SUBJECT: Story Mansion Property – Zoning Status
MEETING DATE: February 23, 2009
BACKGROUND: On January 26, 2009, staff presented a report to the Commission entitled
“Story Mansion Land Use Options.” In that report, the potential for rezoning the property from
its current R-1 Residential Single-household, Low Density zoning designation to PLI Public
Lands and Institutions was discussed.
Staff feels that it would be appropriate for the Commission to formally vote on whether or not to
initiate a Zone Map Amendment to change the zoning on the Story Mansion from R-1 to PLI,
and has requested this matter be brought before the Commission for action. Per Sections
18.70.010 A. and B., BMC, a Zone Map Amendment may be initiated by a majority of City Commissioners. Once initiated, staff would prepare the necessary application materials, schedule
the various reviews and public hearings, and bring back to the Commission for possible adoption
as an ordinance. Zone Map Amendments only become effective after approval on second reading
by a majority of Commissioners (except in the case of a valid protest by neighbors, in which case
the ZMA may only be approved by a 4/5ths majority of the Commission).
[NOTE: In a related matter, on January 26th, Commissioners directed staff to bring back the
necessary Resolution and Findings of Fact to declare the Story Mansion property as parkland.
That Issue will be before the Commission as an agenda item on March 2, 2009.]
Public parks are allowed as principle uses in both the R-1 and PLI zoning districts. Community
Centers are allowed as a principle use in the PLI district, but are listed as a conditional use in the
R-1 district. If the Commission acts to change the zoning on the property to PLI, use of the
property as a community center will be run through your Development Review Committee as a
simple Site Plan review. If you leave the zoning R-1, staff will proceed with preparation and processing of a Conditional Use Permit (CUP) application for community center use, to bring
before the Board of Adjustment (or the Commission) in early April.

RECOMMENDATION: That the City Commission consider making a motion to initiate a
Zone Map Amendment from R-1 to PLI, per Section 18.70.010 BMC.
FISCAL EFFECTS: The costs and timeframes are comparable for preparing and processing
applications for a Zone Map Amendment or a Conditional Use Permit. Once operating as a
Community center, the property may start generating a revenue stream of cash to offset costs
incurred to upgrade the property and bring the mansion up to Code.
ALTERNATIVES: As suggested by the City Commission.
