HomeMy WebLinkAbout11 17 08_Lindley House Rehabilitation and Second StructureCommission Memorandum Memorandum created on November 12, 2008 REPORT TO: City Commissioners FROM: Courtney Kramer, Assistant Planner SUBJECT: Lindley House Rehabilitation and Second Building, Preliminary SPCOA/DEV (#Z- 08207) MEETING DATE: Monday, November 17, 2008 RECOMMENDATION: That the City Commission approve the Lindley House Rehabilitation and Secondary Building Preliminary Site Plan Certificate of Appropriateness with Deviations (#Z-08207) as conditioned by Staff. BACKGROUND: This is a Site Plan Certificate of Appropriateness application with deviations, requesting the following exterior alterations: 1) construction of a new entry porch on the existing building in the 15 foot required front yard setback; 2) construction of a second building in the rear yard of the site in the required 75 foot required watercourse setback; 3) construction and replacement of the drive aisle and parking area in the required watercourse setback in the required 75 foot required watercourse setback; and 4) related site improvements. This application is the second application for the site by the property owner. The Bozeman City Commission denied a previous request for deviations in May, 2008. The City Commission primarily based denial on the massing of the structure proposed at the time. The structure proposed with this application is significantly smaller than that proposal. A total of five deviations are requested with this application. The first is from Bozeman Municipal Code 18.16.050 “Yards” A 1 c to allow reconstruction of a front porch for the existing building in the required 15 foot front yard setback. The second is from Bozeman Municipal Code section 18.42.100 “Watercourse Setback” B 3 b to allow construction of a fence in the required 75 foot watercourse setback. The third is from Bozeman Municipal Code 18.42.100 “Watercourse Setback” B 3 b to allow construction of a pervious parking facility in the required 75 foot watercourse setback. The fourth is from Bozeman Municipal Code 18.42 100 “Watercourse Setback B 3 b to allow construction of drive access from East Olive Street to a rear parking area in the required 75 foot watercourse setback. The fifth deviation has been called out in conjunction with the deviations requested for pervious paving in the setbacks. It is necessary to grant a deviation from Bozeman Municipal Code Section 18.42.100 B 6 “Setback Planting” to allow less than 100 percent of the disturbed areas be planted with ground cover. All disturbed areas not paved for drive access or parking facilities shall be planted with ground cover. Construction of a second building in the 75 foot watercourse setback has not been called out as a deviation as Bozeman Municipal Code Section 18.42.100 “Watercourse Setback” includes provisions allowing the final approval body to administratively reduce the watercourse setback up to 35 feet from the stream. Requests to reduce the watercourse setback to less than thirty five feet from the stream must be approved through the Board of Adjustment or City Commission, as has been done in this project with the 135 Commission Memorandum Memorandum created on November 12, 2008 fence, drive access and parking area. City Legal Staff and Planning Staff now understand that once any part of a project must be approved through the BOA or Commission that review body becomes the final approval body for all elements of the project. In this case, it is within the Commission’s purview to grant the reduction in watercourse setback for the new building. UNRESOLVED ISSUES: Planning Staff is not aware of any unresolved issues at this time. FISCAL EFFECTS: The development, if carried forward, will require site improvements to meet City standards that will be the responsibility of the applicant.
