HomeMy WebLinkAboutOrdinance 05- 1632 Create City Clerk office, effective July 1, 2005 ORDINANCE NO. 1632 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, PROVIDING THAT THE BOZEMAN MUNICIPAL CODE BE AMENDED BY ADDING A NEW CHAPTER 2.30, ENTITLED "OFFICE OF THE CITY CLERK"; BY AMENDING AND RENUMBERING SECTION 2.32.050, ESTABLISHING THE REQUIREMENT FOR A BOND AND OATH; AND BY REPEALING SECTION 2.04.060. BE IT ORDAINED by the City Commission of the City of Bozeman, Montana: Section 1 That the Bozeman Municipal Code is amended by adding a new Chapter 2.30, so that such chapter shall read as follows: "Chapter 2.30 Office of the City Clerk 2.30.010 City Clerk. A. The City Clerk shall be appointed by the City Manager and shall serve until removed by him, or until a successor is appointed and qualifies. B. Powers and duties of the City Clerk shall include: 1. Attend all meetings of the Commission and record and sign the proceedings thereof. 2. Keep records of the Commission. Maintain and preserve the minutes and records of the proceedings of the Commission in accordance with State statutes, ordinances and resolutions. 3. Record ordinances and resolutions. Enter into a book all ordinances and resolutions passed and adopted by the Commission and be the legal custodian of the same. 4. Maintain all contracts passed, adopted or entered into by the City. 5. Countersign and cause to be posted or published, as provided by State statute, all ordinances or resolutions adopted by the Commission. 6. Publish all legal notices as required by State statute or ordinance. 7. Take and administer oaths. 8. Make and certify copies of all records, books and papers in the possession of the office. 9. Make and keep a complete index of the minutes, ordinances and resolutions on file in the office. . ..__n.._.___ 10. Post meeting notices. Cause notices of special meetings of the City Commission to be posted in accordance with State statutes, ordinances or resolutions. 11. Maintain the City seal. Have custody of the seal of the City and affix it to such documents as may be required and authorized pursuant to law. 12. Records Manager. Serve as the City's records manager, ensuring that all records of the City are retained and maintained in accordance with State statutes and adopted records retention schedules. 13. Perform such other duties as may be required by ordinance or resolution or by order of the City Manager. C. The City Clerk shall receive such salary as may be fixed by the City Manager." Section 2 That Section 2.32.050 of the Bozeman Municipal Code is amended and renumberered as Section 2.30.020, so that such Section 2.30.020 shall read as follows: "2.32.050 2.30.020 Assistance by the clerk of the commission City Clerk - Oath and bond. Section 3 That Section 2.04.060 of the Bozeman Municipal Code, entitled "Clerk of the Commission", is hereby repealed and declared null and void. Section 4 Repealer. All resolutions, ordinances and sections of the Bozeman Municipal Code and parts thereof in conflict herewith are hereby repealed. - 2 - Section 5 Savinas Provision. This ordinance does not affect the rights and duties that matured, penalties that were incurred or proceedings that were begun before the effective date of this ordinance. Section 6 Severabilitv. If any portion of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions of this ordinance which may be given effect without the invalid provisions or application and, to this end, the provisions of this ordinance are declared to be severable. Section 7 Effective Date. This ordinance shall be in full force and effect on July 1, 2005. PASSED by the City Commission of the City of Bozeman, Montana on first reading at a regular session thereof held on the 21 st day of March 2005.
