ORDINANCE NO. 1740
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF BOZEMAN, MONTANA, AMENDING THE CITY OF
BOZEMAN ZONE MAP FROM “R-4” (RESIDENTIAL HIGH
DENSITY DISTRICT) TO “B-2” (COMMUNITY BUSINESS
DISTRICT) FOR APPROXIMATELY 18.83 ACRES OF
PROPERTY LOCATED SOUTHWEST OF THE INTERSECTION
OF COTTONWOOD ROAD AND WEST BABCOCK STREET IN
THE NE 1/4 OF THE SE 1/4 OF SECTION 9, T2S, R5E, P.M.M.,
CITY OF BOZEMAN, GALLATIN COUNTY, MONTANA.
WHEREAS, the proposed zone map amendment to grant a zoning designation of
"B-2" (Community Business District) has been properly submitted, reviewed and
advertised; and
WHEREAS, the Bozeman Zoning Commission held a public hearing on January
2, 2008, to receive and review all written and oral testimony on the request for a zone
map amendment; and
WHEREAS, the Bozeman Zoning Commission recommended to the Bozeman
City Commission that the zone map amendment be approved as proposed; and
WHEREAS, after proper notice, the City Commission held its public hearing on
January 14, 2008, to receive and review all written and oral testimony on the request for a
zone map amendment; and
WHEREAS, the City Commission has reviewed and considered the twelve zone
map amendment criteria established in Section 76-2-304, M.C.A., and found that the
proposed zone map amendment would be in compliance with the twelve criteria; and
WHEREAS, at its meeting held on January 14, 2008, the City Commission
found that the proposed zone map amendment would be in compliance with Bozeman’s
adopted growth policy and would be in the public interest.

NOW, THEREFORE, BE IT ORDAINED by the City Commission of the
City of Bozeman, Montana:
Section 1
That the zoning district designation of the following-described property is
hereby designated as "B-2" (Community Business District):
That part of the Northeast Quarter of the Southeast Quarter of Section 9, Township 2
South, Range 5 East of P.M.M., City of Bozeman, Gallatin County, Montana, described
as follows:
Beginning at the southeast corner of said Northeast Quarter of the Southeast Quarter;
thence westerly 268° 56' 49", assumed azimuth from north, 1017.14 feet along the south
line of said Northeast Quarter of the Southeast Quarter; thence northwesterly 352° 23'
28" azimuth 46.04' feet along the centerline of Baxter Creek; thence northeasterly 025°
58' 02" azimuth 176.80 feet along said centerline; thence northerly 359°03'52" azimuth
90.89 feet along said centerline; thence northerly 351°31'34" azimuth 174.58 feet along
said centerline; thence northerly 006°47'49" azimuth 386.10 feet along said centerline;
thence easterly 088° 51' 56" azimuth 932.85 feet; thence southerly 180° 22' 13" azimuth
850.88 feet along the east line of said Northeast Quarter of the Southeast Quarter to the
point of beginning.
Area of B-2 zoning = 820,363 square feet or 18.8329 acres. Subject to existing
easements.
Section 2
The effective date is thirty days after final adoption of this ordinance on second
reading.
PASSED by the City Commission of the City of Bozeman, Montana, on first
reading, at a regular session thereof held on the 3rd day of March, 2008.
