ORDINANCE NO. 1614
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING THE CITY OF BOZEMAN
ZONE MAP AND
ESTABLISHING AN INITIAL MUNICIPAL ZONING DESIGNATION OF "R-3"
(RESIDENTIAL MEDIUM DENSITY DISTRICT) ON 10.06ACRES lOCATED IN THE
SE1J., SW1J., SECTION 35, T1S, R5E, P.M.M., GALLATIN COUNTY, MONTANA.
WHEREAS, the proposed zone map amendment to grant a zoning designation of "R-3" ,
Residential Medium Density District, has been properly submitted, reviewed and advertised; and
WHEREAS, the Bozeman Zoning Commission held a public hearing on June 18, 2002, to
receive and review all written and oral testimony on the request for a zone map amendment; and
WHEREAS, the Bozeman Zoning Commission recommended to the Bozeman City Commission
that the zone map amendment be approved; and
WHEREAS, after proper notice, the City Commission held its public hearing on July 15, 2002,
to receive and review all written and oral testimony on the request for a zone map amendment; and
WHEREAS, the City Commission has reviewed and considered the twelve zone change criteria
established in Section 76-2-304, M.C.A., and found the proposed zone map amendment, to be in
compliance with the twelve criteria; and
WHEREAS, at its meeting held on July 15, 2002, the City Commission found that the proposed
zone map amendment would be in compliance with the Bozeman adopted Growth Policy and would be
in the public interest upon annexation of the subject property; and
WHEREAS, the subject property was annexed through adoption of Commission Resolution No.
3681, adopted on the 19th day of April, 2004.
NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman,
Montana:
Section 1
That the zoning district designation of the following-described property is hereby designated
as "R-3" (Residential Medium Density District) on is 1 0.0611 acres, subject to existing easements, to wit:
The tract of land described in Document Number 2058722, records in the office of the
Clerk and Recorder, Gallatin County, Montana, and located in the Southeast Quarter
of the Southwest Quarter of Section 35. Township 1 South, Range 5 East of P.M.M.,
and further described as follows:
Commencing at the south quarter corner of Section 35, Township 1 South, Range 5
East, P.M.M.; thence westerly 269016'00", assumed azimuth from North, 661.04 feet
along the south line of the Southwest quarter of said Section 35, to the point of
beginning of the property to be described; thence continuing westerly 269016'00"
azimuth 330.52 feet along said South line; thence northerly 359052'35" azimuth
1325.40 feet along the west line of the East half of the West half of the Southeast
quarter of the Southwest quarter of said Section 35; thence easterly 089018'00"
azimuth 330.89 feet along the North line of the East half of the west half of the
Southeast quarter of the Southwest quarter of said Section 35; thence southerly
179053'33" azimuth 1325.21 feet along the East line of the East half of the West half
of the Southeast quarter of the Southwest quarter of said Section 35 to the point of
beginning.
Section 2
The effective date is thirty days after final adoption of this ordinance on second reading.
PASSED by the City Commission of the City of Bozeman, Montana on first reading at a regular
session thereof held on the 19th day of April 2004.
