Sean Becker, Cr. Eric Bryson, Cr. Jeff Krauss, Cr. Jeff Rupp, City Manager Chris Kukulski, Assistant Planning Director Chris Saunders, City Attorney Paul Luwe, Director of Public Service Debbie Arkell, Assistant to the City Manager and Neighborhood Coordinator Brit Fontenot, and Deputy City Clerk Cynthia Jordan Delaney. 0:20:30 A. Call to Order - 6:00 pm - Community Room, Gallatin County Courthouse, 311 West Main Street Mayor Jacobson called the meeting to order. 0:20:32 B. Pledge of Allegiance and a Moment of Silence 0:21:15 Changes to the Agenda - Chris Kukulski, City Manager Mr. Kukulski stated that Action item F2, "Greater Bozeman Area Transportation Plan (2007 Update) Project Presentation and Discussion, opened and continued from January 22, 2008 (Murray)" will be moved to February 11 because bad weather closed the road from Helena so the consultant couldn't make it. For Action item F4, "East Gallatin Recreation Area Master Plan (Dingman)," staff has requested that we postpone that decision to a later date. 0:22:56 C. Public Service Announcement - Snow Plowing Procedures (Van Delinder) 0:23:07 John Van Delinder, Street Superintendent Mr. Van Delinder talked about residential plowing. He stated that they use motor graters with snow gates, and they never intentionally plow a driveway in. 0:28:28 D. Consent 1. Authorize Payment of Claims (LaMeres) 2. Public Comment Mayor Jacobson opened public comment. 0:29:36 Bob Chase - Public Comment Mr. Chase, of 433 South Black Avenue, stated that last week he entered into the record information about vandalism on his property. He connected vandalism and money being allocated to Story Mansion. He says City money is being allocated to a park that is a building, but the most important things are health, safety, and welfare. Let a private group take the burden of preserving the building. 0:32:59 Brian Leland - Public Comment Mr. Leland, of 528 North Bozeman, stated that he had a guest editorial on the jail in the January 14, 2008 Bozeman Daily Chronicle. It was edited by the Chronicle, and to correct the record he read an excerpt of what he actually wrote and submitted. 0:34:27 Public Comment closed. Mayor Jacobson closed public comment. 0:34:40 1. Vandalism and Graffiti in the City of Bozeman (Fontenot) 0:34:47 Brit Fontenot, Assistant to the City Manager and Neighborhood Coordinator On behalf of many City staff, Mr. Fontenot introduced the topic of vandalism and graffiti. They recommend the creation of a Vandalism and Graffiti Task Force with a wide breadth of participants, as well as direction from the Commission to allocate funds from the departments to combat this problem. 0:36:37 Officer Dave Ferguson, Bozeman Police Dept. Mr. Ferguson gave a presentation with photos showing the type of graffiti being seen in Bozeman and the tools they are looking into to combat it. 0:43:37 Officer Ferguson Officer Ferguson suggested just buying one $5,000 graffiti camera and then seeing how useful it is. 0:44:51 Thom White, Superintendent of Parks and Cemetery Mr. White showed photos of vandalism in City parks, including damage to a concession stand building, toilet facilities, and the sprinkler system. 5 Bozeman City Commission Meeting, January 28, 2008 3 0:48:53 James Goehrung, Director of Facility Services Mr. Goehrung described the vandalism and graffiti to City buildings, including the difficulty of using anti-graffiti products in this climate, looking at money in budget requests to address vandalism, and combining forces with the Downtown Bozeman Partnership. 0:53:02 Mr. Fontenot Mr. Fontenot discussed proposals from the neighborhoods to involve neighborhoods and businesses in a community-wide effort to remove graffiti within 24-48 hours, create partnerships, and get the word out through community education and outreach. 0:58:13 Public Comment opened. Mayor Jacobson opened public comment. 0:58:31 Charlie Finch - Public Comment Mr. Finch, of 816 North 17th, stated that he is an environmentally safe painter who did the mural on Heebs. He found a company that makes environmentally safe graffiti coating, and has two coats on that mural now. The top coat can't be scratched with a nail. This clear product has a high resistance to UV rays and good color retention. There is a lot of potential, and this company also makes a graffiti removal product. 1:02:17 Don Pilotte - Public Comment Mr. Pilotte, of 2007 South Tracy, is the President of the Gallatin Association of Realtors. In May 2007 they put together a public service campaign targeting graffiti, and it seemed very successful. Their 2008 budget includes funds for a public service campaign. They look forward to working with the City to be part of the solution. 