HomeMy WebLinkAbout08-18-2008_June 25, 2008 Policy Meeting MinutesLINKED MINUTES OF THE POLICY MEETING OF THE CITY COMMISSION BOZEMAN, MONTANA June 25, 2008 ***************************** The Commission of the City of Bozeman met in the City Commission Room at City Hall, 411 East Main Street, on Wednesday, June 25, 2008 from 12:30-2:00 p.m. Present were Mayor Kaaren Jacobson, Cr. Jeff Krauss, Cr. Sean Becker, Cr. Eric Bryson, Cr. Jeff Rupp, City Manager Chris Kukulski, Planning Director Andy Epple, Planner Courtney Kramer, Historic Preservation Planner Allyson Bristor, and City Clerk Stacy Ulmen. 0:00:09 A. Historic Preservation: Second Story Additions to One Story Properties (Kramer) 0:01:00 Andy Epple, Director of Planning Mr. Epple spoke about small bungalow homes. These have become valuable properties. The preservation program allows and doesn't discourage adding onto the homes. Mr. Epple went over what the City code allows. Mr. Epple spoke regarding the "pop top" scenario (building up). This has caused the denial of applications. He wanted to have a policy meeting to discuss the preservation program and the "pop the tops" concept. 0:04:48 Chris Kukulski, City Manager Mr. Kukulski requested that the differences between the Historic district and Conservation Overlay district be discussed. 0:08:11 Ms. Kramer Ms. Kramer stated that planning has received a number of applications to construct a second story addition to a one story house. She spoke regarding the constraints of allowing these. She went over the definition of demolition in the Code. She highlighted the design guidelines. 0:19:45 Ms. Kramer Ms. Kramer spoke regarding the differences in application submittals in or out of the Historic District. 0:20:32 Mr. Epple Mr. Epple stated that the City does not do design review or require certificates of appropriateness outside the conservation district. 0:29:52 Mayor Jacobson Mayor Jacobson stated that she does not think that pop tops are proper in the historic and overlay districts. 0:31:24 Cr. Krauss Cr. Krauss spoke regarding encouraging people from building in the green space and making it desirable to live downtown. We need to recognize that applicants are subject to the rules that the City imposes. 0:35:06 Cr. Rupp Cr. Rupp spoke regarding the chart that was handed out. It does not appear that we are treating people the same. 0:36:21 Allyson Bristor, Historic Preservation Planner Ms. Bristor stated that decisions are based on the inventory which is over 25 years old. 0:37:02 Ms. Bristor Ms. Bristor spoke regarding the guidelines relating to non-contributing properties in the Historic district. 0:38:03 Ms. Kramer Ms. Kramer asked for direction regarding how to apply the guidelines. 0:38:37 Ms. Bristor Ms. Bristor stated that the conservation overlay has guidelines in place that specify regulations. 0:38:58 Mr. Epple Mr. Epple spoke regarding the applications outside of the historic district. 0:43:18 Mayor Jacobson Mayor Jacobson asked that the difference between restoration and preservation be explained. 18 Linked Minutes of the Bozeman City Commission Policy Meeting, June 25, 2008 3 0:43:28 Ms. Kramer Ms. Kramer stated that from a preservation aspect, you keep it in place the way it is. A restoration means you take it back to what it was. 0:44:01 Mayor Jacobson Mayor Jacobson asked for the difference between rehabilitation and adaptive re-use. 0:44:19 Ms. Kramer Ms. Kramer stated that both allow for more extensive changes. It is great for houses that have lost their integrity. 0:48:09 Ms. Bristor Ms. Bristor spoke regarding the deviations process. 0:49:40 Mr. Kukulski Mr. Kukulski spoke regarding applications outside the district, 0:50:23 Ms. Bristor Ms. Bristor spoke about the historic district and creating a local historic district program. It is a matter of how we feel neighborhood character should be changed. 0:51:35 Cr. Bryson Cr. Bryson wondered why in 25 years there has not been a creation of any more historic districts. 0:52:43 Cr. Bryson Cr. Bryson stated that we need to encourage the designation of historic districts. 0:53:11 Cr. Bryson Cr. Bryson stated that he is concerned about the idea that restrictions are imposed outside the district. 0:53:59 Cr. Becker Cr. Becker stated that it seems that we need to move towards working with those in the conservation area to see if they want to become a historic district. We need information on how we go about doing this. 0:55:44 Mayor Jacobson Mayor Jacobson wondered what happens with applications in the interim. 0:56:46 Ms. Bristor Ms. Bristor stated that at this point the proposals that have been submitted are not abiding by the City's guidelines in conservation district. 19 Linked Minutes of the Bozeman City Commission Policy Meeting, June 25, 2008 4 0:58:44 Cr. Krauss Cr. Krauss stated that he is not in favor of doing away with the overlay district. He wants adaptive re-use in the downtown and in the conservation overlay district. He is not sure if national standards serve the City the best. We make history now. We want the conservation overlay district to be a place where people vest in their property. He would approve some “pop tops” but need some kind of limits. Stay within the guidelines. 1:04:25 Rob Pertzborn, Public Comment Mr. Pertzborn stated that he loves the conservation overlay district. He tried to create one on North Church. It is hard to put one together. 1:07:33 Ron Bryan, Public Comment Mr. Bryan spoke regarding design guidelines. 1:12:18 Mr. Epple Mr. Epple spoke regarding the appeal procedure. 1:13:14 Ms. Bristor Ms Bristor suggested that the historic inventory be updated. 1:13:17 Mr. Epple Mr. Epple explained that in 2006 the Commission authorized a surcharge on certificate of appropriateness fees. There is around $10,000. We are currently seeking a Protect America's Treasures Grant. We are looking at using the surcharge funds to begin the study to update the historical inventory. 1:14:16 Ms. Bristor Ms. Bristor stated that the inventory update parallels with the growth policy update within the preservation section of the plan. 1:15:38 Ms. Kramer Ms. Kramer spoke regarding the Preserve America designation. 1:20:43F.
