HomeMy WebLinkAboutGreek Way Apartments Zoning Variance Commission Memorandum TO: Honorable Mayor and City Commission FROM: Brian Krueger, Associate Planner SUBJECT: Greek Way Apartments Zoning Variance #C-08004 MEETING DATE: Monday, July 21, 2008 at 6:00 p.m. CONSENT AGENDA RECOMMENDATION: That the Commission consider reclaiming review authority for the Greek Way Apartments Zoning Variance application #C-08004. BACKGROUND: The property owner and applicant, SAAM Real Estate, Inc., and representative, Thomas, Dean & Hoskins, Inc., submitted a level of service zoning variance application related to the Greek Way Apartments Site Plan project #Z-07270. The Greek Way Apartments site plan project is a 27 dwelling unit residential apartment project property located at the northwest corner of Kagy Boulevard and Greek Way. The City Commission reviewed the site plan application on March 17, 2008 and conditionally approved the project with 12 conditions of approval. The standard review authority for variance applications is the Board of Adjustment. The Greek Way Apartments variance request is the same variance request submitted by the owners of South Towne Square that was recently approved by the Commission. This request is regarding the same issue: the level of service requirements for the intersection of South 7th Avenue and Kagy Boulevard. UNRESOLVED ISSUES: Planning Staff would like to inquire whether the Commission would like to formally reclaim review authority for the variance application per section 18.64.010.C.1 of the Bozeman Municipal Code. This section allows that the Commission may, by an affirmative, simple majority, vote of its members at a regularly scheduled meeting reclaim to itself the final approval of a request normally subject to the approval of the Board of Adjustment. The project would be considered at the August 18, 2008 Commission meeting. If the Commission chooses not to reclaim the project, a staff report will be forwarded to the Board of Adjustment for their review on August 12, 2008. FISCAL EFFECTS: The Department of Planning is not aware of any fiscal effects for the proposed development at this time. ALTERNATIVES: As suggested by the City Commission.
