3. Authorize Mayor to sign the Findings of Fact and Order for the

7. Approve Mount Baldy-Thies Lots 25 & 26 Annexation #A-07007, with
the 13 recommended Terms of Annexation listed on pages 2-3 of the Staff
Report, and direct staff to prepare an Annexation Agreement for signature
by the parties (Skelton )
8. Approve Bid for One New 42 Cubic Yard Capacity Recycling Truck
(Johnson)
9. Provisionally adopt Ordinance No. 1740, Billion Property Zone Map
Amendment #Z-07261 (Riley)
10. Approve Bid for One New 2008 60,000 lb GVWR Tandem Axle Truck
with installed and operating New Inside/Outside Rail Cable Roll-Off Hoist
(Johnson)

within the purview of the Bozeman City Commission. There will also be an
opportunity in conjunction with each agenda item for comments pertaining to that
item. Please limit your comments to 3 minutes.
F. Action Items
1. Bozeman Birthing Center Conditional Use Permit and Certificate of
Appropriateness with Deviations #Z-08012 (Bristor)
*Consider a motion approving the Bozeman Birthing Center Conditional Use Permit and
Certificate of Appropriateness with Deviations #Z-08012, with the two requested
deviations and the Recommended Conditions of Approval listed in the Staff Report.
2. Mount Baldy-Thies Lots 25 & 26 Zone Map Amendment #Z-07283
(Skelton)
*Consider a motion approving an initial municipal zoning designation of RS (Residential
Suburban District) for Mount Baldy-Thies Lots 25 & 26 Zone Map Amendment #Z-07283
with the contingencies listed in Zoning Commission Resolution #Z-07283.
3. Baxter Main, LLC Historic Sign Designation #Z-07230 (Bristor)
*Consider a motion approving the historic sign designations of the “Hotel Baxter” roof
sign (including the blue light) and the freestanding pole sign, by finding the signs have
historical and cultural significance to the City of Bozeman, but do not conform to the
provisions of the Bozeman Municipal Code.
AND
Direct staff to create findings and a resolution for the historic sign designation for future
adoption by the City Commission.
4. Ted's Montana Grill Change in Use and Certificate of Appropriateness
with Deviations #Z-08019 (Bristor)
*Consider a motion approving the Ted’s Montana Grill Change in Use and Certificate of
Appropriateness with Deviations #Z-08019, with the three requested deviations and the
Recommended Conditions of Approval listed in the Staff Report.
5. Minor Modification to the Valley West Planned Unit Development #Z-
08020 (Krueger)
*Provide comments regarding the Minor Modification to the Valley West Planned Unit
Development #Z-08020.

*Consider recommending approval to the Planning Director with the conditions outlined
by staff for the proposed Minor Modification to the Valley West Planned Unit
Development #Z-08020.
AND
Provide comment to the applicant on the updated Parks Master Plan.
6. Burke Park Lots Purchase (Dingman)
*Consider a motion approving the purchase of the Burke Park lots for $500,000, using
$250,000 from park land cash-in-lieu park funds and $250,000 from general funds.
AND
*Consider a motion authorizing the City Manager to execute the Buy-Sell Agreement and
Settlement Agreement.
