SUBJECT: Review Authority – Lindley House Rehabilitation and Second Structure
MEETING DATE: November 3, 2008
RECOMMENDATION: That the City Commission consider reclaiming final approval of the
Lindley House Rehabilitation and Second Structure, per Section 18.64.010 C.1. Bozeman
Municipal Code, and further set a tentative public hearing date of November 17, 2008 for formal
consideration of the project proposal.
BACKGROUND: This submittal is the second application for the site by the property owner.
Citing concerns with massing and scale, the Bozeman City Commission denied a previous
request for deviations in May, 2008. The second application, submitted in August, significantly
reduced the size of the second structure as well as reduced the number of deviations required. On
October 12 the Board of Adjustment reviewed the deviations requested with the project and
tabled it until their November meeting due to concerns about the legality of reducing the
watercourse setback. Due to the Veteran’s Day holiday falling on the second Tuesday in
November, the BOA is unable to schedule their November meeting until Thursday, November
20th
.
At the Commission’s October 27, 2008 regular meeting the designer for the project, Bob
Mechels of Dowling Sandholm Architects, appealed to the Commissioners to reclaim the project
for review in an effort to expedite the review process. During the FYI comments Commissioners
discussed if projects initially denied by them should revert to them for further approval, and
asked Planning Staff to put the matter on the Monday, November 3, 2008 agenda for formal
action to reclaim approval authority over the project.
UNRESOLVED ISSUES: None identified, other than whether the Board of Adjustment or
City Commission will have final approval authority over this project.
ALTERNATIVES: As suggested by the City Commission.
FISCAL IMPACTS: None identified with regard to this decision.