1:03:19 Chris Naumann - Public Comment Mr. Naumann, the Executive Director of the Downtown Bozeman Partnership, offered the partnership's support for the vandalism and graffiti task force and encouraged the Commission to direct City staff to form it. He said there are economies of scale on some solutions. Please contact him with any questions about their initiatives with the graffiti removal project. 1:04:43 Public Comment closed. It was moved by Cr. Rupp, seconded by Cr. Rupp wanted to know if the Commission is comfortable with that representation since there is only one citizen/INC member. He wants to add another citizen-at-large or business. 6 Bozeman City Commission Meeting, January 28, 2008 4 1:08:20 Amendment to Motion It was moved by Cr. Krauss, seconded by Cr. Becker, to propose that amendment: that we have an Association of Realtors (member) and a member of the at-large public. 1:09:51 Cr. Krauss Cr. Krauss stated that perhaps in next year's budget have a graffiti and vandalism fund from which the departments draw money so we can see how much this costs us. Rupp's main motion was to create a Vandalism and Graffiti Task Force consistent with what the City Staff Report lists, going off the paragraph on the agenda. 1:16:58 Mayor Jacobson Mayor Jacobson said that a task force appointed by the City Manager would be reporting back to the Commission in a public way. She wants to get going quickly with this. 1:19:25 Amendment to Motion It was moved by Cr. Krauss, seconded by Cr. Becker, I amend the motion to, so we created and staffed a Vandalism and Graffiti Task Force, and just amend the motion to empower the City Manager to appoint that task force. Becker clarified for the public what they voted on: there is a board including a member of citizen-at-large, the Gallatin Association of Realtors, a staff liaison, a representative of the Downtown Partnership, the Bozeman Police Department, the local business community, and the Bozeman School District that will be appointed by the City Manager to address vandalism and graffiti (and one representative of the INC). 1:21:17 Mr. Kukulski Mr. Kukulski stated that they can do some immediate things with the budget. Long term, he can work with Finance to get an account to centrally track costs for our facilities. If you are comfortable with that, tomorrow morning we could get that $5,000 camera. 1:23:29 Mayor Jacobson Mayor Jacobson suggested starting with only one camera. 1:25:54 Cr. Bryson Cr. Bryson stated that if you're going to set aside graffiti mitigation dollars, they need to come at least partially from existing budgets. 1:26:26 Cr. Rupp Cr. Rupp is comfortable empowering the City Manager to do his duty and use his authority to move the dollars around in the budget. 1:27:02 Cr. Krauss Cr. Krauss wants to buy a camera that notifies the police. 1:32:09 Cr. Becker Cr. Becker empowered the City Manager to take immediate action with the camera, and he asked that the use of this camera system be restricted to municipal property only. 1:32:49 Mr. Kukulski Mr. Kukulski asked the officers to use this camera for vandalism and graffiti only. 1:33:35 2. Meadow Creek Subdivision Payback Agreement for Water Improvements, Traffic Signal Improvements, and Sanitary Sewer Improvements (Murray) 1:44:52 Bob Murray, City Engineering Mr. Murray presented the staff report. These water, sewer, and traffic signal improvements payback districts are for larger offsite improvements that ultimately will service a much larger area than the subdivision. 1:54:27 Mr. Murray Mr. Murray clarified that for the properties not in the City, until they come through for a subdivision or site plan review they don't pay anything. 1:57:59 Neal Ainsworth, Applicant Mr. Ainsworth, of 909 Turnberry, stated that they thought if they put in such a sewer system they could recoup what they didn't use as their capacity. They disagree with Bob Murray. They can't get a large percentage of the money back; it's a tough pill to swallow. He asked for consideration to make a zone where it is for properties that are outside of the City coming in. It's only fair. 2:01:20 Public Comment opened. Mayor Jacobson opened public comment. 2:01:32 Dave Kraft - Public Comment Mr. Kraft, of 8670 Fowler, wanted to know how Meadow Creek can create a payback district when they haven't finished the water line project and are three years behind paying for crop damages the water line caused. He and others are denied the right to farm. He doesn't know why part of his land is tied into a payback district since he was denied annexation. 2:04:06 Ted Newman - Public Comment Mr. Newman, of 535 Valley Drive, stated that he is so frustrated that his blood is boiling. Just on his lot in the Fowler Place subdivision, he will pay three times for the sewer: the lot, impact fee, and site plan review. He lives on Valley Drive, and he will pay two times for that. They want to remain in the County, but it's one thing after another with no representation. 