HomeMy WebLinkAboutApprove Reclaiming Review Authority for the South Commission Memorandum TO: Honorable Mayor and City Commission FROM: Allyson Bristor, Associate Planner SUBJECT: South Church Halfway House CUP - #Z-08070 MEETING DATE: Monday, April 28, 2008 at 6:00 p.m. CONSENT AGENDA RECOMMENDATION: That the Commission consider reclaiming review authority for the South Church Halfway House Conditional Use Permit #Z-08070. BACKGROUND: The property owner Clarice Dreyer, representative ADSGC, and applicant Shelly Johnson, submitted a Conditional Use Permit application for the establishment of a “recovery support home,” for eight male individuals requiring a safe and sober living environment, at the 119 South Church Avenue. The site plan application is scheduled for first- week review by the Development Review Committee on May 7, 2008. The standard review authority for the application is the Planning Director. UNRESOLVED ISSUES: As informally affirmed by the City Commission at the April 21, 2008 regular Commission public meeting, Planning Staff would like to inquire whether the Commission would like to formally reclaim review authority for the site plan application per section 18.64.010 of the Bozeman Municipal Code. This section allows that the Commission may, by an affirmative, simple majority, vote of its members at a regularly scheduled meeting reclaim to itself the final approval of a development normally subject to the approval of the Planning Director. The project would be considered at the June 2, 2008 public meeting. If the Commission chooses not to reclaim the project a staff report will be forwarded to the Planning Director. FISCAL EFFECTS: The Department of Planning is not aware of any fiscal effects for the proposed development at this time. ALTERNATIVES: As suggested by the City Commission.
