HomeMy WebLinkAboutConsent 5 Greek Way Cash in Lieu Total Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Brian Krueger, Associate Planner SUBJECT: Greek Way Apartments Request for Cash in Lieu of Parkland Dedication File No. Z-07270 MEETING DATE: Monday, June 23, 2008 Consent Item RECOMMENDATION: The City Commission accepts staff’s findings and allows cash in lieu of. parkland dedication for the Greek Way Apartments, File No. Z-07270. BACKGROUND: The City Commission granted preliminary approval for an application to construct a 27 dwelling unit (six fourplex units, one duplex unit, and one manager’s dwelling unit) apartment project on 2.6 acres located on Greek Way. The property is zoned R-3, Medium Density Residential. At the time of preliminary approval the applicant did not propose any dedicated parkland on site. During the consideration of the project the Commission gave the applicant informal guidance to proceed with the proposal and return to the Commission at the time of final site plan with a proposal for cash in lieu of parkland dedication for 100% of the required parkland for the project. UNRESOLVED ISSUES: Section 18.50.030 of the Bozeman Municipal Code states that “The City Commission may determine whether the park dedication must be a land dedication, cash donation in-lieu of land dedication or a combination of both.” The City Commission shall consider the following when making this decision 1) the desirability and suitability of land for parks and playgrounds based on size, topography, shape, location or other circumstances; and 2) the expressed preference of the developer. The developer has requested to provide all of the land dedication required, approximately .81 acres, with a cash donation in lieu. Staff supports this request and finds that in order for this project to provide higher density housing in close proximity to the University as envisioned by the Bozeman 2020 Community Plan with the onsite constraints of the areas required for stormwater detention/retention and associated setbacks that cash be accepted in lieu of park land donation. Staff further finds that this is in accordance with the expressed preference of the developer and that the Gallagator Trail, Langhor Park, and Christie Fields are in the immediate vicinity and will provide adequate parkland to support this project. Staff has reviewed the required parkland calculation, the required property appraisal that was submitted to determine the value of the cash in lieu payment and has found them acceptable. FISCAL EFFECTS: Per the attached letter, the anticipated payment for cash in lieu of parkland dedication for .81 acres for this project is $88,165.00.
