ORDINANCE NO. 1624
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING THE CITY OF BOZEMAN ZONE
MAP AND
ESTABLISHING AN INITIAL MUNICIPAL ZONING DESIGNATION OF "R-4"
(RESIDENTIAL HIGH DENSITY DISTRICT) ON THE NORTH 1 0.887 ACRES AND
"R-3" (RESIDENTIAL MEDIUM DENSITY DISTRICT) ON THE SOUTH 28.949
ACRES lEGAllY DESCRIBED AS TRACT B, C.O.S. 2389, lOCATED IN THE SE%,
SECTION 4, T2S, R5E, P.M.M., GAllATIN COUNTY, MONTANA.
WHEREAS, the proposed zone map amendment to grant a zoning designation of "R-4"
(Residential High Density District) on the north 1 0.887 acres and "R-3" (Residential Medium Density
District) on the south 28.949 acres, has been properly submitted, reviewed and advertised; and
WHEREAS, the Bozeman Zoning Commission held a public hearing on January 21, 2004, to
receive and review all written and oral testimony on the request for a zone map amendment; and
WHEREAS, the Bozeman Zoning Commission recommended to the Bozeman City Commission
that the zone map amendment be approved; and
WHEREAS, after proper notice, the City Commission held its public hearing on February 23,
2004, to receive and review all written and oral testimony on the request for a zone map amendment;
and
WHEREAS, the City Commission has reviewed and considered the twelve zone change criteria
established in Section 76-2-304, M.C.A., and found the proposed zone map amendment, to be in
compliance with the twelve criteria; and
WHEREAS, at its meeting held on February 23, 2004, the City Commission found that the
proposed zone map amendment would be in compliance with the Bozeman 2020 Community Plan and
would be in the public interest upon annexation of the subject property; and
WHEREAS, the subject property was annexed through adoption of Commission Resolution No.
3752, adopted on the 22nd day of November 2004.
NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman,
Montana:

That the zoning district designation on Tract B, C.O.S. 2389, located in the SE%, Section 4,
T2S, R5E, P.M.M., Gallatin County, Montana property is hereby designated as:
R-3 Zonina
Commencing at the Southeast Corner of said Section 4; thence westerly 270004' 30",
assumed azimuth from north, 660.93 feet along the south line of the Southeast
Quarter of said Section 4 to the point of beginning:
thence continuing westerly 2700 04' 30" azimuth 660.93 feet along said south line;
thence northerly 0010 01' 12" azimuth 1906.30 feet along the west line of said Tract
B; thence easterly 0900 00' 00" azimuth 661.95 feet; thence southerly 181003' 01"
