HomeMy WebLinkAboutConsider Termination of Police Impact Fee Study Commission Memorandum REPORT TO: Honorable Mayor and Commission Members FROM: Chris Kukulski, City Manager Anna Rosenberry, Finance Director Chris Saunders, Assistant Planning Director Mark Tymrak, Director of Public Safety - Police SUBJECT: Termination of Police Impact Fee Study Contract MEETING DATE: April 27, 2009 RECOMMENDATION: Consider approving the termination of the Professional Services Agreement for Law Enforcement Impact Fees. BACKGROUND: In November 2007, the city entered into a contract with Tindale-Oliver, & Associates (TOA) to complete a study that would calculate the development impact fee for law enforcement infrastructure in the City. The agreement is in force through August 20, 2009. In law enforcement, there are a very small number of capital items that are eligible for impact fees; capital items that expand capacity with a useful life of ten years or more. Central to the calculation is the cost of the police and court facility. At the time we entered into this contract, we believed we were close to establishing a location and arriving at a facility cost. Work/Meetings Completed: o Kick Off Meeting, November 26, 2007- Scope of Service, Data Needs Memo & Assignments, Coordination of Project Schedule. In Bozeman. TOA had three staff in attendance, including their contract attorney. o Conference Call, February 20, 2008 - Analysis of City Owned vs. Leased Facilities, Timing of New Building Construction, Debt Service Funding, Remaining Data Needs, Report Preparation/Project Schedule. While under contract, TOA worked on our data set of police calls-for-service, building permit activity, and daily functional population/net migration. On more than one occasion, they 75 described the implications of leasing ground vs. buying ground, and had discussions with staff regarding quantifying the current amount of "capacity deficit" for police facility needs. However, we have never able to get them the facility cost and design information that is integral to finishing this study. Due to the current situation with land acquisition, and given the existing economic and building climate, we recommend termination of this contract. We posed the question of possibly terminating this agreement to Tindale-Oliver and they were understanding of our situation and agreeable. They requested that we provide them with written notice of termination. If the Commission does not wish to terminate the agreement, please provide direction on whether we should try to extend the current contract for a longer term. FISCAL EFFECTS: The total price of the contract was $34,960. During FY08, we paid$8,015, primarily for meetings with staff and initial development of the study. During FY09, no work was done and nothing has been paid. With termination, nothing more will be paid. ALTERNATIVES: As suggested by the City Commission.
