RECOMMENDATION: Authorize the City Manager to sign the contract agreement with Redflex Traffic Systems, Inc. which, acting at the direction of the City, will implement, maintain and manage the Digital Automated Red Light Camera Enforcement Program at selected intersections in Bozeman on an initial 3-year term. BACKGROUND: In 2005 and 2007, the City of Bozeman conducted a citizen survey. Results of this survey indicated a majority of Bozeman residents are not satisfied with current traffic related enforcement. In 2007, the City Commission adopted a police department staffing plan. One area of concern addressed in the plan is the need for adequate staff to enforce traffic regulations. During the fall of 2007, City staff presented an enforcement option to the City Commission and received direction to augment existing law enforcement by implementing a Digital Automated Red Light Camera Enforcement Program in the City of Bozeman. City staff conducted research on various camera enforcement companies, existing programs and related studies. This research supports the conclusion that implementing this program for the City would be legislatively feasible, operationally feasible and serve to improve traffic safety for Bozeman. In the spring of 2008, City staff formed a red-light camera enforcement committee, with representation from City Manager’s Office, Legal Department, Public Services Department, Public Safety Department and Information Technology. In order for this program to be successful, inter-departmental collaboration, and City Commission and public support is imperative. Before presenting any final proposal, we ensured several areas of concern were adequately addressed. These areas of concern included: 1) What are the cities ultimate objectives and will the program address these? 2) Is implementation of the program legally feasible, and if so, in what manner? 3) What are the fiscal impacts on the city? 4) What are some of the concerns of staff, commission and public? 5) What is the best manner of implementation and operation of the program? 6) What intersections meet the established criteria for the red-light camera program? In research of other cities crash data, we find a startling decrease in the number of right-angle crashes at intersections for cities that utilize red-light camera enforcement. According to the National Highway Traffic Safety Enforcement Division, cities using red-light camera enforcement as a safety measure show a 40% reduction in angle crashes. Right angle crashes, such as those at signal intersections generally occur at higher speeds and result in more severe vehicle damage and occupant injuries than damage and injuries seen in rear-end collisions. In 2002, the PROGRAM OBJECTIVES American Journal of Health conducted a study in four California cities and found a 29% reduction in right angle crashes at red-light camera controlled 101 Page 2 | Commission Memorandum intersections and an overall crash reduction at all intersections of 7%. Dozens of other cities reported data indicating an overall decrease in traffic crashes in cities utilizing red-light camera enforcement. In a review of crash data over the past 3 years, Bozeman experienced an average of 1,656 crashes annually, averaging 437 at signal intersections. One crash alone will have profound impacts on our community. Not only are there significant costs related to medical care, insurance premiums and vehicle damage, but time spent by law enforcement officers and fire personnel limit their ability to be available for other safety needs in the City. Most importantly, injuries to vehicle occupants or pedestrians result in loss of life or lowered quality of life. With this information, the red-light camera enforcement committee determined this program objectives consisted of: • IMPROVE DRIVER BEHAVIOR RELATED TO TRAFFIC SAFETY AT INTERSECTIONS WITH TECHNOLOGY ENFORCEMENT. • REDUCE NUMBER OF RED-LIGHT VIOLATIONS AND CRASHES AT SIGNALIZED INTERSECTIONS, PARTICULARLY THOSE WITH HIGH RATES OF RED LIGHT VIOLATIONS AND/OR HIGH RATES OF RIGHT-ANGLE CRASHES. • USE TECHNOLOGY TO ENHANCE LAW ENFORCEMENT INVESTIGATIONS, PARTICULARLY RELATED TO CRASH INVESTIGATIONS AT INTERSECTIONS. • ENSURE THE INTRODUCTION OF THIS TECHNOLOGY IS DONE WITH CONSIDERATION TO THE PUBLIC WHO SHOULD BE APPROPRITELY INFORMED AND EDUCATED LEGALLY FEASIBLE In August 2007, then City Attorney Paul Luwe presented to the City commission a memorandum regarding legal authority to utilize cameras for enforcing red-light violations. Currently, there are no cities in the State of Montana using cameras to enforce red light violations. Numerous cities and states are legally allowed to use this manner of enforcement, through a variety of enforcement methods including both criminal and civil infractions. A determination was made that a City with self-governing powers, such as Bozeman, is not precluded from enacting a photo-radar ordinance. In Bozeman, an ordinance needs to be drafted to allow for red-light camera enforcement, with the violation classified as a civil infraction, and provisions allowing for an appeal if the registered owner is in question, the vehicle stolen or the owner is able to properly identify the actual operator of the vehicle that caused the violation. Furthermore, the creation of this ordinance will not replace the ability to issue a criminal citation for a red light violation n occurring at non-camera controlled intersections or when a criminal citation is more appropriate than a civil infraction, such as a major crash at a camera controlled intersection or an egregious infraction viewed directly by a police officer. 