground, an erosion/sediment control plan may be required. The Montana Department of Environmental Quality, Water Quality Bureau, shall be contacted by the applicant to determine if a Storm Water Discharge Permit is necessary. If required by the WQB, an erosion/sediment control plan shall be prepared for disturbed areas of 1 acre or less if the point of discharge is less than 100’ from State Waters. y. The Gallatin County Conservation District, Montana Department of Environmental Quality, and U.S. Army Corps of Engineers shall be contacted regarding the proposed project and any required permits (i.e., 310, 404, Turbidity exemption, etc.) shall be obtained and provided prior to FSP approval. 3. Conformance with all other applicable laws, ordinances, and regulations All other applicable laws, ordinances, and regulations must be followed. All conditions for a Site Plan and Certificate of Appropriateness must be met prior to final site plan approval. The plans will 251 #Z-09053 Bozeman Lower Yards Shop/HRDC Bus Facility SP/COA 9 be further evaluated against the requirements of the International Building Code (IBC) when an application is made for a building permit. 4. Relationship of site plan elements to conditions both on and off the property The subject property is currently utilized for the storage by several City departments. Currently the site provides storage for the following departments: Streets, Forestry, Police (Impound Lot) and Vehicle Maintenance. The Water/Sewer and Fire Departments use the site for rescue training. In addition to equipment storage, the site has been utilized for salt/sand and snow storage. The new building will provide a much needed vehicle maintenance shop and HRDC Streamline bus barn. A new water truck fill station and waste oil dump station will be moved from the 814 N. Bozeman location to better serve the public and city workers. In addition to the new building and services, a new sand/salt storage facility will be constructed. This new storage facility has an impervious concrete foundation and a weather protective cover to prevent salt contamination of soils and ground water. A grading and drainage plan has been designed for the site. Additional gravel will be brought to the site to improve the parking area and vehicle circulation areas. A circulation plan was created to direct water truck traffic to enter the site from N. Rouse and exit at Griffin Avenue. The water truck route and waste oil dump area will be paved. As funds allow, additional paving will occur. Overall, the grading, drainage, surfacing and circulation of the site will be greatly improved with this project. The impound lot and snow storage will be moved to the old animal shelter location. This allows room for a large detention pond in the northeast corner of the property and the planting of trees by the City Forester. Planting boulevard tree species in this area has been suggested. These trees will be setback outside of the Griffin Drive right-of-way. This will enhance the open space and overall appearance of the site. The area south of the proposed sand storage facility will be utilized for outdoor storage. Once the construction is complete and the final fence location determined, staff recommends planting lilac bushes around the perimeter of the outdoor storage area fencing, as funds allow, improving its screening. Pedestrian connectivity to North Rouse Avenue will not be provided at this time. This site will be in a slow yet constant state of flux with pending MDT improvements to North Rouse and future removal of four large storage sheds. As such, we foresee the pedestrian connectivity to North Rouse Avenue being provided with completion of North Rouse Avenue improvements and Phase II of the Lower Yards. There is an existing Northwestern Energy parcel and facility located off North Rouse Avenue along the west boundary of the subject property. This parcel is enclosed in a fence and well landscaped along the North Rouse frontage. A 40’ wide gas transmission main easement bisects the north half of the City of Bozeman property. No buildings encroach into this easement with this proposal. As part of the application, the owner/applicant has requested public agency exemptions from Title 18 of the BMC (Unified Development Ordinance) pertaining to: portions of perimeter curbing, portions of on- site paving, landscaping and screening of outdoor storage. 5. The impact of the proposal on the existing and anticipated traffic and parking conditions Due to the nature of this use, the expansion will increase the traffic on adjacent streets, but not significantly. This land use is not a high traffic generator; However, the site will generate additional large vehicle traffic with an average of 30 water truck trips a day during the summer months and morning departure and evening return trips of Streamline buses. Additional parking is being provided for employees. Once the impounded vehicles are relocated, this paved area may be used for City fleet vehicle storage. One van accessible parking space is provided near the south facing entrance of the building. 