Kukulski, City Manager SUBJECT: Provisional adoption of Ordinance No. 1759, Amendments to Ordinance No. 1726, providing for the amendment of Chapter 2.01 by amending the sections on Financial Disclosure, Post Employment Prohibitions and Definitions. MEETING DATE: April 20, 2009 RECOMMENDATION: Provisionally adopt Ordinance No. 1759, Amendments to Ordinance No. 1726, revising Chapter 2.01 of said code; providing for the amendment of Chapter 2.01 by amending the sections on Financial Disclosure, Post Employment Prohibitions and Definitions. BACKGROUND: At the Commission’s direction, I have amended the Ethics Ordinance to modify who must file the financial disclosure statement set out in 2.01.100. I have added the concept that a covered person must disclose entities in which he/she has a 10% or greater interest as an equity owner and any real property which the individual holds an equity interest of 10% or more. I have amended Post Employment Activities 2.01.110 to allow former public servants to appear before decision makers so long as they disclose in writing pursuant to 2.01.111 the reason for such appearance and officers or employment held by the public servant for the 12 months preceding succession of employment. If the notice is filed with the Clerk of the Commission and the City Attorney’s office, the former public servant may participate in such post employment activities. I will be present at the meeting on April 20, 2009 to answer any questions. ALTERNATIVES: As suggested by the City Commission. UNRESOLVED ISSUES: None. FISCAL EFFECTS: There are no direct fiscal impacts related to this ordinance.