102 Page 3 | Commission Memorandum CONCERNS OF STAFF, COMMISSION AND PUBLIC Several concerns were identified over the past year: Are the cameras an invasion of privacy? Driving is a regulated activity on public roads. By obtaining a license, a motorist agrees to abide by certain established rules, such as obeying traffic signals. The cameras are situated at the most dangerous intersections in Bozeman and take photographs of the vehicle as it approaches the intersection, as it goes through the intersection and a close-up photograph of the vehicle license plate, with no photography of the vehicle interior, including the driver or occupants. Once a law enforcement official determines a red-light violation has occurred and a notice is sent, does the violation get posted for observation by the vehicle owner. Only the vehicle owner will be able to review the violation to decide whether to pay the fine or appeal the violation. Law enforcement will use other video in reaction to a major incident or crime. For example, if a pedestrian is struck by a vehicle at a camera monitored intersection and the driver flees, law enforcement will retrieve the video data to help locate the offender. Are the yellow lights too short? Research was conducted to ensure all signal intersections are timed according to standards set by the Manual on Uniform Traffic Control Devices (MUTCD). This guideline indicates that yellow change interval should have a duration set at approximately 3-6 seconds. The controllers for the lights cannot physically be set for any duration less than 3 seconds. Prior to any final use of the cameras for red-light enforcement, verification by the City and the contractor installing the cameras will be done. Is a civil fine a fair replacement for a criminal citation and will these cameras replace an officer on the street? While red light violations at these intersections will usually result in a fine only, and not a criminal traffic citation or points on the driver’s record, they will serve as a deterrent to red-light running, and resultant traffic crashes at Bozeman intersections. Law enforcement officers will continue to issue criminal traffic citations for offenders involved in serious crashes or dangerous red-light running. More importantly, with an average of nearly 130 calls for service per day, there are too many calls, too many streets and too many traffic signals for law enforcement officers alone to monitor, and still remain proactive on our streets and in our neighborhoods. Red-light camera enforcement will serve to augment current traffic enforcement efforts, essentially creating a “force multiplier”. By placing red-light cameras at dangerous intersections and implementing public awareness of the red-light camera program, law enforcement officers will be better able to focus on more egregious traffic infractions (Reckless Driving, DUI), business security, neighborhood patrols and proactive community policing. IMPLEMENTATION/OPERATION PLAN Based on the above information, City staff sent out a request for proposal nationwide. The City received proposals from two different companies that install and operate red-light camera enforcement systems. Through a selection process and follow-up research, the City selected a proposal offered by Redflex Traffic Systems Inc. from Scottsdale, Arizona. Redflex has developed and supports 71% of all inaugural red-light camera programs in the United States. Redflex holds contracts with over 220 Cities in 21 states totaling over 1,255 operational systems. Contacts with other City officials resulted in extremely favorable responses of Redflex. In our analysis, we found Redflex has the verifiable capabilities and experience in delivering programs of this magnitude and complexity to give the public safety benefits derived from developing a model red-light camera enforcement program for Bozeman. 103 Page 4 | Commission Memorandum Upon agreement by the Commission to adopt a red-light camera enforcement program and agreement to work with Redflex, the implementation phase begins. Over the course of 60-90 days after contract agreement, Redflex will work with all divisions of the City impacted by red-light camera enforcement to ensure installation and operation is done in accordance with mutually agreed upon decisions. Field testing, yellow light timing verification, permit authorization, etc. will be done in a collaborative nature. Redflex’s role, as directed by the City, will be to provide a number of functions more appropriately managed by an established, qualified company specializing on red-light camera programs. Some functions include: • Supply, install and maintain red-light camera enforcement high resolution digital cameras at mutually agreed upon intersection approaches. • Process all violations (after Bozeman Police Department verification), by initial viewing of all red-light running, mail notices of violations, complete collections processing, web access for police and vehicle owners to review infractions and supply all evidence