252 #Z-09053 Bozeman Lower Yards Shop/HRDC Bus Facility SP/COA 10 6. Pedestrian and vehicular ingress and egress No pedestrian connectivity is being provided at this time. As previously noted, vehicular access with this phase will take place mainly at the southernmost North Rouse Avenue entrance. Vehicles will exit at Griffin Drive. This circulation pattern will work best for approaching the water fill station and exiting will be facilitated by the traffic light at the intersection of Rouse and Griffin. Improvements to the grade and surfacing of the vehicle circulation areas will greatly improve vehicular ingress and egress to/from the site. The applicant will be requesting a variance to upgrades to adjacent streets, including sidewalk or a pathway along Rouse and Griffin. The installation of a bicycle rack has been conditioned for the new Shop Building. 7. Landscaping, including the enhancement of buildings, the appearance of vehicular use, open space, and pedestrian areas, and the preservation or replacement of natural vegetation No landscaping is proposed with this phase of the site development. The site is in a state of flux with pending improvements to North Rouse Avenue and future demolition of buildings. The applicant did not feel it was an efficient use of funds to install landscaping and irrigation systems due to the uncertainty of road improvement and fence locations. However, staff has determined that screening of the outdoor storage areas from the public right-of-ways is the top priority for landscaping improvements as funds allow. The detention pond in the northeast corner of the property must be landscaped as listed in the code provisions section (p. 6, code provision, “d”). 8. Open space None required for this project. However, significant open space areas are provided with this project to allow for storm water detention area and to provide appropriate setback areas. The barb wire fence around the open space area at the north end of the property is being removed. 9. Building location and height The new buildings are not located within any required setbacks and are largely located internal to the existing facility operations. The proposed buildings at 27′-4 ¾ ″ (shop/bus barn) and 32′-9″ (sand storage) are within the allowable height (45′ max) in the M-1 district and the DRB has reviewed the building plans and found them adequate for the existing site context. 10. Setbacks The M-1 zoning district setback requirements are met: 20’ front (Griffin and Rouse), 3’ side and rear. 11. Lighting All new site lighting must meet the full cut-off (dark sky compliant) requirement of 18.42.150. The two non-conforming site lights are grandfathered in under 18.42.150.K. 12. Provisions for utilities, including efficient public services and facilities As evidenced by the operation of the existing facility, utilities are available to the facility. The applicant will need to coordinate with Northwestern, Qwest, or other private providers to serve the new 253 #Z-09053 Bozeman Lower Yards Shop/HRDC Bus Facility SP/COA 11 facilities/buildings. All utilities and easements will need to be coordinated with future landscaping installations. 13. Site surface drainage Site surface drainage for the facility is a combination of overland flow and controlled flow for new improvements. A storm water drain is required for the water fill station. Storm water will be tied into the existing storm water facilities. There is a new detention area proposed for the north east corner of the site to serve the expanded facility. 14. Loading and unloading areas The waste oil dump and water fill station areas will be paved. The water fill station has been conditioned to require the installation of a storm water drain. The drive aisles to and from these facilities will be paved as funds allow with completion by 2012. 15. Grading Due to the relatively flat existing grade of the site, minimal grading will be required except as required to engineer the storm water system and to prepare the new building foundation areas. Even though minimal amount of grading is required, the grading to be completed will greatly improve the circulation areas of the site. 16. Signage No signage has been proposed. As called out in the Planning Code Provisions, per section 18.52.060.B a comprehensive signage plan is required for two or more tenant spaces on a lot. A comprehensive signage plan shall be submitted with the final site plan that complies with this section. Chapter 18.52 requires the review and approval of a Sign Permit Application prior to the construction and installation of any on-site signage. 