Those present were Mayor Kaaren Jacobson, Cr. Jeff Krauss, Cr. Sean Becker, Cr. Eric Bryson, City Manager Chris Kukulski, Deputy City Manager Ron Brey, City Attorney Paul Luwe, Assistant City Attorney Tim Cooper, and Deputy City Clerk Cynthia Jordan Delaney. 0:00:23 A. Call to Order - Executive Session - 6 p.m. - Community Room, Gallatin County Courthouse, 311 West Main Street Mayor Jacobson called the Executive Session to order at 6 p.m. and declared this portion of the meeting closed to the public to discuss litigation strategy. 0:00:26 B. Executive Session - 6 p.m.-7 p.m. - Litigation Strategy This Executive Session was not recorded, and no written minutes were taken. Those present were Mayor Kaaren Jacobson, Cr. Jeff Krauss, Cr. Sean Becker, Cr. Eric Bryson, City Manager Chris Kukulski, Deputy City Manager Ron Brey, City Attorney Paul Luwe, Planning Director Andy Epple, and Deputy City Clerk Cynthia Jordan Delaney. 0:13:32 C. Call to Order - Regular Meeting - 7 p.m. - Community Room, Gallatin County Courthouse, 311 West Main Street Mayor Jacobson called the Regular Meeting to order at 7:00 p.m. 0:13:34 D. Pledge of Allegiance and a Moment of Silence 0:14:14 Changes to the Agenda - Chris Kukulski, City Manager Mr. Kukulski stated that he is not aware of any changes to the agenda. 0:14:20 E. Authorize the Absence of Cr. Rupp 0:14:20 Motion and Vote to authorize Cr. Rupp's absence. It was moved by Cr. Becker, seconded by Cr. Bryson, to authorize Cr. Rupp's absence. Those voting Aye being Crs. Becker, Bryson, Krauss, and Mayor Jacobson. Those voting No being none. Those absent being Cr. Rupp. Bozeman City Commission Meeting, May 5, 2008 The motion carried 4-0. 0:14:36 F. Public Service Announcement - Story Mansion Grounds Reservations (Dingman) 0:14:48 Ron Dingman, Director of Parks and Recreation Mr. Dingman notified the public that the Story Mansion grounds are available for reservation for group activities. The reservation form and permits can be picked up at the City Shops Complex. 0:17:48 G. Minutes - April 9, 2008 Policy Meeting and April 14, 2008 0:17:54 Motion and Vote to approve the Minutes from April 9, 2008 Policy Meeting and April 14, 2008. It was moved by Cr. Bryson, seconded by Cr. Krauss, to approve the Minutes from April 9, 2008 Policy Meeting and April 14, 2008. Those voting Aye being Crs. Bryson, Krauss, Becker, and Mayor Jacobson. Those voting No being none. Those absent being Cr. Rupp. The motion carried 4-0. 0:18:13 H. Consent 1. Authorize Payment of Claims (LaMeres) 2. Public Comment 2    Bozeman City Commission Meeting, May 5, 2008 Mayor Jacobson opened public comment. 0:19:20 Pat Martin - Public Comment Mr. Martin, of 2771 Deer Creek Drive, is here on behalf of the Community Mediation Center to invite the Commission to attend the annual Peacemaker event this Thursday from 6-8 p.m. at the Museum of the Rockies. 0:20:19 Chelsea Murphy - Public Comment Ms. Murphy is the new director of the Gallatin Valley Food Bank. She encouraged the public to participate in the National Letter Carriers' Food Drive on Saturday morning. 0:21:12 Public Comment closed. Mayor Jacobson closed public comment. 0:21:18 J. Mayoral Proclamation 0:21:24 2. Municipal Clerks’ Week (Mayor Jacobson) Mayor Jacobson read the Municipal Clerks' Week Proclamation. 0:23:35 1. Arthritis Awareness Month (Mayor Jacobson) Mayor Jacobson read the Arthritis Awareness Month Proclamation. 0:25:58 K. Special Presentation - Police/Court Master Plan Study (Jeff Sandholm, Dowling Sandholm Architects) 0:26:17 Jeff Sandholm, Dowling Sandholm Architects Mr. Sandholm stated that Chris Kukulski asked Dowling Sandholm to look at the police station and see if it would be sized appropriately to fit on the current Law and Justice Center site. He showed schematic diagrams of with room for expansion and believes these facilities can fit on this campus. 0:44:11 Public Comment Mayor Jacobson opened it up for public question or comment on this presentation. Architectural Contract for the Story Mansion Rehabilitation (Goehrung) 0:45:01 James Goehrung, Director of Facility Services Mr. Goehrung presented the staff report and referenced the memo and attachment in the packet. 0:46:31 Public Comment opened. Mayor Jacobson opened public comment. 0:46:55 Jane Klockman - Public Comment 3    Bozeman City Commission Meeting, May 5, 2008 Ms. Klockman, of 713 South Willson, stated that she is solidly in favor of using the property as a municipal gathering place for many types of events. She urged the Commission to back the plan that is now in place and rally around the project. 0:48:11 Steve Kirchhoff - Public Comment Mr. Kirchhoff, of 516 South 6th Avenue, is here to encourage the Commission to do whatever step tonight to keep the vision of the Story Mansion as a community center alive. The Story Mansion will pay off huge dividends from a realistic standpoint and make Bozeman the kind of place we cherish. 