packages needed for prosecution. • Allow access, at no additional charge, of video necessary for criminal investigative purposes, such as a major traffic crash. • Provide a 24 hour customer service hotline to answer questions relating to system operations, payment of violation or appeal process questions. • Provide audit data of number of violations at each intersection on a monthly basis. • Assistance with local ordinance development. • Provide legal support and assistance for major court challenges. City staff has ensured through the proposal and contract process that the following principles apply upon implementation. • A violation will only occur on direct verification by a trained Bozeman Police official. • An appeal procedure will exist to allow a vehicle owner to indicate (1 failure to transfer plates by a new owner; 2) the fact that the vehicle was stolen at the time of the violation; and 3) to identify the actual driver of the vehicle. • Equipment will be functional at a minimum of 90% of the time and repairs are done within 48 hours, as necessary. • To adequately prepare the public, ensure that the first 30 days of operations are done with warning violations only. • Ensure that the program is 100% violator funded, as detailed in “Fiscal Effects” below. PROPOSED INTERSECTIONS City staff has complied crash data on the existing 45 signal intersections in Bozeman. Upon review of the number/type of crashes, difficulty for law enforcement to monitor and historical red light citation data, the following 13 intersections have been selected for initial survey review. After a 24 hour survey of each intersection to determine the rate of red light violations, the City and Redflex will mutually agree on which of these 13 intersections warrant a red light camera system. The intersections under consideration are: 104 Page 5 | Commission Memorandum • 19th • 19 and Main (78 crashes in 3 years) th • 19 and Oak (84 crashes in 3 years – major northern entry to city) th • 19 and Durston (47 crashes in 3 years) th • Huffine and Ferguson (28 crashes in 3 years – high speed highway and major western entry to city) and Beall (34 crashes in 3 years – heavy pedestrian use) • Main and College (43 crashes in 3 years) • Main and 23rd • Main and 15 (53 crashes in 3 years) th • Main and 11 (33 crashes in 3 years) th • Main and 7 (42 crashes in 3 years – very visible intersection and near school) th • Main and Willson (32 crashes in 3 years, central location to downtown and pedestrians) (45 crashes in 3 years, substantial red light citations issued) • 7th • 7 and Oak (75 crashes in 3 years, major northern entry to city) th UNRESOLVED ISSUES: Final ordinance creation, final business rules creation and final intersection selection. FISCAL EFFECTS: The digital automated red-light camera enforcement program is 100% violator funded. If 100 violations occur or zero violations occur, the City is not responsible for paying Redflex more than is received from violation payments. In fact, no payment goes to Redflex until a violation is confirmed by the Bozeman Police Department and the responsible party has paid for the violation. A portion of fines collected pay for Redflex costs related to equipment, installation, maintenance, processing, customer service support, training and legal support. A portion of fines collected help pay to offset City costs of electricity; law enforcement personnel costs to review violations, gather evidence packages and testify; finance personnel and court personnel costs related to handling deposits, audits and appeals; and costs related to public awareness campaign to educate the public. Law enforcement will continue to issue criminal traffic citations at non-camera enforced approaches, thus there should be an overall increase in total citations issued. However, with the public awareness and ability for owners to view the violation for civil infractions, overall appeals to municipal court should diminish. Additionally, staff time spent investigating crashes will also diminish over time as driver behaviors are modified and overall crashes decline as a result of a Digital Automated Red Light Camera Enforcement Program. The Federal Highway Administration and National Highway Traffic Safety Administration maintain that red light camera systems can be a very effective countermeasure to prevent red light running, as cited in Red Light Camera Systems Operational Guidelines, FHWA-SA-05-002, January 2005. Additionally, significant data supports the effectiveness of red light camera programs in reducing intersection crashes and improving driver safety. Such programs have been successfully operated in Europe for over 20 years and for more than 10 years in the United States and have been proven to be accurate and reliable. As of January, 2008, over 200 U.S. communities use camera enforcement and the numbers grow significantly each year. An effective public awareness and information campaign is crucial to the acceptance and success of a red light camera program and is vital to effect significant change in driver behavior. The campaign must increase citizen awareness about the dangers associated with red light running and speeding while providing them with the information they need to alter their driving habits, including advance warning of the increased traffic enforcement and the steps should take to get answers to any questions or concerns. To gain public support, communications should occur through a variety of channels with a central message to improve traffic safety, explain program objectives and report program results with emphasis on achieved safety benefits. This guide provides an all-inclusive approach to promoting information about red light running and speeding as well as the increased enforcement that will come as a result of red light cameras. 