SUBJECT: Revised Contract for Law Enforcement Impact Fees
MEETING DATE: Monday, July 14, 2008
RECOMMENDATION: Authorize the City Manager to sign the contract revision.
BACKGROUND: In November 2007, the City Commission authorized a contract to prepare a
study examining a law enforcement impact fee. The original term of the contract was to expire
270 days after contract execution. This is August 20, 2008. The City has been in discussion with
Gallatin County regarding the siting of the expanded police facility. This discussion has taken
longer than expected. The decision on location has a significant effect on the elements included
in the calculation of a potential impact fee. Therefore, it is desirable to extend the contract time
to allow the completion of the discussion with the County and subsequent work by the
contractor.
UNRESOLVED ISSUES: Does the Commission wish to extend the contract time.
FISCAL EFFECTS: None. The contract has already been funded in a prior fiscal year. The
change in time does not impact the contract amount.
ALTERNATIVES: As suggested by the City Commission.

Contract Amendment Number 1
The City of Bozeman, P.O. Box 1230, Bozeman, MT (“City”) and Tindale-Oliver &
Associates, 1595 S. Semoran Blvd., Building 7, Suite 1540, Winter Park, FL 32792
(“Consultant), collectively the (“Parties”) entered into a contract dated November 20,
2007 for the Consultant to furnish specific services of a professional planning and
financial nature (the “Contract”)
WHEREAS, the Contract contained a time limit within which the work was to be
performed; and
WHEREAS, due to factors beyond both parties control additional time is needed to
complete data gathering and prepare the study called for in the Contract; and
WHEREAS, the Parties agree that the time of the contract should be extended; and
WHEREAS, Articles 1, 2, 5 and 13 of the Contract allow for revision upon mutual
written agreement of the parties;
NOW THEREFORE, in consideration of the mutual covenants and agreements contained
herein, the Parties agree Article 1 shall be amended as follows:
Article 1. CONTRACT TIME.
The Work will be completed within 270 calendar days after the date of this agreement by
August 20, 2009. The total time may be adjusted at the mutual written agreement of both
City and Consultant.
