MINUTES OF THE SPECIAL MEETING OF THE CITY COMMISSION
BOZEMAN, MONTANA
August 8, 2008

The Commission of the City of Bozeman met in the Commission Room, City Hall, 411 E. Main on Friday, August 8, 2008 at 7 a.m. Present were Deputy Mayor Jeff Krauss, Cr. Sean Becker,
Cr. Eric Bryson, and Cr. Jeff Rupp, City Manager Chris Kukulski, and City Clerk Stacy Ulmen.
0:14:16 A. Call to Order 7 a.m.-City Hall, City Commission Room, 411 East Main
Deputy Mayor Krauss called the meeting to order at 7:14 a.m.
0:14:17 B. Pledge of Allegiance and Moment of Silence
0:14:54 C. Authorize the absence of Mayor Jacobson
0:15:00 Motion and Vote to authorize the absence of Mayor Jacobson.
It was moved by Cr. Bryson, seconded by Cr. Becker to authorize the absence of Mayor
Jacobson.
Those voting Aye being Crs. Bryson, Becker, Rupp, and Deputy Mayor Krauss.
Those voting No being none.
The motion carried 4-0.

Deputy Mayor Krauss opened public comment.

0:15:22 E. Discussion regarding the Police Department and Municipal Justice Center
Site (Jeff Sandholm of Sandholm architects)

Mr. Lachapelle spoke regarding the master plan of the L & J site.
0:17:54 Cr. Bryson
Cr. Bryson spoke regarding getting a cost breakdown of the L & J site compared to the West
Lake site.

Mr. Sandholm passed out site plans of the northwest corner and the southwest corner of the L &
J site.

Mr. Sandholm stated that for the police, the southwest corner would be the best because of the
access out to College Street. The County Commission is not convinced that this is the best.

Mr. Sandholm stated that he believes that the southwest corner could work for everybody. The
southwest corner is better access to College Street. The northwest corner does not address access
to Koch.

Cr. Bryson questioned access points on each corner.

Deputy Mayor Krauss reiterated that the County is not offering a piece of property with two
access points at this time.

Mr. Sandholm spoke regarding the Koch access.

Cr. Becker asked what the difference between the Koch and the College accesses were.
0:26:45 Mr. Lachapelle
Mr. Lachapelle explained that the College access exists and the Koch access would take
additional public dollars to construct.

Cr. Becker spoke regarding the difference between response times for City and County police
calls.

Cr. Rupp spoke regarding access and asked if this is the primary issue regarding the northwest
versus the southwest corner.

Mr. Lachapelle stated that long term storage needs and an evidence storage facility were
sketched for the southwest corner and not the northwest.

Mr. Kent spoke regarding the issue with parking at the existing jail.

Mr. Kent spoke regarding leasing property.

Cr. Bryson spoke regarding making an offer for the southwest corner.

Cr. Bryson spoke regarding the importance of proceeding with some counter offer for the
southwest corner. It is important to keep the communications with the Sheriff’s Department and
the County.

Cr. Rupp stated that would be listed in the communication are the concerns with the northwest
corner, primarily access.

Deputy Mayor Krauss spoke regarding finding out the true cost of the West Lake property.
Deputy Mayor Krauss spoke regarding his concern of having the money to purchase property for
the police department.

Mr. Kukulski stated that the 2009 budget shows funding for a down payment and architectural
fees.

Mr. Kukulski asked the Commission to determine how much land they would like to make an
offer to the County on.

Cr. Rupp stated that he would like to bargain with the County for the southwest site. Cr. Rupp
spoke regarding the West Lake site.

Mr. Kent stated that the best site for the Police Department is the West Lake site and the second
best is the southwest corner at the current Law and Justice site.

Mr. Kent stated that if the department was located in the northwest corner, parking would be an
issue.

Cr. Rupp spoke regarding shared parking agreements.

Deputy Mayor Krauss stated that the City should own enough property for future expansion.

Cr. Rupp stated that the City should pursue 5 acres.
0:53:42 Cr. Rupp
Cr. Rupp stated that the City should draft a letter to the County and it should include that the
northwest corner will not work because of the Koch access.

Deputy Mayor Krauss stated that the City should make an offer on the 5 acres in the southwest
corner.

Mr. Kukulski asked the Commission what they would like for a dollar figure for the offer on the
southwest corner.

Mr. Kukulski asked the Commission if they wanted to use the figure from the northwest corner
appraisal.

Deputy Mayor Krauss stated that he would like a response from the County before the City takes
the position on the jail bond issue.

Mr. Kukulski stated that he will draft a letter to the County and place it on the Monday
Commission Meeting agenda.

Cr. Rupp reiterated that the shared parking needs to be addressed.

Mr. Lachapelle spoke regarding the advantages of the southwest corner.

Cr. Rupp spoke regarding moving the Municipal Court and adding a second court.
1:01:21 Mr. Kukulski
Mr. Kukulski stated that the Judge has found space for the second court. There has been
discussion regarding finding a location for both courts.

Judge Seel spoke regarding a site for the second municipal court.