0:51:46 Bob Chase - Public Comment Mr. Chase, of South Black Avenue, referenced a Tributary article on historic preservation, and he mentioned tax fatigue. He signed an online petition to have the Story Mansion returned to a single family dwelling. Tax expenditures that go beyond the responsibility of government should be put on a ballot, and he asked the Commission not to vote in favor of this expenditure. 0:54:37 Victor Hanson - Public Comment Mr. Hanson, of 2735 Harris Street, seconded Mr. Chase’s comments and said this should be brought up to a ballot. He doesn't feel that a city that has needs in water, fire, etc., should be spending three million dollars or more to renovate this place. He wants to see his tax bill stay the same and not go up. 0:55:22 Rick Klein - Public Comment Mr. Klein, of Bozeman, stated that last week a Chamber of Commerce poll showed that 68% are not in favor of keeping the Story Mansion. He agrees that if you are going to spend taxpayer dollars, it should be to a vote of the public, or else we will start an initiative. The PROST Plan has already proposed another community center, and private owners would accept restrictions. 0:57:15 Chris Nixon - Public Comment Mr. Nixon, 719 North Wallace Avenue, stated that from day one he wanted to get the mansion in public hands. This step of $2.5-3 million seems like a huge amount of taxpayer money. With community input and volunteers, we could do something short-term to get crowds of 150 in there and then see the demand before making major structural changes. 1:00:23 Public Comment closed. Mayor Jacobson closed public comment. 1:07:24 Mayor Jacobson Mayor Jacobson clarified that we are not making a commitment to spend $2.5 million. We are talking about spending money for the schematic design that would begin the spending of the Save America's Treasures Grant. If we don't start to spend those funds, we lose them. 1:09:43 Cr. Bryson Cr. Bryson stated that his concern with this proposal of the $49,100 is that it starts us spending the SAT Grant and obligates us with significant strings attached. 4    Bozeman City Commission Meeting, May 5, 2008 1:12:18 Cr. Becker Cr. Becker stated that if we decide to engage the SAT Grant, this money will hammer out the exact cost of the project and will enable us to capture the $500,000 grant. This is not an authorization to spend any more than $49,000 (or the $24,500 from the City). 1:14:57 Motion to direct staff to finalize the contract with Comma-Q Architects in the amount of $49,149.00 for a complete Schematic Design Analysis of the Mansion and to authorize the City Manager to sign the contract. It was moved by Cr. Krauss. It was moved by Cr. Becker, seconded by Mayor Jacobson (after handing the gavel to Cr. Rupp. The vote tied 2-2. 1:15:52 Mayor Jacobson Mayor Jacobson stated that Cr. Rupp will break the tie next Monday night (May 12, 2008). 1:16:39 Mayor Jacobson Mayor Jacobson agreed to put the second part/motion of this Action item on the agenda for next week: "Consider a motion directing staff to advertise for a General Contractor/Construction Manager and select a firm to assist the Architect in developing detailed cost estimates for the rehabilitation of the Story Mansion." 1:17:16 M. Reminder of the Joint City-Town/County Meeting on Friday, May 9, 2008 at 12 p.m. in Three Forks (Kukulski/Delaney) 1:17:57 2. Discuss Cancelling the City Commission Meeting on Tuesday, May 27, 2008 and the Policy Meeting on Wednesday, May 28, 2008 (Kukulski) 1:18:10 Mr. Kukulski Mr. Kukulski suggested cancelling the May 27 City Commission Meeting. 1:18:54 Andy Epple, Planning Director Mr. Epple mentioned that the Mill District Project is proposing to downsize the project a little bit, and he will deal with it administratively unless the Commission wants to look at it. There is an intensive training being scheduled for the new Board of Adjustment. 1:20:43 Cynthia Jordan Delaney, Deputy City Clerk Ms. Delaney read the May 28 Policy Meeting topic: "UDO Revisions related to Off-site Road Improvements and Infill Development (Epple)." 1:20:59 Cr. Krauss, Cr. Bryson, and Mayor Jacobson Cr. Krauss, Cr. Bryson, and Mayor Jacobson agreed that this is big issue that we want to expedite so the Policy Meeting should stay scheduled. 1:21:27 Crs. Krauss and Becker Crs. Krauss and Becker agreed to not have an evening meeting. 1:22:11 Mr. Kukulski Mr. Kukulski verified that there will only be a Policy Meeting that week and not an evening meeting. 1:22:34 Mayor Jacobson Mayor Jacobson stated that Bozeman was chosen as one of eight cities to attend the Mayor's Institute for Urban Design, and she will be going to Portland later this week. 1:24:22 Cr. Bryson Cr. Bryson stated that he will be out of town later this week, and hopes that one of the Commissioners can facilitate the discussion at the Joint Meeting on Friday about the representation on the Board of Health. 1:24:39 Cr. Becker Cr. Becker stated that he will be at that meeting on Friday. 1:25:01 N.
