Kukulski, City Manager SUBJECT: Breaking of the 2-2 Tie Vote on Cr. Becker’s May 5, 2008 Motion "to direct staff to finalize the contract with Comma-Q Architects in the amount of $49,149.00 for a complete Schematic Design Analysis of the Mansion and to authorize the City Manager to sign the contract." MEETING DATE: May 12, 2008 RECOMMENDATION: Cr. Rupp, after reviewing the record (Commission packet, CD, and/or DVD of the May 5 meeting) and stating such, should vote on the motion as transcribed below: Motion: “It was moved by Cr. Becker, seconded by Mayor Jacobson (after handing the gavel to Cr. Krauss), to direct staff to finalize the contract with Comma-Q Architects in the amount of $49,149.00 for a complete Schematic Design Analysis of the Mansion and to authorize the City Manager to sign the contract.” Vote: Those voting Aye being Cr. Becker and Mayor Jacobson. Those voting No being Crs. Bryson and Krauss. Those absent being Cr. Rupp. The vote tied 2-2. BACKGROUND: On May 5, 2008 a motion was made by Cr. Sean Becker related to Agenda item L. 1. [Architectural Contract for the Story Mansion Rehabilitation (Goehrung)] "to direct staff to finalize the contract with Comma-Q Architects in the amount of $49,149.00 for a complete Schematic Design Analysis of the Mansion and to authorize the City Manager to sign the contract." Cr. Jeff Rupp was absent from the proceedings and did not cast a vote at the May 5, 2008 meeting. The vote resulted in a 2-2 tie, and therefore Cr. Rupp should cast a vote on the motion transcribed above. For the sake of additional review by the Commissioners and public, the May 5 Commission packet materials for this item have been included in this week’s packet under Action item 2 [Construction Manager at Risk for the Story Mansion Renovation, Second Part of Architectural Contract for the Story Mansion Rehabilitation (Goehrung), continued from May 5, 2008].
