ORDINANCE NO. 1615
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING THE CITY OF BOZEMAN ZONE MAP BY AMENDING
THE ZONING DESIGNATION FROM "R-3" (RESIDENTIAL-MEDIUM-DENSITY
DISTRICT) TO "R-1" (RESIDENTIAL-SINGLE-HOUSEHOLD, LOW-DENSITY
DISTRICT) ON APPROXIMATELY 33 ACRES IN THE UNIVERSITY SUBDIVISION,
LOCATED IN THE NW% OF SECTION 18, T2S, R6E, PMM, CITY OF BOZEMAN,
GALLATIN COUNTY, MONTANA.
WHEREAS, the proposed zone map amendment to rezone approximately 33 acres from "R-3"
(Residential-Medium-Density District) to "R-1" (Residential-Single-Household Low-Density District), has
been properly submitted, reviewed and advertised; and
WHEREAS, the Bozeman Zoning Commission held a public hearing on April 20, 2004, to
receive and review all written and oral testimony on the request for a zone map amendment; and
WHEREAS, the Bozeman Zoning Commission recommended to the Bozeman City Commission
that the zone map amendment be approved; and
WHEREAS, after proper notice, the City Commission held its public hearing on May 3, 2004,
to receive and review all written and oral testimony on the request for a zone map amendment; and
WHEREAS, the City Commission has reviewed and considered the twelve zone change criteria
established in Section 76-2-304, M.C.A., and found the proposed zone map amendment, to be in
compliance with the twelve criteria; and
WHEREAS, at its meeting held on May 3, 2004, the City Commission found that the proposed
zone map amendment would be in compliance with Bozeman's adopted growth policy and would be in
the public interest.
NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman,
Montana:
Section 1
That the zoning district designation of the following-described property is hereby amended from
"R-3" (Residential-Medium-Density District) to "R-1" (Residential-Single-Household Low-Density
District):
A tract of land located in the NW1f4 of Section 18, T2S, R6E, PMM, City of Bozeman,
Gallatin County, Montana. Beginning at the southeast corner of the University
Subdivision No.2; thence North 89027' West, along the south line of said subdivision,
a distance of 1190.0 feet to a point on the west right-of-way line of South Tracy
Avenue; thence North 00027' West, along said right-of-way line and its northerly
extension, a distance of 1030.2 feet to a point on the southeasterly line of Tract 4 of
Certificate of Survey No. 1571; thence North 30022' East, along said line, a distance
of 38.8 feet; thence North 89045' East, along said line, a distance of 20.3 feet; thence
North 30022' East, along the northwesterly line of University Subdivision, as
amended, a distance of 116.2 feet to a point on the centerline of East Garfield Street;
thence North 90000' East, along said centerline, a distance of 1089.8 feet to a point
on the east line of said University Subdivision No.2; thence South 00027' East, along
said line, a distance of 1211.4 feet, more or less, to the Point of Beginning thus
affecting the following lots:
University Subdivision as amended by F-29 and F-29A, Block 1: Lots 1 A, 1 B, & 2-5;
University Subdivision as amended by F-29, Block 2: Lots 1-22; University
Subdivision, Block 3: Lots 1-3; University Subdivision, Block 4: Lots 1-24; University
Subdivision No.2, Block 2: Lots 13-24; University Subdivision No.2, Block 4: Lots 1-
24; University Subdivision No.2, Block 6: Lots 1-14; University Subdivision No.2,
Block 7: Lots 1-4; University Subdivision No.3, Block 1: Lot 1; University Subdivision
No.3, Block 2: Lots 1-12; Abandoned Railroad R/W as described in Film 90, Page
1178.
Said parcel containing 33 acres more or less.
Section 2
The effective date is ninety days after final adoption of this ordinance on second reading.
PASSED by the City Commission of the City of Bozeman, Montana on first reading at a regular
session thereof held on the 14th day of June 2004.
