SUBJECT: Appeal of Administrative Decision re: West Winds PUD Phase 4—
Proposed Road Alignment for Breeze Way
MEETING DATE: October 20, 2008
RECOMMENDATION: Schedule Appeal Hearing for November 17,2008.
BACKGROUND: On August 21,2008, Mr. Clint Litle of HKM Engineering, on behalf of
Cascade Development, submitted an application to appeal an administrative decision to deny
Cascade Development's proposal to alter the planned east—west alignment of Breeze Way as it
traverses through Phase 4 of West Winds PUD. Administrative staff has concluded that the
proposed alignment of Breeze Way, which would partially be incorporated into a circular drive
rather than making a more direct connection to Ferguson Road,does not substantially comply
with the Commission's overall PUD approval or plat approval for West Winds Phase 4. The
appellants argue that the new road alignment does comply with the intent of the Commission's
previous approval actions, and seeks redress from the Commission to overturn the administrative
decision to deny the newly proposed road alignment. The Commission's role in this matter at
this time is to set a date for a hearing on the appeal application,per Section 18.66.030 BMC.
UNRESOLVED ISSUES: A full packet of information pertaining to the Breeze Way road
alignment issue at the root of this appeal will be provided to Commissioners in advance of the
scheduled hearing date.
ALTERNATIVES: As suggested by the City Commission.
FISCAL IMPACTS: None identified at this time.
