Commission Memorandum

SUBJECT: Greek Way Apartments Site Plan Application #Z-07270
MEETING DATE: Monday, March 17, 2008 at 6:00 PM.
RECOMMENDATION: That the City Commission approve the Greek Way Site Plan
application (#Z-07270) with the conditions and code provisions outlined in the staff report.
BACKGROUND: The property owner, SAAM Real Estate, Inc. and their representative Prugh
and Lenon Architects, P.C. have submitted a site plan application for Lots 4 & 5 of the Greek
Way Subdivision, also known as 1811 Greek Way, to allow the construction of 27 residential
dwellings (6 fourplex units, one duplex unit, and one manager’s dwelling unit), a community
building, and related site improvements.
Both the Development Review Committee (DRC) and staff recommend overall conditional
approval of this application with the conditions and code provisions outlined in the staff report.
The City Commission opened this item on February 11, 2008. The Commission reviewed the
application and requested additional information to supplement the application. The application
review was continued until February 25, 2008. On February 28, 2008 the Commission continued
the application again until March 17, 2008 as requested by the applicant.
UNRESOLVED ISSUES: On February 11, 2008 the Commission requested additional
information on two specific issues:
· the covenant settlement agreement; and
· traffic impacts at the intersection of Greek Way and Kagy Boulevard.
Covenant. The applicant’s counsel requested that the court documents be distributed to the
Commission. Attached to this report is a January 31, 2008 letter from the applicant’s counsel
with the attached settlement documents from the Court. Staff notes in the staff report that the
Greek Way Subdivision was originally envisioned as an area for fraternity and sorority house
locations. A note on the original plat states “No building having less than 6,000 square feet of
floor area may be constructed on any lot herein described.” Private litigation has been ongoing
since 2003 regarding this restriction and other covenants related to the plat. The applicant has
provided evidence to the City that the parties to the litigation have reached a settlement which
will remove this restriction. The Court is prepared to remove this restriction from the
subdivision by order pending the approval of this development proposal by the City. Staff has
recommended a condition that the applicants provide evidence to the City that the
aforementioned plat restriction has been removed from the subdivision prior to final site plan
approval. The recommended condition is listed as condition #1 on page 3 of the staff report.

Traffic. The applicant’s representative TD& H Engineering Consultants have submitted
additional information regarding the traffic impacts of the project at the intersection of Greek
Way and Kagy Boulevard. TD&H submitted a traffic analysis of that intersection including
traffic counts during the AM and PM peak hours. The findings and analysis can be found in the
attached letter from TD& H dated March 7, 2008. City Engineering staff reviewed the report
and concurs with the findings of the study and the conclusion that the intersection meets the
current levels of service standards in Title 18, BMC for the existing traffic plus the proposed
project. No mitigation is required by the code for this development. A memo dated March 11,
2008 from project engineer Murray is attached with staff findings.
FISCAL EFFECTS: The Department of Planning is not aware of any fiscal effects for the
proposed development at this time.
ALTERNATIVES: As suggested by the City Commission.