106 The Problems: Red Light Running and Speeding Transportation safety agencies like the National Highway Traffic Safety Administration, the Federal Highway Administration and the Insurance Institute for Highway Safety endorse photo enforcement technology as an effective public safety tool. The NHTSA reports that nearly 9,200 died in 2005 in intersection-related crashes. Approximately 805 people are killed and another 165,000 are injured annually in red light running collisions. Additionally, 40 to 45 percent of all crashes in the U.S. occur at intersections or are intersection-related. Public costs of red light running exceed $14 billion per year. Recent polls suggest that one in three American motorists knows someone injured or killed in a red light running crash and that one in five motorists admits to running red lights in the last 10 intersections they entered. Speeding is another leading cause of fatal motor vehicle crashes. The economic cost to society of speeding-related crashes is estimated by NHTSA to be $40.4 billion per year. Speeding is a contributing factor in 30 percent of all fatal crashes, and an estimated 1,000 Americans die monthly. In 2006, 13,543 lives were lost in speed-related crashes, up 3 percent from the previous year. Speeding reduces a driver’s ability to steer safely around curves or objects in the roadway and extends the distance a driver needs to stop a vehicle. Yet drivers still speed. One recent national poll suggested that 71 percent of polled American drivers believe it is acceptable to exceed the speed limit by 5 mph. Red light running and speeding may be attributed in part to a prevalent attitude today in which time is valued more than safety. In many cities, the yellow light now denotes "hurry up" instead of "slow down." The symbol of a speed limit sign is often disregarded, as well. 107 More National Statistics Red Light Running • The Federal Highway Administration estimates that red light running results in more than 100,000 intersection-related crashes annually. • Other motorists and pedestrians account for more than half of the deaths caused by red light running crashes. • The average red light camera location in the U.S. results in reduced societal costs of $39,000 - $50,000 a year, as reported in a cost-benefit analysis funded by the FHA. Speeding • Speeding is a contributing factor in 30 percent of all fatal crashes. An estimated 1,000 Americans die each month from speed-related crashes. • In 2005, more than 13,000 lives were lost in speed-related crashes. • The economic cost to society of speeding-related crashes is estimated by NHTSA to be $40.4 billion per year – $76,865 per minute or $1,281 per second. • NHTSA analysis found that the proportion of fatal speed-related crashes decreased with increasing driver’s age: male drivers ages 15 – 20 (38%), male drivers ages 35 – 44 (19%) and male drivers ages 45 – 54 (15%). Public Opinion Regarding Photo Enforcement • National polling conducted by the National Campaign to Stop Red Light Running found 83 percent support for red light cameras in cities with a red light running problem. • The Federal Highway Administration and National Highway Traffic Safety Administration contend that red light camera systems can be a very effective countermeasure to prevent red light running. • A 2006 poll of Arizona voters, conducted by Arizona State University’s Walter Cronkite School of Journalism and Mass Communication and KAET-TV, found that 64 percent of voters support the concept of photo speed-enforcement on state highways. Statistics derived from the National Stop Red Light Running Campaign, National Highway Traffic Safety Administration and Insurance Institute for Highway Safety. 108 State Statistics Arizona • An Arizona State University study found motorists’ average speeds dropped 9.5 mph on average through a stretch of the Loop 101 freeway in Scottsdale, prompting state officials to reactivate six fixed photo speed-enforcement cameras in February 2007. The study also found the freeway cameras reduced crashes by as much as 70 percent. Speeding increased by 840 percent after the cameras were turned off in the wake of a pilot program. • In Prescott Valley, red light running violations dropped 97 percent between February and July of 2007, from 836 violations to merely 25. Iowa • An Iowa State University study released in December 2007 found red light cameras were “very successful” in reducing red light running collisions by 90 percent in Council Bluffs and 40 percent in Davenport. Researchers found no increase in rear-end collisions. Ohio • Dayton reduced red light running violations by 44 percent since automated enforcement cameras were introduced in 2003. The average number of annual intersection crashes dropped 37 percent. • Red light cameras in Columbus decreased red light running crashes and violations