PUBLIC STREET AND UTILITY EASEMENT
AND TEMPORARY CUL-DE-SAC-EASEMENT
PT Land, a Montana general partnership, GRANTOR, in consideration of $ 1.00 and for
other good and valuable consideration, receipt of which is acknowledged, grants to The
City of Bozeman, a municipal corporation of the State of Montana, with offices at 411
East Main, Bozeman, Montana 59715, GRANTEE, its successors and assigns, the
following easements, for the use of the public, in, through, and across a parcel of land
situated in Gallatin County, Montana, to be located on the following described real
property: Tract 2A of Certificate of Survey 1215F, situated in the northwest 1/4 of
Section 1, Township 2 South, Range 5 East, P.M.M., City of Bozeman, Gallatin County,
Montana:
1. A perpetual street and utility easement as described on the attached
Exhibits A, A-2, and B which by this reference are made a part hereof.
2. A temporary easement for a cul-de-sac as described on the attached
Exhibits A and C which by this reference are made a part hereof. This
temporary easement for a cul-de-sac is for use with the portion of
Tschache Lane which runs between North 19~' Avenue and the cul-de-
sac, which portion of Tschache Lane will be paved and otherwise
improved in connection with the development of the Saccoccia Minor
Subdivision. When Tschache Lane has been paved and otherwise
improved to the east of the cul-de-sac, the Grantee and the Grantor will
execute and record an agreement which terminates this temporary
easement for a cul-de-sac.
The GRANTOR states that he possesses the real property described above and
that he has a lawful right to grant an easement thereon. The GRANTOR further agrees
that the GRANTEE may peaceably hold and enjoy the rights and privileges herein
granted without any interruption by the GRANTOR.
The terms, covenants, and provisions of this easement shall extend to and be
binding upon the heirs, executors, administrators, personal representatives, successors,
and assigns of the parties hereto.

BACKGROUND: Attached are copies (original to Stacy Ulmen), of the partially executed
easements for the public street and utility easement and temporary cul-de-
sac easement for the above referenced project. Engineering staff has
reviewed the easements and found them to be acceptable.
