RECOMMENDATION: The City Commission accepts the cash-in-lieu of parkland dedication
request for Bronze Leaf Condominiums.
BACKGROUND: The Bronze Leaf Condominium Site Plan application with related site
improvements on 5.61 acres was approved as a 96-unit condominium development on May 26,
2006. The development is located at the southeast corner of Durston and Cottonwood Roads and
is legally known as Tract 1, C.O.S. 985, NW ¼ Section 10, T2S, R5E City of Bozeman, Gallatin
County, Montana. The applicant recently requested a modification to the approved final site plan
reducing the number of dwelling units to 92. During the review for the modification, staff
noticed the Commission had yet to be informed of the applicant’s request to provide cash-in-lieu
of parkland. Pursuant to UDO Section 18.50 (Park & Recreation Requirements), parkland
dedication, or cash-in-lieu of, is required for all residential development. The applicant has
requested to provide cash-in-lieu of parkland for the 2.76 acres of parkland that would be
required for this development. Using the appraisal the applicant submitted with this request, this
cash-in-lieu contribution amounts to $262,032.
Given the site’s close proximity to Broken Park and the park in Valley West Subdivision, the
applicant chose to request cash-in-lieu of parkland dedication.
On June 13th, 2008, staff presented the cash-in-lieu of parkland dedication proposal to the
R&PAB Subdivision Review Committee.
UNRESOLVED ISSUES: The Department of Planning is not aware of any unresolved issues
for the proposed development at this time.
FISCAL EFFECTS: A substantial addition to the parkland cash-in-lieu fund.
ALTERNATIVES: Alternatives as suggested by the City Commission.