since their 2006 rollout. City officials saw a 71 percent decrease in violations at the initial two intersections, from 1,684 violations in March 2006 to 477 in August. Texas • Automated enforcement cameras are credited with reducing El Paso red-light running by 57 percent since 2006. Accidents are down 80 percent. The city did not report any spike in rear-end collisions. • Plano police reported nearly 50 percent fewer collisions at four of the city’s photo-enforced intersections since cameras were installed in March 2006. Collisions were reduced by as much as 30 percent at other intersections. Virginia 109 • Red light running violations spiked nearly 100 percent in Virginia Beach at four photo-enforced intersections in the six months after cameras were switched off for evaluation. Preliminary results from a 2007 study by Old Dominion University found red light cameras reduced red light running by 69 percent in Virginia Beach. Public Opinion on Red Light Running and Photo Enforcement Systems • Past national polling conducted by the Campaign to Stop Red Light Running in 2002 found 83 percent support for red light cameras in cities with a red light running problem. • An April 2001 survey of ten cities by the Insurance Institute for Highway Safety found that opinions about red light camera use are favorable in communities both with (77 – 84 percent) and without (72 – 82 percent) programs. • The Federal Highway Administration and National Highway Traffic Safety Administration contend that red light camera systems can be a very effective countermeasure to prevent red light running, as cited in Red Light Camera Systems Operational Guidelines, FHWA-SA-05-002, January 2005. A survey of 800 licensed drivers in United States ages 18 to 65, conducted by the Federal Highway Administration and the American Trauma Society, resulted in the following: • 96 percent of Americans worry that, when they are driving through an intersection, someone might run a red light and hit them. • 91 percent of Americans believe that running red lights is "very" to "extremely" dangerous. • 70 percent of Americans support the use of enforcement cameras at intersections to catch red light runners. • 60 percent of Americans believe that people run red lights simply because they are in a hurry. • 63 percent of Americans see someone running red lights a few times a week to once a day. • 65 percent of Americans believe that the problem of running red lights has either stayed the same, or has gotten worse, but has not gotten better over the past few years. • 54 percent of Americans agree that people who run red lights are just as reckless as people who drink and drive. • 32 percent of Americans - one out of three - know someone who has been injured or killed because of a red light runner. A A violation occurs when a motorist enters an intersection after the signal light has turned red. Motorists trapped inadvertently in an intersection when the signal changes to red (e.g., waiting to turn left) are not red light runners. Q Is red light running really a problem? A Red light running is one of the major causes of crashes, deaths and injuries at signalized intersections. The National Highway Traffic Safety Administration estimates that 20 percent of drivers do not obey intersection signals. The NHTSA reports that crashes caused by red light running result in more than 800 fatalities and 165,000 injuries annually. The monetary impact is estimated to reach $14 billion annually. Other motorists and pedestrians account for nearly half the deaths caused by red light running crashes. Q What are red light cameras and how do they work? A Red light cameras help communities enforce traffic laws by automatically photographing vehicles whose drivers run red lights. A red light camera system is connected to the traffic signal and to sensors that monitor traffic flow at the crosswalk or stop line. The system continuously monitors the traffic signal 24/7, and the camera itself is triggered by any vehicle entering the intersection above a pre-established minimum speed and following a specified time after the signal has turned red. A second photograph typically shows the red light violator in the intersection. Cameras record the date, time of day, time elapsed since the beginning of the red signal, and vehicle speed. Tickets are sent by mail to owners of the violating vehicles, following review by trained police officers of the photographic evidence. Q Isn’t conventional police enforcement sufficient? A Traditional traffic law enforcement is intensive and high-risk. Police departments rely exclusively on the presence of officers to observe violations and cite offenders, which is limiting. Officers cannot be everywhere. When officers observe a violation, it is not always possible to safely stop the violator because to make the stop. The officer may have to speed to run a red light. This can endanger motorists and pedestrians as well as police officers, and traffic stops in high-traffic areas can increase congestion. Communities lack the resources necessary to allow police to patrol intersections as often as would be needed to ticket all motorists who run red lights and to thereby make a significant impact on red light running. Red light cameras are designed to identify traffic law violators without depending on the presence of police officers, allowing communities to focus on other enforcement needs. 