MEETING DATE: February 9, 2009 _____________________________________________________________________________________ RECOMMENDATION: Consider a motion approving Resolution 4145 establishing kennel license application fees ($50.00) for the City of Bozeman Animal Control Enforcement Program separate and distinct from animal licensing fees. BACKGROUND: Staff suggests two changes to Resolution 3233 and reconstituting as Resolution 4145. 1) CLARIFICATION OF THE SEPERATENESS OF KENNEL LISCINCING FEES AND ANIMAL REGISTRATION FEES. Currently, when a citizen applies for a kennel license in the City of Bozeman (City) and remits payment for same, the $50.00 kennel license fee includes registration fees for the number of animals listed on the kennel license application. While not clearly stated in Resolution 3233 that the kennel license fee includes animal licensure, this has been the practice for at least the past 15 years. The $50.00 application fee associated with kennel licenses assists in defraying several costs incurred by the City. Kennel licensing fees are significantly diluted by including animal licensing fees in the $50.00 charge. For example, staff time is utilized when conducting applicant site inspections, applicant and neighbor interviews, follow-up and complaint visits, document 45 2 preparation, processing and tracking of applications, and on occasion, testimony before the Bozeman City Commission as well as related equipment and vehicle costs. For kennel license applicants who simultaneously register three or more animals, the City potentially forfeits as much as $25.00 per non-altered dog, $10.00 if altered and $10.00 for unaltered cats, $5.00 if altered. The current fee resolution, Resolution 3233, does not clearly state that the kennel license application fee of $50.00 is separate and distinct from animal license fees. The purpose of Resolution 4145 is to make that distinction clear. The fee revision proposed in Resolution 4145 attempts to separate the costs of kennel licensees and pet license fees. Resolution 3233 currently reads: Resolution 3233, Section 4 Licenses for keeping or maintaining a kennel within the corporate limits of the City of Bozeman shall be issued for a license year beginning January 1. The annual fee for each license shall be $50.00. The fee for initial first time licenses shall be prorated for the first year from the date such license issued. The proposed language in Resolution 4145 reads: Proposed Resolution 4145, Section 4 Licenses for keeping or maintaining a kennel within the corporate limits of the City of Bozeman shall be issued for a license year beginning January 1. The application and renewal fee for each kennel license shall be $50.00. The kennel license fee is separate and distinct from animal licensing fees required pursuant to Bozeman Municipal Code 6.04.020. [Emphasis added] The language in Resolution 3233, Section 4 concerning prorated fees was removed completely. Pro rated kennel licensing fees are addressed in recently passed Ordinance 1754, Kennel Licensing Requirements, BMC 6.04.050, Section C, which reads: The kennel license fee shall be in an amount as set by Resolution of the City Commission, and the license shall expire on the thirty-first (31) day of December of each year, unless sooner revoked. License fees shall be reduced by 50% if application is made, and subsequently approved, between July 1 and December 31. The kennel license application fee is non-refundable. 2) DEPOSITS Staff recommends the deletion of Section 6 in Resolution 3233 if adopted as Resolution 4145. The City has not requested or collected deposits for redemption of animals impounded at the animal shelter in at least 15 years. The City does not intend to commence this practice. Resolution 3233, Section 6 reads: 46 3 A deposit shall be required to redeem an animal impounded at the animal shelter when such animal has not been spayed or neutered The deposit shall be refunded if the owner sterilizes the animal within 30 days of redemption The amount of each deposit shall be $50.00. The two changes recommended by staff in Resolution 4145, 1) formally and clearly disentangle kennel licensing fees and animal licensing fees and 2) deleting section 6, the “deposit” provision, clarify and streamline fees related to kennel and animal licensure in the City of Bozeman. The annual fee for each license shall be $10.00 for each altered dog and $25.00 for each unaltered dog First time licenses issued after July 1 shall be prorated on a semiannual basis. A late fee in the amount of $5.00 shall be assessed for all renewal licenses issued after February 15 of the license year. Section 2 Licenses for owning keeping or harboring a cat within the corporate limits of the City of Bozeman shall be issued for a license year beginning January 1. The annual fee for each license shall be $5.00 for each altered cat and $10.00 for each unaltered cat First time licenses issued after July 1 shall be prorated on a semi-annual basis. A late fee in the amount of $5.00 shall be assessed for all renewal licenses issued after February 15 of the license year. Section 5 48 Permits for owning keeping or maintaining an exotic or wild animal within the corporate limits of the City of Bozeman shall be issued for a permit year beginning January 1. The annual fee for each permit shall be $25.00. First time licenses issued after July 1 shall be prorated on a semi- annual basis If the permit fee is not paid on or before February 15th of the current calendar year a fifty dollar late registration fee shall be imposed. If application for a renewal permit is submitted after February 15th the application will be considered a new application and subject to all the requirements for a new application.
