RECOMMENDATION: The City Commission “continue the public hearing for the Martel
Residence Zone Map Amendment to a date uncertain not to exceed ninety (90) days” until the
applicant’s request to establish a municipal zoning designation has been properly noticed.
BACKGROUND: A Zone Map Amendment application to establish an initial municipal
zoning designation of R-1 (Residential Single Household, Low Density District) on 0.398 acres
located in the general area of 2104 Spring Creek Drive has been submitted for review. The
subject property is contiguous to the City of Bozeman. The Development Review Committee
has reviewed the application and presents the findings and recommended terms of annexation
outlined in the staff report to the Commission.
UNRESOLVED ISSUES: The Zoning Commission held its public hearing on May 20 to
consider the applicant’s request to establish a municipal zoning designation running concurrently
with a request for annexation of the subject property. At the public hearing before the Zoning
Commission it was determined by the Planning Office that information provided in the
applicant’s submittal did not include a complete adjoiner’s list of properties within 200 feet of
the subject property. Finding that the information provided was incorrect, and at the
recommendation of the Planning staff, the Zoning Commission held the public hearing, took
public testimony, and continued the public hearing on the matter until said request for a zone
map amendment with annexation is properly noticed for all adjoiners within 200 feet of the
property.
FISCAL EFFECTS: Fiscal impacts are undetermined at this time, but will include increased
property tax revenues from annexation and municipal zoning of the property, and costs from
additional service demand.
ALTERNATIVES: As suggested by the City Commission.