111 Q Does my community really need red-light cameras? I’ve heard all that is really needed is to extend yellow light timing? A The use of adequate yellow signal timing reduces red light running and injury- related crashes, but longer yellow timing used in conjunction with red light cameras provides a more significant decrease in incidents of red light running. The Insurance Institute for Highway Safety recently conducted a field study to evaluate the effects on red light running by first lengthening yellow signal timing, followed by the introduction of red light cameras. Six approaches to two different intersections were tested sequentially. Findings were compared against three intersections in a neighboring city where red light cameras were not used and yellow light timing remained constant. Results showed that yellow timing changes reduced red light violations by an average 36 percent. The addition of red light camera enforcement further reduced red light violations by 96 percent beyond levels achieved by the longer yellow timing. At the intersection with the greatest incidence of red light running—251 per 10,000 vehicles—yellow light extensions reduced red light running to 198 incidents per 10,000 vehicles. Once red light cameras were installed at that intersection, incidents of red light running dropped to an astounding two per 10,000 vehicles. Q What safety benefits do red light cameras provide? A Cameras have been proven to substantially reduce red light violations. Institute Evaluations by the Insurance Institute for Highway Safety in Fairfax, Virginia, and Oxnard, California, showed that camera enforcement reduced red light running violations by nearly 40 percent. In addition to reducing red light violations, cameras have been shown to reduce intersection crashes. In Oxnard, California, significant citywide crash reductions followed the introduction of red light cameras, and injury crashes at intersections with traffic signals were reduced by 29 percent. In addition to reducing red light running at camera-equipped sites, violation reductions in both communities carried over to signalized intersections not equipped with red light cameras, indicating community-wide changes in driver behavior. Front-into-side collisions — the types of crashes most closely associated with red light running — were reduced by 32 percent, and front-into-side crashes involving injuries were reduced by 68 percent. An Institute review of international red light camera studies concluded that cameras reduce red light violations by 40 to 50 percent and reduce injury crashes by 25 to 30 percent. 112 Q Isn’t it more dangerous for cars to slam on their brakes if they fear running a red light rather than to simply keep driving? A REDFLEX technology is set to photograph only those vehicles entering the intersection after the light has turned red. While drivers who fear a ticket for red light running can cause a rear end collision by applying their brakes too rapidly, these types of accidents are far less dangerous than the typical right- angle collision caused by red light running, indicating a positive aggregate benefit. A 2007 study of three Iowa communities found no increase in rear end collisions. A 2005 study in Raleigh, North Carolina showed a 25 percent reduction in rear end accidents. As confirmed by two recent studies funded by the FHTSA, red light photo enforcement benefit communities by reducing dangerous right angle crashes at the intersections where the cameras are deployed, as well as other intersections located near red light camera- enforced intersections. Q I’ve heard that red light cameras don’t actually improve road safety. Is that true? A Red light cameras are proven to deter red light running and are an effective supplement to traditional law enforcement. Red light cameras are in operation in more than 200 U.S. communities, up from only two communities 10 years ago, and have been used internationally since the 1970s. A 2005 review of red light camera studies around the world concluded that cameras reduce red light violations by 40 to 50 percent and reduced injury-related crashes by 25 – 30 percent, according to The National Campaign to Stop Red Light Running. See the state statistics on page 6 for details Q Do red light cameras violate motorists’ right to privacy? A No. Driving is a regulated activity on public roads. By obtaining a license, a motorist agrees to abide by certain rules, such as to obey traffic signals. Neither the law nor common sense suggests drivers should not be observed on the road or have their violations documented. Red light camera systems can be designed to photograph only a vehicle's rear license plate, not vehicle occupants, depending on local law. Only vehicles driven by motorists who violate the law are photographed. Speeding: Q Is speeding really a safety problem? A Speeding is a factor in nearly one third of all fatal crashes in the United States. More than 13,000 people die annually from speed-related accidents. Speed increases the severity of the crash by increasing the energy of the impact. Q Isn’t speed variation between the two cars the real issue in an accident? A No, nearly 50 percent of all speed-related crashes are single vehicle accidents. The risk of death and injury is directly proportional to the speed. 