SUBJECT: Cash-in-Lieu of Parkland Dedication for the Rialto Building Site Plan and Certificate of
Appropriateness Application (#Z-07252)

RECOMMENDATION: The City Commission accepts the cash-in-lieu of parkland dedication request for the
Rialto Building Site Plan and Certificate of Appropriateness application (#Z-07252).
BACKGROUND: The Rialto Building Site Plan and Certificate of Appropriateness application received
preliminary site plan approval from the Planning Director on December 28, 2007. The applicant submitted a revised
final site plan application in November 2008. The project site is the historic Rialto Theater building, which is
located at 10 West Main Street within the Main Street Historic District. The property is legally described as Lots 2,
3, 20 and 21, Block A, Story Addition, City of Bozeman, Gallatin County, Montana. The property is zoned “B-3”
(Central Business District).
Details of the project proposal include the following: (1) removal of the vacant theater on the first floor and change
in use to retail, (2) change in use to office on the second floor, (3) two-story rooftop addition to existing two-story
structure and (4) proposed residential condominium units on the new third and fourth floors (with a total of five
dwelling units). No deviations are requested with the application.
Pursuant to UDO Section 18.50 (Park & Recreation Requirements), parkland dedication, or cash-in-lieu of, is
required for all residential development if it wasn’t previously provided (typically during a subdivision review). It is
determined that the project proposal creates new residential demand for the subject lot and adequate parkland was
never dedicated. The applicant requests to provide cash-in-lieu of parkland for 6,534 square feet (0.15 acres) of
parkland that is required for the five dwelling unit development. Using the appraised value of $2.50 per square foot,
which was obtained from the Bronzeleaf Condominium project’s appraisal of high density “R-4” residential zoning,
the applicant agrees to pay a cash-in-lieu contribution of $16,335.00.
UNRESOLVED ISSUES: The Department of Planning is not aware of any unresolved issues for the proposed
development at this time.
FISCAL EFFECTS: The cash contribution provides the City of Bozeman financial support in the creation and
maintenance of planned parkland within the City boundaries.
ALTERNATIVES: The dedication of 6,534 square feet (0.15 acres) of parkland, or other alternatives as suggested
by the City Commission.
