ORDINANCE NO. 1634
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING THE CITY OF BOZEMAN ZONE MAP BY ESTABLISHING
AN INITIAL ZONING DESIGNATION OF "R-3" (RESIDENTIAL MEDIUM DENSITY
DISTRICT) ON 59.823 ACRES SITUATED IN THE E % W % SW % and W % W %
E % SE % OF SECTION 3, TOWNSHIP 2 SOUTH, RANGE 5 EAST, P.M.M.,
GAllATIN COUNTY, MONTANA.
WHEREAS, the proposed zone map amendment to establish an initial zoning designation of "R-
3", (Residential Medium Density District) on 59.823 acres has been properly submitted, reviewed and
advertised; and
WHEREAS, the Bozeman Zoning Commission held a public hearing on November 4, 2003, to
receive and review all written and oral testimony on the request for a zone map amendment; and
WHEREAS, the Bozeman Zoning Commission recommended to the Bozeman City Commission
that the zone map amendment be approved; and
WHEREAS, after proper notice, a public hearing was set before the City Commission on
November 17, 2003, to receive and review all written and oral testimony on the request for a zone map
amendment; and
WHEREAS, the City Commission opened and held its public hearing on November 17, 2003, to
receive and review all written and oral testimony on the request for a zone map amendment; and
WHEREAS, the City Commission has reviewed and considered the twelve zone change criteria
established in Section 76-2-304, M.C.A., and found the proposed zone map amendment, as recommended
by the Zoning Commission, to be in compliance with the twelve criteria; and
WHEREAS, the City Commission found that the proposed zone map amendment would be in
compliance with the Bozeman 2020 Community Plan, and would be in the public interest, upon annexation
of the subject property; and
WHEREAS, the subject property was annexed through adoption of Commission Resolution No.
3787, on the 18th day of April, 2005.
NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman,
Montana:
Section 1
That the zoning district designation of the following-described property is hereby initially
established as "R-3" (Residential Medium Density District).
A tract of land being the E Y:1: W Y:1: SW ~ and the W Y:1: W Y:1: E Y:1: SE ~ of Section 3,
T2S, R5E, P.M.M., Gallatin County, Montana, and being further described as follows:
Beginning at a point on the south line of said Section 3 which bears S89.59'47"W a
distance of 982.44 feet from the southeast corner of said Section 3, said point being
the W-E-E1/256 corner of said Section and the southwest corner of Diamond Estates
Subdivision No.1; thence along the south line of said Section 3 S89.59'47"W a
distance of 982.43 feet to the W-E1/64 corner of said Section, said point also being the
southeast corner of Diamond Estates NO.2 Subdivision; thence along the W-E1/64 line
of said Section and the east line of Diamond Estates No.2 Subdivision NOO.58'57"E
a distance of 2642.94 feet to the C-W-E1/64 corner; thence along the E-W mid-section
line of said Section 3 N89.48'24"E a distance of 988.66 feet to the C-W-E-E 1/64 corner,
said point also being the northwest corner of Diamond Estates Subdivision No.1;
thence along the W-E-E line and the west line of Diamond Estates Subdivision NO.1
S01.06'58"W a distance of 2646.33 feet to the Point of Beginning.
Said Tract of land being 59.823 acres of land, more or less, along with and subject to
all existing easements of record or of fact.
Section 2
The effective date is thirty days after final adoption of this ordinance on second reading.
PASSED by the City Commission of the City of Bozeman, Montana, on first reading, at a regular
session thereof held on the 18th day of April, 2005.
