Kukulski, City Manager SUBJECT: Review Authority – Town and Country Foods Re-Development Proposal MEETING DATE: October 27, 2008 RECOMMENDATION: That the City Commission reclaim to itself the final approval of the Town and Country Foods / Campus Square re-development project, per Section 18.64.010 C.1. Bozeman Municipal Code, and further set a tentative public hearing date of November 17, 2008 for formal consideration of the redevelopment proposal. BACKGROUND: Studio Architects, on behalf of Town and Country Foods, has submitted an application to redevelop the Campus Square theatre complex into a grocery store, restaurant, and other retail uses (all within the confines of the existing building). The redevelopment proposal triggers the need for several variances pertaining to street intersections within one mile of the redevelopment proposal that currently operate at or below a level of service “D”. The application for redevelopment of this property, with variances, would ordinarily be scheduled to go before the Board of Adjustment; however, during FYI comments at the Commission’s October 20, 2008 regular meeting, Commissioners requested that this matter be placed on the October 27, 2008 agenda for formal action to reclaim approval authority over the project. UNRESOLVED ISSUES: None identified, other than whether the Board of Adjustment or City Commission will have final approval authority over this project. ALTERNATIVES: As suggested by the City Commission. FISCAL IMPACTS: None identified with regard to this decision.