17. Screening A public agency exemption for 18.42.160, “Outdoor Storage”, has been requested. This code section requires that any materials, equipment or vehicle storage be screened. The sand storage will be contained in a new structure, but the impound lot (future fleet parking) and outdoor storage of equipment remains unscreened. Planning staff has recommended that as funds are available, screening of outdoor storage areas be the top priority for landscaping improvements. Specifically, as the location and fencing of the outdoor storage area is finalized, lilac bushes planted around the fence perimeter, over time, would provide adequate screening. 18. Overlay district provisions This project is located within the Class II Entryway Corridor and was reviewed by staff and the Design Review Board (DRB) at their April 29, 2009 Meeting (copy of minutes attached). The DRB recommended approval of the project with the four conditions as referenced in the Recommended Conditions Section of this report. 254 #Z-09053 Bozeman Lower Yards Shop/HRDC Bus Facility SP/COA 12 19. The subject of reciprocal and perpetual easements or other agreements to which the City is a party so that the sale of individual lots will not cause one or more elements of the development to become nonconforming. CALL TO ORDER AND ATTENDANCE Chairperson Pro Tem Pentecost called the meeting of the Design Review Board to order at 5:33 p.m. in the upstairs conference room of the Alfred Stiff Professional Building, 20 East Olive Street, Bozeman, Montana and directed the secretary to record the attendance. MINUTES OF APRIL 8, 2009 Mr. Rea stated on page 4 in his paragraph the 3rd line down should instead read “as long it was not painted to look like it was rusted”. MOTION: Mr. Wall moved, Mr. Rea seconded, to approve the minutes of April 8, 2009 with corrections. The motion carried 4-0. ITEM 3. PROJECT REVIEW 1. City Shops Lower Yards Shops/HRDC SP/COA #Z-09053 (Thorpe) 1812 North Rouse Avenue * A Site Plan with a Certificate of Appropriateness Application to allow the construction of a new 25,380 sq. ft. shop/office complex joint facility and a 4,000 sq. ft. sand storage structure with related site improvements. John VanDeLinder, Debbie Arkell, Mike Wiseman, and Sash joined the DRB. Assistant Planner Keri Thorpe thanked the DRB for rearranging their schedule and presented the Staff Report noting the property was on a site with multiple buildings while two structures were being proposed with the current application. She stated the informal application had reviewed the proposal and this application was for the back half of the proposal. She noted multiple agency exemptions had been requested including landscaping and Staff was supportive of the exemption; she noted there some areas where additional landscaping would be provided and would include street trees and boulevard plantings that would be set back to allow for improvements to Griffin Drive. She stated that once the outdoor storage location was decided, 269 2 Design Review Board Minutes – April 29, 2009 Staff had recommended placing lilac trees around the fence where the storage area would be seen by the public. She stated there would be a field tested detention system installed on the site so the City might recommend the system in the future. Mr. Wiseman explained the detention areas proposed for the site and those locations. Planner Thorpe stated Staff was supportive of the proposal as it was a new approach to what could have been a plain looking building. She stated there were two lights on the site that were grandfathered in, but the applicant could work with the City on new fixtures. Mr. Wiseman stated that part of why the roof form had been chosen was due to two facilities sharing the same spaces and they had attempted to keep the snow out from in front of the bay doors using the design. He stated he was exploring the idea of using a cistern for rainwater, but the project might be too small in the first phase to justify the use of the cistern, though it could be implemented in future phases of construction. He directed the DRB to a color rendering of how the site would look from Rouse Avenue and noted they had tried to break up the facade. He stated the more public part of the building would screen much of the site once that phase of construction began. He noted logical brakes in the siding had been instituted and day lighting options had been investigated. Sash stated anyone visiting the building would likely come up on the south side where many of the HRDC offices would be and the storefront appearance had been proposed. He stated the south side would need to accommodate a forklift so the storefront appearance would not work in that location. He stated a water fill would be used by the City and would be a self contained unit to assist in circulation on the east side of the structure. Mr. Wiseman stated the future build-out would be the phase in which the landscaping would be installed given that Rouse Avenue was scheduled to be widened. He directed the DRB to the proposed materials for the structure. Sash noted the locations of each color of proposed siding. Planner Thorpe asked what