SUBJECT: Final Adoption of Ordinance No. 1702, Baxter Meadows Planned Unit
Development Zone Map Amendment #Z-07011
MEETING DATE: Monday, April 14, 2008
RECOMMENDATION: The City Commission finally adopt Ordinance No. 1702.
BACKGROUND: The Commission preliminarily approved the rezoning on March 19, 2007.
Ordinance No. 1702 is the implementing ordinance for the ZMA. The Commission gave
preliminary approval to the ordinance on April 2, 2007 (provisionally adopted on Consent).
However, this ordinance was never finally adopted.
UNRESOLVED ISSUES: None.
FISCAL EFFECTS: None
ALTERNATIVES: As suggested by the City Commission.

ORDINANCE NO. 1702
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
BOZEMAN, MONTANA, AMENDING THE CITY OF BOZEMAN
ZONE MAP FOR A MUNICIPAL ZONING DESIGNATION OF "R-3"
(RESIDENTIAL MEDIUM DENSITY DISTRICT) AND “PLI”
(PUBLIC LANDS AND INSTITUTIONS) ON 154.883 ACRES
LOCATED NORTHEAST QUARTER IN SECTIONS 3, T2S, R5E,
GALLATIN COUNTY, MONTANA.
WHEREAS, the proposed zone map amendment to grant a zoning designation of “R-
3", Residential Medium Density District and “PLI” Public Lands and Institutions District, has
been properly submitted, reviewed and advertised; and
WHEREAS, after proper notice the Bozeman Zoning Commission held a public
hearing on February 21, 2007, to receive and review all written and oral testimony on the request
for a zone map amendment; and
WHEREAS, the Bozeman Zoning Commission recommended to the Bozeman City
Commission that the zone map amendment be approved; and
WHEREAS, after proper notice, the City Commission held its public hearing on
March 19, 2007, to receive and review all written and oral testimony on the request for a zone
map amendment; and
WHEREAS, the City Commission has reviewed and considered the twelve zone
change criteria established in Section 76-2-304, M.C.A., and found the proposed zone map
amendment to be in compliance with the twelve criteria; and
WHEREAS, at its meeting held on March 19, 2007, the City Commission found that
the proposed zone map amendment would be in compliance with the City of Bozeman Growth
Policy and would be in the public interest.
NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of
Bozeman, Montana:

Section 1
That the zoning district designation of the following-described property is hereby
designated as "R-3" (Residential Medium Density District):
A parcel of land, said parcel being a portion of Tract 3A-1, and a portion of Tract 4A-1 of
Certificate of Survey No. 2202B, and a portion of Baxter Lane as dedicated on the Final Plat of
Baxter Meadows Phase 2A, said parcel being located in the Northeast Quarter of Section 3,
Township 2 South, Range 5 East, Principal Meridian Montana, City of Bozeman, Gallatin
County, Montana and said parcel being further described as follows:
Beginning at the northeast corner of said Section 3; thence South 01°33'52" West, on the east
line of Section 3, a distance of 1590.56 feet; thence North 90°00'00" West, on the centerline of
the Vaquero Parkway Street Easement recorded in Doc. No. 2258764, a distance of 330.48 feet;
thence on said centerline through a curve to the right with a radius of 1237.50 feet, a central
angle of 46°10'08", and an arc length of 997.18 feet to an easterly extension of the south line of
Tract 4A-1 of Certificate of Survey No. 2202B; thence on a non-tangent course of North
90°00'00" West, on said extension and on said south line, a distance of 424.95 feet; thence the
following 3 courses on the westerly line of said Tract 4A-1:
North 33°25'38" West, a distance of 440.25 feet;
North 01°32'52" West, a distance of 350.93 feet;
North 44°41'57" East, a distance of 219.42 feet;
thence North 90°00'00" East, on the north line of said tract a distance of 177.82 feet to the
centerline of Vaquero Parkway; thence North 00°00'00" East, on said centerline and its northerly
extension, a distance of 326.83 feet to the north line of Section 3, said line being the centerline of
the Baxter Lane Street and Utility Easement recorded in Doc. 2103143 (Exhibit E); thence North
89°41'58" East, on said line, a distance of 1611.42 feet to the Point of Beginning.
The described zoning parcel has an area of 57.690 acres, more or less and is along with and
subject to any existing easements.
Section 2
That the zoning district designation of the following-described property is hereby
designated as "PLI" (Public Lands and Institutions District):
A parcel of land, said parcel being a portion of Tract 3A-1, of Certificate of Survey No. 2202B,
and a portion of Baxter Lane as dedicated on the Final Plat of Baxter Meadows Phase 2A, said
parcel being located in the Northeast Quarter of Section 3, Township 2 South, Range 5 East,
Principal Meridian Montana, City of Bozeman, Gallatin County, Montana and said parcel being
further described as follows:
Beginning at the east quarter corner of said Section 3; thence North 89°52'48" West, on the south
line of Tract 3A-1 of Certificate of Survey No. 2202B, a distance of 2636.23 feet; thence North

01°12'12" East, on the west line of said tract, a distance of 2315.10 feet; thence North 89°41'56"
East, on the south line of the Final Plat of Baxter Meadows Subdivision P.U.D. Phase 1, as
amended, a distance of 800.30 feet; thence North 01°12'45" East, along said plat, as amended, a
distance of 325.15 feet to the north line of Section 3, said section line being the centerline of
Baxter Lane; thence North 89°41'58" East, along said line, a distance of 241.65 feet to the
northerly extension of the centerline of the Vaquero Parkway Street Easement recorded in Doc.
No. 2258764; thence South 00°00'00" East, on said extension and said centerline, a distance of
326.83 feet to the north line of Tract 4A-1 of Certificate of Survey No. 2202B; thence North
90°00'00" West, on said line, a distance of 177.82 feet; thence the following 3 courses on the
westerly line of said Tract 4A-1:
South 44°41'57" West, a distance of 219.42 feet;
South 01°32'52" East, a distance of 350.93 feet;
South 33°25'38" East, a distance of 440.25 feet;
thence North 90°00'00" East, on the south line of said tract and on its easterly extension, a
distance of 424.95 feet to the said centerline of Vaquero Parkway; thence on said centerline
through a non-tangent curve to the left with a radius of 1237.50 feet, a central angle of
46°10'08", an arc length of 997.18 feet, and a chord which bears South 66°54’56” East for
970.42 feet; thence North 90°00'00" East, on said centerline and on its easterly extension, a
distance of 330.48 feet to the east line of Section 3; thence South 01°33'52" West, along said
section line, a distance of 1069.55 feet to the Point of Beginning,
The described zoning parcel has an area of 97.193 acres, more or less and is along with and
subject to any existing easements.
Section 3
The effective date is thirty days after final adoption of this ordinance on second reading.
PASSED by the City Commission of the City of Bozeman, Montana, on first reading, at
a regular session thereof held on the 2nd day of April 2007.
