BACKGROUND: The applicant is proposing to amend the City of Bozeman Zone Map for the zoning classification of approximately 2.59 acres from R-O (Residential Office District) to R-3 (Residential Medium Density District) and for approximately 4.97 acres from R-3 to R-O for property located west of Highland Boulevard on the north side of the Knolls at Hillcrest Subdivision. This application brings the zoning into compliance with the adopted Bozeman Deaconess Health Service Subarea Plan and matches the zoning boundaries to the established street and lot lines. At their July 15, 2008 public hearing the City of Bozeman Zoning Commission voted 4 in favor and 0 against to recommend approval of this application as proposed. Nick Lieb noted he had emailed his absence and asked for an excused absence rather than an unexcused absence. Seeing there were no other changes or additions to the minutes, Chairperson Pomnichowski approved the minutes of July 1, 2008 as submitted. ITEM 4. PROJECT REVIEW 1. Zone Map Amendment Application #Z-08119 – (Knolls at Hillcrest) A Zone Map Amendment requested by the owner and applicant, Bozeman Deaconess Real Estate Development Co., and representative, PC Development, requesting to amend the City of Bozeman Zone Map on approximately 2.59 acres from R-O (Residential Office District) to R-3 (Residential Medium Density District) and approximately 4.97 acres from R-3 to R-O for a total change on approximately 7.56 acres for property legally described as the south portion of COS 2047, The 145 Zoning Commission Minutes from July 15, 2008 Page 2 Knolls at Hillcrest Subdivision, located in the E ½ of Section 18, T2S, R6E, P.M.M., City of Bozeman, Gallatin County, Montana. Staff Presentation: Doug Riley, Associate Planner, presented the staff report for the Knolls at Hillcrest zone map amendment. He noted the proposal was to change the zoning designation on 2.59 acres from R-O to R-3 and 4.97 acres from R-3 to R-O for a total change of 7.56 acres. He noted the application was to bring the property into compliance with the Bozeman Deaconess Hospital Subdivision subarea plan and to match the zoning to established street and lot lines. He noted the changes were in compliance with the Growth Policy and the underlying designation. No public comment had been received to date. He noted Staff is recommending approval with the contingencies listed in the staff report. Questions for Staff: Chairperson Pomnichowski sought clarification on the need to amend the subarea plan. Planner Riley responded the zone map amendment was an implementation of the subarea plan. Chairperson Pomnichowski sought clarification if the zone map amendment would be in compliance with the map as well as with the growth policy. Planner Riley responded the zone map amendment would be in compliance with the subarea plan and the growth policy. Chairperson Pomnichowski sought clarification on the impacts of the change on the zoning inventory for the project. Planner Riley responded it was in compliance with the zoning inventory. Applicant Presentation: Cheryl Ridgley stated the zone map amendment was to align the zoning with the actual lot and plat lines and to bring it into compliance with the subarea plan. Questions for Applicant: There were no questions for the applicant. Public Comment: Seeing no public comment, Chairperson Pomnichowski closed the public comment period. Discussion: Peter Harned stated that the application met the original plan, and that he felt it met the 12 criteria. Mr. Lieb sought clarification on why the current zoning had been implemented. Planner Riley 146 Zoning Commission Minutes from July 15, 2008 Page 3 noted the property had been reviewed as a PUD and lot boundaries and streets had not been created when the current zoning was adopted. Mr. Lieb noted the R-O district was oddly shaped. Planner Riley responded the zoning change allowed for the appropriate zoning and related uses for the different parcels. Motion and Vote: It was moved by Mr. Vaughan, seconded by Mr. Harned, to recommend approval of the Zone Map Amendment Application #Z-08119 the Knolls at Hillcrest with the contingencies listed in the staff report. Mr. Vaughan stated he felt it met the 12 criteria and was a logical change. He stated he was going to vote in favor of the application. Chairperson Pomnichowski noted even though the change looked logical it still needed to meet the 12 criteria. She noted that the block map is supposed to be general and the zoning more specific. She noted that the current zoning is very general and she hopes the change stays true to the previous informal plan and plat. She noted one of the 12 criteria was to keep the character of the district which she felt was a stretch between the different uses between the R-3 and R-O districts. Those voting Aye being Mr. Vaughan, Mr. Harned, Mr. Lieb, and Chairperson Pomnichowski. Those voting No being none. The motion carried 4-0. Chairperson Pomnichowski noted the City Commission would review the project on August 4, 2008. ITEM 5. NEW BUSINESS Mr. Vaughan noted he would not be at the August 5, 2008 meeting. Seeing no other new business before the board, Chairperson Pomnichowski closed this portion of the meeting and moved to adjourn the meeting. ITEM 6. Report By: Doug Riley, Associate Planner Recommendation: Approval with contingencies PROJECT LOCATION & MAP The subject property contains a total of approximately 7.56 acres and is located on the north side of the newly developed Knolls at Hillcrest Subdivision west of Highland Boulevard. The property is legally described as the south portion of COS 2047, The Knolls at Hillcrest Subdivision, located in the E 1/2 of Sec. 18, T.2S/R6E, P.M.M., CITY OF BOZEMAN, GALLATIN COUNTY, MONTANA. The subject property is located within the Bozeman Deaconess Health Services Planning Subarea. Please refer to the following vicinity map. 148 PROPOSAL AND BACKGROUND INFORMATION The property owner/applicant, Bozeman Deaconess Real Estate Development Company, proposes to amend the zoning designations on the approximately 7.56 acre subject property from R-O (Residential Office District) to R-3 (Residential Medium Density District) [approx. 