SUBJECT: South Towne Square Zoning Variance #Z-08003
MEETING DATE: Monday, May 5, 2008 at 6:00 p.m.
CONSENT AGENDA
RECOMMENDATION: That the Commission consider reclaiming review authority for the
South Towne Square Zoning Variance application #Z-08003.
BACKGROUND: The property owner and applicant, Kailo II Corporation, and representative,
Allied Engineering Services, submitted a level of service zoning variance application. The South
Towne Square site plan development is a commercial condominium property located at the
southeast corner of Kagy Boulevard and South 3rd Avenue. The City Commission reviewed the
application on May 14th, 2007 and recommended approval with 15 conditions of approval for
application #Z-07051. The standard review authority for variance applications is the Board of
Adjustment.
UNRESOLVED ISSUES: Planning Staff would like to inquire whether the Commission would
like to formally reclaim review authority for the site plan application per section 18.64.010 of the
Bozeman Municipal Code. This section allows that the Commission may, by an affirmative,
simple majority, vote of its members at a regularly scheduled meeting reclaim to itself the final
approval of a development normally subject to the approval of the Board of Adjustment. The
project would be considered at the June 2, 2008 public meeting. If the Commission chooses not
to reclaim the project a staff report will be forwarded to the Board of Adjustment for their review
on June 10, 2008.
FISCAL EFFECTS: The Department of Planning is not aware of any fiscal effects for the
proposed development at this time.
ALTERNATIVES: As suggested by the City Commission.
