SUBJECT: Board of Appeals (Re)Appointments
MEETING DATE: February 4, 2008
RECOMMENDATION: (Re)appoint members to the Board of Appeals.
BACKGROUND: Four terms on the Board of Appeals expired on December 31, 2007, and one
term expired on December 31, 2006, so there are currently five vacancies.
The Board of Appeals was established under Commission Resolution No. 2483, adopted October
3, 1983 to determine the suitability of alternate materials and methods of construction and to
provide reasonable interpretation of the following codes of the City of Bozeman: Building Code,
Electrical Code, Mechanical Code, and Plumbing Code.
The Board of Appeals shall consist of five members appointed by the City Commission and
serving without compensation, who are qualified by experience and training to pass upon matters
pertaining to building construction. The Building Official shall be an ex officio member and
shall act as Secretary of the Board.
The initial terms of office were as follows: one appointed for one year, two appointed for two
years, and two appointed for three years. Succeeding appointments are for a period of three
years.
The Board of Appeals shall adopt reasonable written rules and regulations for conducting its
business, hear appeals not more than thirty (30) days after filing thereof, and render all decisions
and findings in writing to the appellant with a copy to the Building Official.
This board currently has five vacancies and four applicants. If possible, please specify which
member is being appointed to the one term that expired on December 31, 2006 (which would end
December 31, 2009). Since four of the five terms are not currently staggered, it appears that the
initial staggering set up in the resolution didn’t continue. Perhaps decide if terms shall be newly
staggered so that all board members in the future don’t expire at once.