2:07:32 Mark Albrecht - Public Comment Mr. Albrecht, of 4969 Durston, stated that he thinks he lives in the sewer payback district. He asked the Commission not to vote on this until there is some clarity. 2:09:04 Dayle Kountz - Public Comment Mr. Kountz, of 5550 Blackwood Road, asked if up there in the peach (in the diagram map) coming from Huffine down to Cottonwood to Stucky if that is that in payoff district, that one to the west. 2:09:38 Mr. Kountz Mr. Kountz said that Loyal Gardens/Madill is trying to do the same thing privately to get us to pay for it now individually to get access to those sewer lines. He is confused since his property is in the peach part, why is it in this district? 2:10:25 Deb Stober - Public Comment Ms. Stober, of 395 North Valley Drive, is representing her household as well as her neighbors at 441 Valley Drive. They have been told numerous times that there would be no impacts. There is nothing in writing about what this payback district will cost, nor any public hearings. They have a real problem that they are now going to pay because a developer didn't want to pay what he was required to do. They can't continually get hit by unlimited paybacks. 2:13:47 Martie Stewart - Public Comment Ms. Stewart, of 3303 Bitterroot Way, is also a part of the Valley Drive subdivision and concurs with Deb. She said for the Babcock payback district they couldn't pay upfront so they are being charged interest until they are pulled into the City. Will this happen with this payback, or do they have the chance to pay upfront? 2:14:46 Carrie Swenson - Public Comment Ms. Swenson, of 4969 Durston Road, is also representing her family at 4959 Durston Road. This notice is the first time they have heard of this sewer line and that they might be responsible for payback. They're angry it's been in the works for 2-3 years and are concerned about costs. She doesn't think there is enough information to pass tonight. 2:16:14 Jeff Strong - Public Comment Mr. Strong, of 7980 Balsam Drive, questioned why there would be a payback fee assessed at the time of a site plan or a subdivision review or application. An appropriate time to trigger a payback is when someone actually connects and uses capacity. He is asking that only properties that are not in the City be in the payback. Rupp stated that the areas deserving of public scrutiny are traffic flow on the intersection of Kagy and Greek Way and neighborhood participation allowing them to comment. Alternative Energy Systems Presentation (Knight) 3:06:47 Martin Knight, Assistant Planner Mr. Knight presented his research about how other communities are addressing alternative energy and using wind and solar energy. 3:20:57 Mayor Jacobson Mayor Jacobson wants to move forward to begin to develop standards for vertical turbines. 3:26:28 Cr. Krauss Cr. Krauss wants to remove regulatory barriers to solar cell installation, as well as take steps to protect solar cell installations to make sure no one can block out the sun. 3:29:00 Cr. Bryson Cr. Bryson would like to see vertical access turbines on the ugly lights on 19th. 3:29:35 Cr. Rupp Cr. Rupp wants to spread our vision around to VT, a state that is saying that all energy for new development must come from alternative sources. Mayor Jacobson opened public comment. 3:32:35 James Donaldson - Public Comment Mr. Donaldson, who is homeless in Bozeman, stated that he may be considered a genius on renewable energy. He suggested that bent turbines on roofs can create energy in smaller quantities and go to LED lights. He discussed getting solar energy from mirrors to create steam generators. (Re)Appointments to the Cemetery Advisory Board (Delaney) 3:41:06 Mayor Jacobson Mayor Jacobson stated that according to the ordinance we cannot reappoint Russ Tuckerman tonight since he isn't a City resident, and there must be more City residents than non-City residents on the board. 3:42:03 Motion that we reappoint Katherine Ball and Betsy Fordyce to the Cemetery Advisory Board. Selection of Commissioner Liaisons to Boards and Appointment of Commissioner Voting Members to Boards (Delaney) 3:45:06 Mayor Jacobson Mayor Jacobson said they only need to vote for boards that need voting members. For liaisons they only need to vote when there is a conflict. They still need voting members for the Local Water Quality District Board, the Prospera Business Network Revolving Loan Fund Committee, and the Transportation Coordinating Committee. 3:46:44 Ms. Delaney Ms. Delaney stated they need also need voting members for the Audit Committee (two voting members) and the Public Transit Stakeholders Advisory Board. 3:47:08 Motion and Vote to appoint Mayor Jacobson to the Local Water Quality District.
