HomeMy WebLinkAboutOrdinance 04- 1610 Amends zone map, Laurel Glen ORDINANCE NO. 1610 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONT ANA, AMENDING THE CITY OF BOZEMAN ZONE MAP BY ESTABLISHING AN INITIAL ZONING DESIGNATION OF "R-1 " (RESIDENTIAL SINGLE HOUSEHOLD, lOW DENSITY DISTRICT), "R-2" (RESIDENTIAL TWO HOUSEHOLD, MEDIUIM DENSITY DISTRICT), "R-3" (RESIDENTIAL MEDIUM DENSITY DISTRICT), "R-4" (RESIDENTIAL HIGH DENSITY DISTRICT), "PLI", (PUBLIC lANDS AND INSTITUTIONS DISTRICT), AND "B-1" (NEIGHBORHOOD BUSINESS DISTRICT) ON 156.96 ACRES SITUATED IN THE WEST HALF OF THE SOUTHEAST QUARTER AND EAST HALF OF THE SOUTHWEST QUARTER OF SECTION 35, TOWNSHIP 2 SOUTH, RANGE 5 EAST, MONTANA PRINCIPAL MERIDIAN. WHEREAS, the proposed zone map amendment to establish an initial zoning designation of "R-2" (Residential Single Family, Medium Density District), "R-3A" (Residential Two-Family, Medium Density District), "R-3", (Residential Medium Density District), "R-4" (Residential High Density District), "PU" (Public Lands and Institutions District), and "B-2" (Community Business District), on 156.96 acres has been properly submitted, reviewed and advertised; and WHEREAS, the City of Bozeman Zoning Commission held a public hearing on October 16, 2001, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, two (2) members of the general pUblic spoke in opposition to the proposed zone map amendment on said lands and four (4) members of the general public expressed concern with infrastructure, traffic impacts, street improvements, pUblic services and safety, and impact on existing rural residential dwellings; and WHEREAS, the City of Bozeman Zoning Commission discussed the appropriateness of a "B-1" (Neighborhood Business District) zoning designation in place of the requested "B-2" (Community Business District) zoning designation, and a "PU" (Public Lands and Institutions District) zoning designation for all lands proposed for dedicated parklands; and WHEREAS, the City of Bozeman Zoning Commission found that a "B-1" (Neighborhood Business District) zoning designation is consistent with the "Neighborhood Commercial" node of the Land Use Plan Element of the Master Plan and is a more appropriate zoning designation than the "B-2" (Community Business District) zoning designation; and WHEREAS, the City of Bozeman Zoning Commission recommended to the Bozeman City Commission that the zone map amendment be approved with amendments to modify the proposed "PU" (Public Lands and Institutions District) lands along West Oak Street to "R-4" (Residential High Density District), with the parkland east of the proposed town center to be designated as "PU" (Public lands and Institutions), and that the areas requested for "B-2" (Community Business District) zoning designation be designated as "B-1" (Neighborhood Business District); and WHEREAS, after proper notice, a public hearing was set before the City Commission on November 13, 2001, to receive and review all written and oral testimony on the request for a zone map amendment; and --- -- --------- -- - -- ------- - ------------ - -.. .-.... ..-..---- -- - ,.--.-.-...------ WHEREAS, the City Commission received five (5) letters of written testimony from the general public with three (3) letters expressing opposition to the request for a zone map amendment and two (2) letters expressing concern with infrastructure, traffic impacts, public services and safety, natural amenities, and impact on existing rural residential dwellings; and WHEREAS, the City Commission held its public hearing on November 13,2001, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, four (4) members of the general public expressed concern with infrastructure, traffic impacts, street improvements, public services and safety, natural amenities, and impact on existing rural residential dwellings; and WHEREAS, the City Commission declared a need for a broader mix of uses and housing types, better connectivity of the interior street system, appropriate zoning designation for dedicated parklands, and further improvement of an innovative design for development of the subject property; and WHEREAS, in response to questions and issues raised, the public hearing was subsequently continued to November 21, 2001, to further consider the proposed land uses, arrangement of zoning designations, and street connectivity; and WHEREAS, at its meeting held on November 21,2001, the City Commission identified the need to consider a rearrangement of the