2.59 ac.] and from R-3 to R-O [approx. 4.97 ac]. The purpose of the zone map amendment request is to adjust the zoning boundaries to match the recently developed subdivision road and lot lines and to designate the zoning in accordance with the adopted Bozeman Deaconess Health Services Subarea Plan (see attached copy of the Subarea Plan). ZONING DESIGNATION & LAND USES The applicants propose a zone map amendment to essentially swap some R-O zoning for R-3 zoning and vice versa. The intent of the R-0 (Residential Office District) is to provide for and encourage the development of multi-household and apartment development and compatible professional offices and businesses that would blend well with adjacent uses. The primary use of a lot, as measured by building area, permitted in the R-O district is determined by the underlying growth policy land use designation. Where the district lies over a residential growth policy designation the primary use shall be non-office uses; where the district lies over a non-residential designation the primary use shall be office and other non- residential uses. Primary use shall be measured by percentage of building floor area. The intent of the R-3 (Residential Medium Density District) is to provide for the development of one- to five-household residential structures near service facilities within the City. It should provide for a variety of housing types to serve the varied needs of households of different size, age and character, while reducing the adverse effect of non-residential uses. The following land uses and zoning are adjacent to the subject property: The Knolls at Hillcrest Zone Map Amendment Staff Report, #Z-08119 2 149 North: Hillcrest Retirement Community; zoned R-O South: The Knolls at Hillcrest Subdivision; zoned R-3 East: Across Highland Boulevard: Bozeman Deaconess Health Services, currently vacant and/or used for agriculture; undergoing Preliminary Plat Review; zoned R-1 The intent of the R-1 (Residential Single-household, Low Density District) is to provide for single- household residential development and related uses within the City at urban densities, and to provide for such community facilities and services as will serve the area’s residents while respecting the residential character and quality of the area. West: Burke Park; zoned R-1 GROWTH POLICY DESIGNATION The area that is subject to this application is part of the Bozeman Deaconess Health Services Subarea Plan which was adopted by the City in 2006. This zone map amendment request would closely match and implement the approved land use designations and densities as shown on the adopted sub-area plan (copy of plan attached) for the “Hillcrest West Neighborhood” (The Knolls at Hillcrest Subdivision), and the “Contiguous Hillcrest Expansion” area. The Subarea Plan discussed the need for such rezoning request(s) in order to implement the plan. The expansion of the “Contiguous Hillcrest Expansion” area is addressed in the plan as follows: (p. 4-1) Contiguous Hillcrest Area: Area reserved for the future expansion of the Hillcrest/Aspen Pointe assisted living campus. Uses include multi-unit building residential assisted living condominiums, detached single household homes, and all necessary related support functions. Surface, sub-surface, or above grade parking is also envisioned. All development in this designation will continue to be subject to the design guidelines described in “Condition 21.” The following growth policy designations are adjacent to the subject property: North: Existing Hillcrest Facility: Part of the adopted Bozeman Deaconess Health Services Subarea Plan. Again, see attached Bozeman Deaconess Health Services Adopted Subarea Plan. South: Hillcrest West Neighborhood (The Knolls at Hillcrest Subdivision): Part of the adopted Bozeman Deaconess Health Services Subarea Plan. East: Across Highland Boulevard: Bozeman Deaconess Health Services: Part of the adopted Bozeman Deaconess Health Services Subarea Plan (Designated as the “Hillcrest East Neighborhood”). West: Burke Park; designated as “Parks, Open Space and Recreational Lands” on the 2020 Plan. REVIEW CRITERIA & FINDINGS According to Section 18.70.020 of the Unified Development Ordinance (UDO), the Bozeman Zoning The Knolls at Hillcrest Zone Map Amendment Staff Report, #Z-08119 3 150 Commission shall cause to be made an investigation of facts bearing on each zone map amendment application. The Zoning Commission must provide necessary information to assure that the action of each zone map amendment application is consistent with the intent and purpose of the UDO. Specifically, the investigation must address the following criteria as required in Section 76-02-304, Montana Code Annotated: A. Consistency with the City’s growth policy As previously noted, this zone map amendment request is in accordance with the adopted Bozeman Deaconess Health Services Subarea Plan which was adopted in 2006 and became part of the City’s official growth policy. Any future development of the subject property will be further evaluated for compliance with the adopted subarea plan during the appropriate subdivision or site plan review process. B. Lessening of congestion in the streets This property is primarily serviced by Highland Boulevard which is designated as a minor arterial in the Greater Bozeman Area Transportation Plan 2001 Update. Highland Boulevard was recently upgraded as part of the Knolls at Hillcrest Subdivision Development. Increased traffic will occur upon additional development on the R-O portion of the property (i.e. Contiguous Hillcrest Expansion Area); however, street improvements have already occurred to accommodate additional traffic flows as anticipated in the adopted Subarea plan. In addition, the DRC will identify the impacts to the area’s transportation network system and determine appropriate mitigation measures as part of any