113 Q If photo enforcement cameras are so new in the United States, how do we know they are effective? A Victoria, Australia and Great Britain have used photo enforcement systems for well over two decades. The number of motorists exceeding the speed limit in monitored roadways is down 66 percent in Victoria and 32 percent in Britain. Crashes have been reduced in Victoria by up to 35 percent and up to 40 percent in Britain. A Yes, a comprehensive statistical analysis was recently conducted for the Arizona Department of Transportation (ADOT) and the Arizona Department of Public Safety (DPS) following the first U. S. automated enforcement freeway program. Redflex Traffic Systems in cooperation with ADOT, DPS and the City of Scottsdale implemented a nine month study along a 7.8 mile corridor of the Loop 101 around Phoenix. The program results were dramatic: • The program reduced average speeds down 9.5 mph. • Single vehicle crashes down 71 percent. • Side-swipe crashes down 58 percent. • Total injuries down 40 percent. • Total financial savings estimated to be $10 million per year in that 8 mile stretch alone due to reduced property damage, medical expenses, insurance costs, etc. • Untold benefits include: less congestion time following a freeway accident, community productivity, safety of highway patrol officers responding to an accident, safety of highway patrol officers pursuing a speed related incident. These types of programs typically include all hardware, installation, maintenance, software, citation processing, mailing, adjudication services, payment possessing, collections, process serving, public outreach, and training. Each of these turnkey programs is provided to our partner municipalities on a lease-basis with NO Upfront Capital Investment and is Guaranteed to be 100% Violator Funded for the Life of the Contract  The General Pricing Model: . In fact, each municipality is also offered extensive cost recovery mechanisms, which provide contractual assurances that the city will never operate our programs from a negative fiscal position. 1. Per-Paid Citation: The most common type in the United States. Under this model, the turnkey program is provided to the city risk free in exchange for a negotiated portion of the fines that have been collected. Inherently, the city can never lose money under this model. For Example, if $0 is collected; $0 is owed to REDFlex.  Intersection Selection- Intersection selection is a mutual process. This is a very critical and will include a no cost, no obligation pre-contract and no cost post-contract survey and mathematical assessment of your proposed photo enforced intersections. REDFlex will conduct a 12 hour video assessment of each proposed intersection. This assessment will provide a baseline of data that outlines the total violations, type of violation (left-turn, straight, and right-turn) and time of day. Once compiled, all of this information will be presented to the city to ultimately determine warranted locations.  Installation and Maintenance- 100% of the systems 116 Making a Safer World © 2008 Redflex Traffic Systems, All Rights Reserved 2 installation and maintenance is provided by REDFlex as part of our scope of work. REDFlex provides a construction manager who will work closely with the city’s public works department to develop a system and installation plan for each intersection. This plan includes all engineering, engineered drawings, timelines and necessary permits. Aside from the initial installation and day to day scheduled maintenance REDFlex’s programs also take responsibility for unforeseen events. For example, if a vehicle knocks down our pole, REDFlex will assume responsibility for reinstallation of the system.  Training In addition to the training, the Redflex Customer Service Representative (CSR) assigned to the city’s program will facilitate intradepartmental meetings to continue the process of an open dialogue. These meetings are typically held more frequently at the beginning of a program and taper off to a monthly or quarterly schedule as city wishes. Typically, Redflex will open these meetings to the city’s police, courts, justices, attorneys, engineers and council members. This is done in order to assure that all concerns are addressed and so that each department involved understands how their responsibilities relate to the overall program. - REDFlex will provide training/education program for designated city managers, supervisors, operators, court administrators, and police personnel. This training is intended to help the city develop and enhance their existing knowledge with the skills and competencies that are required to successfully deploy, maintain and operate an effective Red Light Program.  Evidence Sets - All REDFlex system’s provide a combination of high resolution still images including a wide angle pre violation, wide angle during violation, clear driver, and a clear plate image as well as 12 seconds of full motion video with all the evidence being encrypted at the time of capture locally by the system. This prevents interception and manipulation of the evidence in order to assure a secure chain of custody. 