color the sand storage building would be. Mr. VanDeLinder noted the building came in white and red. Planner Thorpe suggested green might be the best option. Mr. Rea asked if Staff condition #5 regarding 75% muted colors was from the UDO. Planner Thorpe responded it was an ADR condition. Mr. Rea asked if anyone had investigated building the sand storage building similar to the rest of the proposed structures. Ms. Arkell responded they would have liked to but it would be too expensive. Chairperson Pro Tem Pentecost asked when the next phase of construction would be commenced. Ms. Arkell responded it would not be for at least the next five years as it was not included in the CIP. Chairperson Pro Tem Pentecost asked if LEED certification had been sought. Mr. Wiseman responded that the most beneficial and cost effective sustainability features would be investigated. Chairperson Pro Tem Pentecost asked how the building would be heated and insulated. Mr. Wiseman responded the storage buildings would not be insulated and the metal buildings would have built it barriers and insulation. He stated the center and office portions would have above code minimal insulation. Chairperson Pro Tem Pentecost asked if the sand storage structure had been decided on. Ms. Arkell responded that the Commission had decided to use the proposed structure due to the cost. Chairperson Pro Tem 270 3 Design Review Board Minutes – April 29, 2009 Pentecost asked how the storm water would be reused on the site. Mr. Wiseman responded they were considering using it for toilet flushing. Sash added that getting the site set up for future installation of the cistern and related systems would be completed for minimal costs; he added that the site would be tied into the existing storm system. Chairperson Pro Tem Pentecost asked why the more muted red color had been chosen instead of what had been depicted. Sash responded that the manufactured colors that were offered did not include that specific color of red and customized paneling would cost more. Mr. Howe stated he thought the graphics proved that the applicant had seen to the needs of the client and he was supportive of the project as proposed. Mr. Wall stated he was supportive of the site plan and the civil site plan was especially good. He stated his one concern was the proposed windows and that they appeared to be an after thought. He suggested putting transoms in those locations instead. Mr. Wiseman responded the front portion of the future phase reflected the original concept of the site design and noted there was still some work to be done on the future design that would make the design of the windows change. Mr. Wall suggested taking the time to modify those windows to make them appear less as if they had just been thrown on; he suggested transoms. He stated it would be an industrial yard and he could understand the metal building challenge of no articulation, but he saw no problem in including the historical component of Bozeman that includes metal. He stated he thought he would prefer to see one color across the structures. He stated he thought the City would need to be more sensitive with regard to the statement “as funding allows” as the City would not extend the same latitude for another applicant. Ms. Arkell stated it was also the City’s concern and they attempted to comply with the regulations, but when using tax payer money the costs would need to be mitigated. Mr. Wall stated that really, the landscaping as it was is likely the nicest landscaping in that area. Mr. Wall asked where snow storage would be located. Mr. VanDeLinder responded it would be taken to the old Humane Society site. He stated he appreciated everything that the City does to make the City a nice place. Mr. Rea stated he had looked more carefully and found the 75% requirement within the D.O.P. He stated he disagreed with Mr. Wall in terms of color as he liked the accents; he suggested liberally interpreting muted colors and suggested red. He stated he agreed with Mr. Wall with regard to his statements about funding and he was shocked at the language included in the Staff Report referencing exemptions. He encouraged liberal interpretation of the muted color comment and suggested glass or polycarbonate doors on the south elevation to allow for solar gain and natural light. Sash responded an insulated door with steel backing would be included for the City side. Mr. Wiseman responded that windows would be included on the top edge of the doors. Chairperson Pro Tem Pentecost stated he appreciated the fact that the applicant had taken what could have been a boring building and made it better than what it is. He stated he agreed with Mr. Rea that more than one color should be used and that more vibrant colors should be used; he suggested Stageline buses would be there so he saw no issue with the color yellow. He stated that for a shop storing buses and trucks, it likely had the most thoughtful design he’d seen.