future development review process. C. Securing safety from fire, panic, and other dangers The regulatory provisions established in all of the proposed zoning designations, in conjunction with provisions for adequate transportation facilities, will address safety concerns with any further subdivision and/or development of the property. Any new structures and development on the subject property would be required to meet the minimum zoning requirements for setbacks, lot coverage, height limitations, and lot sizes. D. Promotion of health and the general welfare The proposed zoning designations for the property are a reflection of the adopted Bozeman Deaconess Health Services Subarea Plan which has the purpose of planning and promoting the public health and general welfare. In addition, the standards of development, and accompanying development review processes or building permit applications, will adequately address the issues of health and general welfare for any particular zoning designation. E. Provision of adequate light and air The regulatory standards set forth in the UDO for all of the proposed zoning districts will provide the necessary provisions (i.e., yard setbacks, lot coverage, open space and building heights), which are intended to provide for adequate light and air for any development on the subject property. F. Prevention of the overcrowding of land The UDO limits the number of people living in a household to a maximum of four unrelated people (see definition of “household” in Section 18.80.1390). Minimum yard setbacks, height The Knolls at Hillcrest Zone Map Amendment Staff Report, #Z-08119 4 151 requirements, maximum lot coverage, and required parking are also limiting factors that help prevent the overcrowding of land. G. Avoiding undue concentration of population Compliance with the regulatory standards set forth in the UDO and the International Building Code will aid in providing adequately sized dwelling units to avoid any undue concentration of population. According to the census information for the City of Bozeman the average household size has been declining from 5.74 in 1930 to 2.48 in 2000. This historical trend is likely to continue and would indicate that the undue concentration of population is not an issue with any zoning designation. H. Facilitating the adequate provision of transportation, water, sewerage, schools, parks, and other public requirements The Bozeman 2020 Community Plan identifies this property as lying within the “Capital Facilities Overlay District” (Figure 6-2). The “Capital Facilities Overlay District” is intended to establish a priority area for development within the larger scope of the Bozeman 2020 Community Plan future land use plan. This is an area within the long-range growth area of the City where services would be most efficiently provided in the near term and where development in the near term would advance the goals of the 2020 Plan. Significant upgrades to the public infrastructure for this immediate area were completed as part of the Knolls at Hillcrest Subdivision development. Further assessment of the impacts to infrastructure, public services, schools, parkland, and other community requirements will be completed as development applications for the property are submitted. I. Reasonable consideration to the character of the district Again, the proposed zoning designations are in accordance with the adopted Subarea Plan for this property which took into account the character of the area in designating future land uses and densities. Overall, the proposed zoning designations match the existing development (Knolls at Hillcrest Subdivision which is R-3) or allow for the expansion of the Hillcrest Development to the south (i.e. the R-O portion). The design of future development on the R-O portion will be subject to the design guidelines described in “Condition 21” which is an agreement that was reached with the Recreation and Parks Advisory Board relating to design guidelines required for the hospital facility and future improvements regarding view sheds and ridgeline setbacks for development west of Highland Boulevard. J. Reasonable consideration to the peculiar suitability of the property for particular uses As previously noted, the adopted Subarea Plan supports the proposed zoning designations and development of the subject property. This application will match the zoning to roads, lot lines and established property development patterns. K. Conserving the value of buildings There are no existing buildings on the subject property. Encouraging the most appropriate use of land throughout the municipality Again, the zoning proposed is appropriate as they are in accordance with the adopted Subarea Plan and established development. AGENCY REVIEW The Planning Department has requested written summary-review comments from the Bozeman Development Review Committee regarding the request zone map amendment. Comments received as of the writing of this staff report have been outlined above. Additional comments and/or recommendations received after the date of this report will be forwarded to the governing body. PUBLIC COMMENT No public comments have been received by the Planning Department as of the writing of this report. Any comments received after the writing of the Staff Report will be distributed to the Commissioners at the public hearing. STAFF RECOMMENDATION Should the City Commission choose to approve this zone map amendment request, the Planning Department recommends the following standard ZMA contingencies: 1. SUMMARY & CONCLUSION The Planning Department and Development Review Committee have reviewed the requested zone map amendment and have provided the above comments as they relate to the review criteria and recommend approval with the above noted contingencies. The recommendation of the Bozeman Zoning Commission will be forwarded to the Bozeman City Commission for consideration at its public hearing on Monday, August 4, 2008. The City Commission will make the final decision on the application.