117 Making a Safer World © 2008 Redflex Traffic Systems, All Rights Reserved 3 Moreover, the video from the system is stored by default for up to 30 days and can be later used in accident reconstruction, investigations by your police and even to be used to defend a city against any liability as a result of driver error in accidents.  Triple Verification Processing REDFlex invests so much of our resources to this area because we understand how important it is to assure that no incidences are issued incorrectly and to assure that we are not wasting the Police Officers time in reviewing and issuing your citations. - REDFlex is one of the only solution provider that employs three fully dedicated teams of “Verification Specialists” whose solitary responsibility in the organization is to accurately, efficiently and consistently evaluate, populate, and verify each of the 22,000 plus violations a day that file into our Scottsdale, AZ, based processing facility. This three stage screening and quality assurance process is done by REDFlex at considerable expense because our “Verification Specialists” run three shifts, 24/7, 363 days a year.  DMV Look-Ups Moreover, REDFlex also has arrangements with additional 3rd parties that can provide vehicle registration information; which further enhances our prosecutable rate. - REDFlex is already set-up to obtain the vehicle registration and driver’s license information directly from Montana’s Department of Motor Vehicles and of others throughout the United States. In addition, REDFlex has a strategic partnership with NLETS (National Law Enforcement Telecommunication System) to obtain real-time DMV information for all 50 states. These reports generated on-line provide information such as system performance, citation captured, traffic volumes, vehicle speeds egregiousness of each violation, violation time of day, lane and movement of violation, and much more; each of these parameters can be trended over a user-defined longitudinal period.  Program Effectiveness- Generally programs have seen a substantial decline in overall speeds and crashes with declines in side-impact and declines or no impact in rear-end crashes. For example, Prescott Valley, AZ achieved a city wide decline of crashes to the magnitude of 37%. That is over 130 fewer injury accidents than when compared to previous years. The city wide reduction is attributed to the "halo-effect", and it is experienced when the driving public becomes more cognizant and careful in their behavior.  Also, Chandler, AZ has experienced a average 9% decline in injury accidents over a five year period when the city grew by over 70,000 residents. Violator Call Center Currently, with over 196 contracts in the United States REDFlex answers some 22,000 calls per month and is able to provide aid to over 99.8 % of these interfaces without having to escalate the call to city staff. - To further ease the burden on our partners REDFlex offers our multi-lingual Violator call center. Simply put our violator call centers number is printed on each and every citation that is authorized by your police department. This is provided in order for REDFlex to be able to field all the calls that would otherwise be directed into the city’s police department or courts.  Partner City Support Services- Aside from support in the 119 Making a Safer World © 2008 Redflex Traffic Systems, All Rights Reserved 5 form of maintenance and a call center to support violation recipients we also provide a contract holding city with multiple points of contact to get questions answered and to respond to the needs of our partners as soon as possible. The first avenue a partner city can reach REDFlex is via our customer support call center. This call center is set up to provide the quickest possible response to questions and technical support as they arise. REDFlex is very proud of the support we provide and maintains our ability to support our partners by adding recourses as needed. For example, when calling our customer support line you can expect someone to answer the call in under a minute. This is because we understand that when you are calling us you do not have time to waste. Furthermore, REDFlex assigns a Customer Service Representative (CSR) to each and every partner. This person is whom the city will be working closest with on a daily basis. Their responsibility is for assuring that the city is satisfied with their program and that it is functioning smoothly, effectively and achieving its goals. Moreover, your CSR is the person who will be providing expert testimony, making the city aware of best practices and acting as a liaison between your Courts, Police Department, and REDFlex.  Court Appeals - the volume of appeals is typically dependent on the governing laws. Most appeals are generally handled through a designated local traffic court or a hearing officer and are heard along side other traffic cases. Typically the court staff’s main role in a Photo Enforcement system is to process payments, schedule hearings, update adjudication software, and to request court packets for the hearings. The application is available for assigned Law Enforcement personnel and is completely secure using robust user management and Internet security protocols. The application was developed in conjunction with various law enforcement agencies to ensure ease-of-use and intuitive navigation - The REDFlex solution has an integrated web-based on-line application called WebOps.