proposed land use patterns and arrangement of zoning designations for said lands to address the goals and policies of the City of Bozeman growth policy; and WHEREAS, the City Commission reviewed and considered the twelve zone change criteria set forth in Section 76-2-304, M.C.A., and found than the initial zoning designations, as proposed, would not be in compliance with the Bozeman 2020 Community Plan and would not be in the public interest; and WHEREAS, the City Commission, at the recommendation of City staff, acknowledged the need to re-notice said public hearings before the Zoning Commission and City Commission to consider modifications to the proposed zone map amendment; and WHEREAS, the proposed modifications to the zone map amendment to establish an initial zoning designation of "R-2" (Residential Single Family, Medium Density District), "R-3A" (Residential Two-Family, Medium Density District), "R-3", (Residential Medium Density District), "R-4" (Residential High Density District), "PU" (Public Lands and Institutions District), and "B-1 II (Neighborhood Service District) on 156.96 acres has been properly and advertised; and WHEREAS, the City of Bozeman Zoning Commission held a public hearing on January 15, 2002, to receive and review all written and oral testimony on the proposed modifications to said request for a zone map amendment; and WHEREAS, the City of Bozeman Zoning Commission discussed the appropriateness of a "PU" (Public Lands and Institutions District) zoning designation for all lands proposed for dedicated parklands; and WHEREAS, the City of Bozeman Zoning Commission elected to defer the recommendation of proposed zoning designation for all areas to be dedicated parklands on said lands to the discretion of City Management and City Staff; and WHEREAS, the City of Bozeman Zoning Commission recommended to the Bozeman City Commission that the zone map amendment be approved; and - 2 - ----- ..- ..---..-..........-..---- ..---... ..........------ --- WHEREAS, the City Commission held its public hearing on February 4, 2002, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, two (2) members of the general public expressed concern with infrastructure, traffic impacts, public services and safety, ground water, impact on existing rural residential dwellings, and potential for future development; and WHEREAS, the City Commission, after review and consideration of the twelve zone change criteria set forth in Section 76-2-304, M.C.A., found that, upon annexation of the subject property, initial zoning designations of "R-2" (Residential Single Family, Medium Density District), "R-3A" (Residential Two-Family, Medium Density District), "R-3", (Residential Medium Density District), "R-4" (Residential High Density District), "PU" (Public Lands and Institutions District), and "B-1" (Neighborhood Service District), as specified, would be in compliance with the twelve criteria, the Bozeman 2020 Community Plan, and would be in the public interest; and WHEREAS, the subject property was annexed through adoption of Commission Resolution No. 3649, adopted on the 20th day of January, 2004; and WHEREAS, on the 24th day of November, 2003, the City Commission finally adopted Ordinance No. 1604, repealing Title 18 of the Bozeman Municipal Code, "Zoning," and adopting by reference a new Title 18, "Unified Development Ordinance," and further adopting by reference a new official zoning map; and WHEREAS, the new Title 18, "Unified Development Ordinance," consolidates the former R-1 , R-2, and R-2A zoning districts designated in Title 18, "Zoning," and specifies that all districts formerly designated "R-2" Residential Single-Household, Medium Density District on the official zoning map adopted by reference by Title 18, "Zoning," shall henceforth be designated as "R-1 ," Residential Single- Household, Low Density District; and WHEREAS, the new Title 18, "Unified Development Ordinance," identifies the former R-3A zoning districts designated in Title 18, "Zoning," and specifies that all districts formerly designated "R-3A" Residential Single-Household, Medium Density District on the official zoning map adopted by reference by Title 18, "Zoning," shall henceforth be designated as "R-2," Residential Two-Household, Medium Density District. NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman, Montana: Section 1 That the following described tracts are hereby initially established as "R-1" (Residential Single- Household, Low Density District).
