ORDINANCE NO. 1635 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING THE CITY OF BOZEMAN ZONE MAP AND ESTABLISHING AN INITIAL MUNICIPAL ZONING DESIGNATION OF "R~1" (RESIDENTIAL SINGlE~HOUSEHOlD, lOW DENSITY DISTRICT) ON 12.937 ACRES AND "R~3" (RESIDENTIAL MEDIUM DENSITY DISTRICT) ON 7.187 ACRES lOCATED IN SECTIONS 32, T1S, R6E, PMM, GAllATIN COUNTY, MONTANA. WHEREAS, the proposed zone map amendment to grant a zoning designation of "R-1", Residential Single-household, Low Density District, and "R-3" Residential Medium Density District, has been properly submitted, reviewed and advertised; and WHEREAS, the Bozeman Zoning Commission held a public hearing on April 6, 2004, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the Bozeman Zoning Commission recommended to the Bozeman City Commission that the zone map amendment be approved; and WHEREAS, after proper notice, the City Commission held its public hearing on May 3, 2004, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the City Commission has reviewed and considered the twelve zone change criteria established in Section 76-2-304, M.C.A., and found the proposed zone map amendment, to be in compliance with the twelve criteria; and WHEREAS, at its meeting held on May 3, 2004, the City Commission found that the proposed zone map amendment would be in compliance with the City of Bozeman Growth Policy and would be in the public interest upon annexation of the subject property; and WHEREAS, the subject property was annexed through adoption of Commission Resolution No. 3788, on the 18th day of April, 2005. NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman, Montana: Section 1 That the following-described tract is hereby established as "R-1" (Residential Single-household Low Density District) on 12.937 acres: A tract of land being a portion of Tract 7A of Certificate of Survey No. 2408 situated inthe NW1/4SW1/4 Section 32, T1S, R6E, P.M.M., City of Bozeman, Gallatin County, Montana, and being further described as follows: ---.-----.-.... Beginning at a point on the E-W mid-section line which bears S88"15"51 "E a distance of 469.15 feet from the W1/4 corner of said Section 32; thence along the E-W mid- section line of said Section 32 S88"15'51 "E a distance of 843.49 feet to the C-W1/16 corner; thence along the W1 /16line of said Section SOO"07'46"W a distance of 667.57 feet to the C-N-SW1/64 corner; thence along the N1/64 line of the SW1/4 of said Section 32 N88"15'51 "W a distance of 845.53 feet; thence NOO"18'19"E a distance of 667.51 feet to the Point of Beginning. Said tract contains 563,548 square feet or 12.937 acres, more or less, and is subject to all existing easements, whether of record or apparent on the ground. Section 2 That the following-described tract is hereby established as"R-3" (Residential Medium Density District) on 7 .187 acres: A tract of land being a portion of Tract 7 A of Certificate of Survey No. 2408 situated in the NW1/4SW1/4 Section 32, T1 S, R6E, P.M.M., City of Bozeman, Gallatin County, Montana, and being further described as follows: Beginning at the W1/4 corner of said Section 32; thence along the E-W mid-section line of said Section 32 S88"15'51 "E a distance of 469.15 feet; thence SOO"18'19"W a distance of 667.51 feet to a point on the N1/64 line of the SW1/4 of said Section; thence along said N1/64 line N88"15'51"W a distance of 469.15 feet to the N-S1/64 corner common to Sections 31 and 32 in said Township and Range; thence along the section line common to said Sections 31 and 32 NOO"17'50"E a distance of 667.51 feet to the Point of Beginning. Said tract contains 313,065 square feet or 7.187 acres, more or less, and is subject to all existing easements, whether of record or apparent on the ground. Section 3 The effective date is thirty days after final adoption of this ordinance on second reading.
